Planning Commission Work Session

The Planning Commission work session commenced at 6:04 p.m. in the Marion
Conference Room at City Hall.
Commissioners Present: Chair Davis, Drotning, Glad, Grenz, Lillehei, Pattee and ex-
officio Bussler.
Staff Present: Planning Director Daryl Morey, Associate Planner Allyn Kuennen, and
Planning Consultant Daniel Licht of NAC.
2009 Zoning Ordinance Update (Sections 1-14 and 96)
Chair Davis opened the work session.
Dan Licht indicated that the draft revisions to Sections 1-14 and 96 of the Zoning
Ordinance were reviewed by the City Attorney's office and several changes were
recommended. Staff distributed NAC's memo identifying the City Attorney's
recommended changes.
Staff and Mr. Licht reviewed the list of proposed revisions as outlined in his updated
February 26, 2009 memo incorporating the recommendations from the City Attorney.
Each revision was discussed by the Planning Commission to determine if it required any
additional amendments or revisions. The Planning Commission directed staff to
consider the following revisions:
1. Remove the word "commercially" from the Animal Kennel definition.
2. Insert commas after the word "food" and "containers" and remove "in individual
servings" from the definition of Restaurant (Convenience).
3. Insert commas after the word "food" and "dishes" in the definition for Restaurant
(General).
4. Remove the word "useful" from the definitions of Service Business (Off Site)
and Service Business (On Site).
5. Review the term "foster care" within the definition of "Family" with the City
Attorney and identify each segment of the definition with an "i)", "ii)" and "iii)".
6. Add a comma after the word "fabric" within the definition of Flag.
7. Replace the word "passenger" with "motor" in the definition of Garage, Private
(Residential).
8. Modify the definition of "Golf Course" to read: "....and related clubhouse or
banquet facilities".
9. Remove the wording after "unit lots" from the definition of Lot, Base.
10.Add a definition for "Foundation" per the building code definition.
11. Revise Sections 11-3-3.A and 11-4-3.A to remove reference to modifications of
the application by the Zoning Administrator, the number of copies required and
the 500 foot adjacent properties owners list.
12. Verify with the City Council the recommended change from a 4/5 vote to a 3/5
simple majority vote for CUP approvals.
Staff concluded the Zoning Ordinance discussion by reviewing the schedule for
completing the update. The next Planning Commission work session is tentatively
scheduled for the second meeting in April where Chapters 15-22 of the Zoning
Ordinance will be reviewed.
Daryl Morey also presented an update on the Wealshire of Lakeville_Alzheimer care
facility that is proposed to be located on land north of 205tH Street and west of I-35. He
stated that the proposed location of the facility that was reviewed at the January Stn
Planning Commission work session was shifted to the northeast by the development
team due to grading costs. The revised location was .reviewed by the City Council at
their February 23~d work session. Mr. Morey then concluded the meeting with an .update
regarding the subdivision of property owned by Doug Pietsch at 12299 Lucerne Trail
related to an amendment to the Zoning .Ordinance approved last summer concerning
exceptions to lot area definitions for unsewered single family lots.
