CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
February 14, 1980
The meeting was called to order at 7:40 p.m, by Mayor Lekson. Ro11 call
was taken. Present: Councilmembers Spande, Zaun, Nelson, Sindt and Mayor Lekson.
Also present: LeRoy Nyhus, Consulting City Engineer; Patrick Farrell, .City
Attorney; Patrick McGarvey, City Administrator/Clerk.
At this time Mayor Lekson opened the public hearing on Project 1980-1,
Holyoke Avenue utility extension, and the improvement of Holyoke Avenue
north from 202nd Street.
Patrick Farrell attested to the proper mailed and published legal notice
for the hearing.
At this time Mayor Lekson called upon Mr. Nyhus to present the proposed project
and its costs.
Mr. Nyhus first explained the need for the utility project by showing a map
from the Minnesota Department of Transportation for a proposed improvement
of the Holyoke Avenue and 202nd Street intersection possibly as soon as 1981.
He explained that the map indicated that the four legs of the intersection
would be widened and improved back approximately 900 feet from the intersection
in each of the four directions.
Mr. Nyhus explained that the City would want to get the utility lines installed
in the boulevard of the present Holyoke Avenue right-of-way before the road
is widened and new asphalt and curb and gutter installed.
Mr. Nyhus then showed overhead slides of three alternative ways of installing
the sewer and water to serve the area of Holyoke Avenue south of 202nd Street
and north of 205th Street.
Mr. Nyhus also explained how sewer service could be extended to the corner
of Holyoke and 202nd Street from the Lake Marion trunk project which is now
under contract and would be crossing 202nd Street to the west of this intersection.
Mr. Nyhus also explained that water could be extended to the same intersection
from the line which dead ends at 202nd Street and Iberia.
Mr. Nyhus then reviewed alternative one and explained that it was the most
cost effective way of extending sanitary sewer and water service to the
properties which do not presently have it along Holyoke Avenue north of 205th
Street to 202nd Street. He also explained that the City needs to loop its
water trunk system in this area for improved fire protection and that the
present 4 inch line on a part of Holyoke Avenue is insufficient for. fire
protection.
He stated that the sanitary sewer estimated assessment rate would be $24 per
front foot and that the water line front foot assessment rate would be $22.56
per front foot.
Mr. Nyhus then explained that the estimated cost for the City's share of the
improvement of Holyoke Avenue north from 202nd Street was 45 percent of the
project cost with an estimated front foot assessment rate of $29.12 per foot.
He explained that Dakota County would pick up 55 percent of the cost on
the roads which are on the county system.
At this time Mayor Lekson opened the meeting for questions and comments from
the citizens present.
Mrs. Kraft asked the council if one of the reasons it was considering extending
utilities to this corner was due to the potential location of the City Fire
Station near it.
Mayor Lekson explained that the most important reason for the utility improvement
at this time is because of the pending road improvement which the City is
asking the Minnesota Department of Transportation to approve and participate in
possibly as soon as the summer of 1981. He stated that it would be an error
to improve the road and then have to dig it up to install the utilities in later.

Mayor Lekson also explained that the City is considering a location of a
fire station but that no final decision has been made on that matter.
The City Administrator explained that the City Council may be entered into
a cooperative agreement with the Minnesota Department of Transportation and
.Dakota County to upgrade the intersection hopefully as soon as the 1981
construction season and no later than 1982.
Mr. Ed Korba asked if the sanitary sewer line would be placed in front of
the homes on Holyoke Avenue on the east side or at the rear as proposed
four years ago.
Mr. Nyhus stated that the sewer and water would be installed in the boulevards
one on each side of Holyoke Avenue. Mr. Nyhus explained that when the 12-inch
water line is installed, the present 4~inch line would be abandoned.
The City Administrator explained that in addition to the estimated front foot
assessment rates for the sanitary sewer and water, that city unit connection
charges in 1980 were $625 for water and. $460 for sanitary sewer, and the
Metropolitan SAC charge for sewer is also required at $425 per house in 1980.
Mayor Lekson stated that he had received a call from Mr. Steberg concerning
project assessment costs who was unable to attend the hearing.
At this time Mayor Lekson opened the meeting to questions and comments from
the council.
Councilman Zaun asked how Mrs. Kraft's` property would be served. Mr. Nyhus
explained that her property should be served by water with the extension of
a water line between Holyoke Avenue and Iberia in the future. He also
explained that she could get service for her house from the new Lake Marion
trunk once it is installed to the west of her.
The City Administrator stated that the current City interest rate on assessments
is 8 percent, but that it may have to increase if the legislature raises the
rate which the City. can be charged for interest on borrowed money.
Councilmembers Spande and Nelson both stated they felt it important for the
City to install the utilities prior to the improvement of the road by the
City, State and County.
80.82 Motion was made by Zaun, seconded by Nelson to close the public hearing.
Roll call was taken on the motion. Ayes, Spande, Lekson, Zaun, Nelson and Sindt.
80.83 Motion was made by Zaun, seconded by Spande to adopt Resolution No. 80-27
ordering Improvement Project No. 1980-1, based on Alternate #1 for the
utilities, and authorizing the City Engineer to prepare plans and specifications.
Roll call was taken on the motion. Ayes, Lekson, Zaun, Nelson, Sindt and Spande.
The City Administrator explained that the public hearing on the assessment of
the properties involved would be held probably in September of 1980. He
stated that the council could assess the cost for up to a period of 20 years
and that the interest rate may be as high as 9 percent given current interest
market conditions.
80.84 Motion was made by Zaun, seconded by Spande to adjourn the special council meeting.
Roll call was taken on the motion. Ayes, Spande, Lekson, Zaun, Nelson and Sindt.
