HomeMy WebLinkAbout03-10-80 ~ • • CITY OF`LAKEVILLE SPECIAL COUNCIL MEETING March 10, 1980 The meeting was called to-order. by Mayor Lekson at 7:00 p.m. Roll call'was taken. Present: Councilmembers Lekson, Nelson, and Sindt. Absent: Zaun and Spande. Also present: Patrick-Farrell, City Attorney; Darrell Schneider and LeRoy Nyhus, Consulting City Engineers; Patrick McGarvey, City Administrator/Clerk. At this time Mayor Lekson presented the certificate of appointment of commissioners of the Housing and Redevelopment Authority of Lakeville, Minnesota. The council discussed the certificate and the terms of office as set forth fqr the individuals who also serve as members of the City Council. 80.123 Motion was made by Nelson, seconded by Sindt to adopt Resolution No. 80-30 apx~roving the appointment of the commissioners of the Housing and Redevelopment Authority of Lakeville, Minnesota. Roll call was taken on the motion. Ayes, Lekson, Nelson,. and Sindt. Nays, none. Absent, Zaun and Spande. At this time Mayor Lekson opened the public hearing on the proposed public improvement to extend sanitary sewer and make street restoration on Oak Curve. and Oak Shore Drive in the Oak Shores Second Addition. Mr. Farrell attested to the proper legal and mailed notice for the hearing. At this time Mr. LeRoy Nyhus presented overhead: slides on the project, which showed the proposed location for the lateral sewer and .water lines. Mr. Nyhus also stated that the City is proposing to install part of a future trunk line which would eliminate the need for the sewer lift station for this. project. He stated the cost would not be reduced to the benefited properties as the cost f_or the sewer lift station would only represent approximately 1/3 of the cost of the trunk line. However, it would. be a superior sewer system in that it will eliminate the need for a lift station which can. at times fail and is .more expensive to maintain. Mr. Nyhus stated that the estimated per front foot cost of the sanitary sewer was $40.15 and the water main, $19.65. Mr. Nyhus also showed a cross section of a proposed street which would be 34 feet wide, including the concrete curb and gutter, with an estimated cost of $25..58 per front foot. The total estimated rate of assessment for the sanitary sewer, water, street and city water and sewer connection charges is estimated at $96.23. At this. time Mayor Lekson opened the meeting for questions and comments from the audience. Mr. Gerald Hogan, 12645 Oak Shore Drive, asked what type of asphalt service the specifications would call for. Mr. Nyhus stated that the state specifications No. 2341 would be required, as .the curb and gutter would be the surmountable type. Mr, Harvey Richmond questioned about the lift station costs and other.-areas using it. Mr. Nyhus stated that the lift station would only be used by the properties receiving notice of the hearing; however, i.f_ the trunk line was installed there would be no lift station and these properties would pay approximately 1/3 the cost of the trunk line with other future areas contributing the rest of the cost. Mr. Jeff Smith asked if the new street would be put back in the same place as the existing street which is not centered in the right-of-way. Mr, Nyhus stated that the new street would be centered in the right-of-way provided it does not cause problems for the existing homes and drivetaays. P~Lr, Stewart Finks questioned on why the front foot method of assessment was being used. -1- • • • . CITY OF LAKEVILLE SPECIAL COUNCIL MEETING March 10,.1980 The City Administrator answered that the front foot is the most common way of assessing, however, it can be assessed on a unit basis or a combination of front foot and unit basis. Mr. Bi11 Andres asked if the cost of the. sewer trunk was being charged only to the properties on Oak Curve. Mr. Nyhus answered that only the .cost of the lift station would be applied toward the trunk cost. Vickie Casey asked who brought up the need for the proposed improvement project. Mayor Lekson answered that there are some problems in the neighborhood with some home owners experiencing septic system failures. Mr, Don Wysocki stated that he is one who has had septic system problems in the past and has spent a considerable amount of money trying to make the septic system work in an area where it cannot work. Mr, Smith stated that he lived next door to Mr. Wysocki and would attest to his problem. LeRoy Nyhus stated that .the sanitary sewer would be installed deep enough in .the street to pick up the lowest lots in the neighborhood. Mr. Gerald Hogan asked when the homeowner had to hookup to the systems and use them. The City Administrator stated that they have to be hooked up to both systems within two years .but that they can ..continue to use their own .wells for outside watering. He stated that the city system and private system cannot be interconnected. Mr. Richard Olson asked if the council would consider assessing the project on a unit basis. ~'he City Administrator stated that the council could consider it, however, it is difficult at timesMto assess on a unit basis if_there are. large differences in lot sizes. Mr. Smith asked about the period of assessment and the interest rate. The City Administrator stated that the :assessment period .would most likely.. be a minimum of 10 _years or a maximum of 20 years. He also stated that the interest rate ceiling had been eight percent, however, due to the bond market. conditions, the new limit may be 10 percent or higher which the City would have to charge. At this time Mayor Lekson asked if any other persons wanted to speak for or against the project. Mr. Smith stated that he was in favor of the project. There was no one else wishing to speak. 80..124 Motion was made by Sindt, seconded by Nelson to close the public hearing.. Roll call was taken on the motion. Ayes, Lekson, Nelson and Sindt. .The .City Administrator explained that the project could not be ordered by the City Council on March 10 because two members were absent and it requires a 4/5 vote of the council, and because of the bond market condition in which the City cannot sell bonds due to the seven percent limit on interest. Mayor Lekson explained that the item would be placed on the April 7, 1980 council agenda for consideration on ordering the project if the bond interest problem is resolved by the state"legislature. At this time Mayor Lekson opened the public hearing on the proposed public improvements to and.. within the Lake Villa Golf Estates plat property at 8:35 p.m. Patrick Farrell attested to. the proper legal and mailed notice for the hearing. -2- s • • • s CITY OF LAKEVILLE SPECIAL COUNCIL MEETING March 10, 1980 LeRoy Nyhus presented the project and showed mans with color coding showing the location of the various improvements. Mr. Nyhus explained the proposed cost. for extending the sanitary sewer and water trunks to the Lake Villa Golf .Estates property is estimated at' $357,200 with a lateral benefit ber foot. assessment rate for water of $25.00`. and for sanitary sewer of $22.50. Mr: Nyhus stated that the cost for extending the sanitary sewer line north along County Road 5 was $36,300, He explained that the third portion of the improvement is for the various improvements within the Lake Villa Golf Estates plat first addition in an estimated cost of $969,600. Mr. Steve Walker, representing Quoen. Ann Courts, asked how many lots are in the Lake Villa Golf Estates First Addition. Mr. Nyhus stated. that there are 187. Ions in the total plat and 53 would be in the First Addition. The City Administrator explained to Mr. Patrick G7ren°that the $36,300 estimated cost would place the sanitary sewer north along County Road 5 to a point west"of the present CB Radio business building and that his property would be assessed these casts. The City Administrator explained that due to the bond market .conditions and. the current limits not being adequate, that the interest paid by the City. and charged on the project would be higher than the bast eight percent. rate charged by the City. 80,125 Motion was made by Nelson, seconded by Sindt to close the public hearing. Roll call was taken on the motion Ayes, Lek"son, Nelson and Sindt. Time: 8.:56 p.m. The City Administrator advised those present that the item would be placed on the .April 7, 1980 council agenda to decide on whether or not to order the project. At this time the City Council reviewed a proposed relocation of a portion of the Lake Marion trunk sewer line, Project 79-1, within the George 4~Iarweg property onto a proposed new street. .80.126 Motion was made by Nelson, seconded by Sindt to adjourn the special council meeting..
