The meeting was called to order at 7:30;, p.m. by Duane Zaun, P,cting Mayor.
Rollcall was taken. Presents Councilmembers Zaun,, Sindt, RnrigKt, and
Nelson. Absent: Mayor Jensen.
Also 'present: Roger Knutson, City Attorney; Keith Nelson, City Engineer;
Jim Robinette.,: Public Works ..Director; Patrick Mc Garvey, City Administrator/
Clerk.
Councilman Zaun stated .that Mayor Jensen: would arrive late for the council
:meeting, as he had to speak at another meeting.
82.285 Motion was made by Enright, seconded by Sindt to approve the council minutes
of the June'21, 1982 council meeting as amended to include the quotation
that. councilman Nelson had left the meeting just before the Community
Center .presentation.

82.286 Motion was made by Nelson, seconded by'Enright to approve the .claims fore
payment as presented.
Roll call was. taken on the motion. Ayes, Zaun, Sndt, Enright & Nelson.
'Staff reports: The City Administrator reported that. the: .council had met.
at a work session prior to'the meeting, ,and that there would be a few
items for the .council. to take up under Other Business as a result of that'
work session,
.82.2:87 Motion was made`by Sindt, seconded by Enright to ,receive the .minutes of
the Natural Resources Committee meeting.
Rolf call was taken on .the motion. Ayes, Sindt, Enright, Nelson,'Zaun.
At this time Mr. Keith Nelson reviewed his letter of June 30, 1982 concerning
the request of ..Walt Sternberg and other property .owners along County. Road
44 for the City to extend. sanitary ewer to their property.
At this time Mayor Jensen. arrived and took his chair.
Discussion centered on whether or not some or all of the lots.`of the
property owners that are requesting antary sewer to .serve would be
buildable lots. The City administrator Tread a letter of March 19, 1980
to Dr. O'Brien to give the council an idea of the conditons.a:~prevous'
council had placed for thecons~ructon of Dr: O'Bren's pzroposed home
on his .property. along County Road 44. It-was pointed out that unless the
council, would-consider and grant some variances, the other lots, including
Dr. O'Brien's,:would..be ~nbuildable, and that a sewer system would obviously
not be necessary for unbuldable property.
The staff recommended-that the property owners and/or Cty_work together to
determine .what the ether-four bu~.ldable parcels;.would require in a way
of variances in conjunction with the preparation of a preliminary report-
so that the coun:oil would have the"full picture when determining whether
or not to call a public hearing on the izm?rovement as requested.
82.288 Motion was made by Jensen, seconded by Zaun to, authorize the City Engineer
to do a preliminary report for a cost nat to exceed .$1,000 on the extension
of utilities to serve-the properties along County Road 44, subject to the
property owners working with the City to present site plans for the re-
platted lots and potentialbuilding sites:

At this time: Mr. Keith Nelson presented hispreliminary report concerning
.the construction of a road to serve the Acorn Heights addition on the east
side of I-35. Mr. John Houston was present as one 'of the; property owners,
of the plat:. -

It was recommended that the council receive the report and call a public
hearing since one other property,:owner besides the. owners of the .Acorn
plat. would be involved as benefited property owner for the construction of
the City street...
82.2£39 Motion was .made by Zaun, seconded by Enright to receive the preliminary,
report .and call a public hearing fnr August 2, 1982 at 7'x30 p.m.°or thereafter.
Roll call was taken on the. motion. Ayes, Nelson.,. Jensen,.Zaun, 5indt, Enright.
At this time Mayor Jensen opened the public hearing on the proposed extension
of Jacquard Avenue to 205th Street. Mr. Keth.Nelson presented a,preliminary
report on the proposed extension showing a rural and urban section.. He
presented slides showing the proposed project and costs, and-assessment
schedule.
Mr: Jerry Clay. was present and. stated that he had no preference as to which
type. of street the City Council chose to construct. Mr. Jack Lankas was
present and indicated some preference toward the rural section.. The
councilndcated that the streetzassessment would be for at beast a 10-
yearperiod or possibly longer..
82.29? Motion was made by Zaun, seconded by Nelson to close the. public hearing...
Roll call was taken on the motion. Ayes, Jensen, Zaun, Sindt, Enright, Nelson.
82.291 Motion was made by Sindt, seconded by Nelson to adopt Resolution No. 82-49
authorizing the City engineer to prepare plans and specifications for
the extension of Jacquard .Avenue to'205th Street. based on a rural section
design.
Roll calf was taken on the motion. Ayes,.Zaun, Sndt, Enrght;'Nelson:, Sensen.
At this time Mayor Jensen opened the public hearing on the proposed. wine
license for the Prairie Provider Eatery and application of Cynthia Luthra.
There was no one present wishing to speak on the matter.
82.292 Motion was made by Zaun, seconded by: Nelson to close he public hearing..

82.293 Motion was made by Zaun, seconded by Nelson to approve awine-license
for Cynthia Luthra for the Prairie Provider Eatery.

82.294 .Motion was made by Nelson, seconded by Enright to approve an ,on-sale 3.2
beer license to John:Dwy~r, Sr. for the; old Station Pizza.
Roll call was taken on the motion. Ayes,. Nelson, Jensen, Zaun, Sndt, Enright.
The Park & Rec. Director and City Administrator. presented areport concerning
the potential donation. of a 2:65 acre parcel of land next to Dodd Park
on the south side of Dodd,Boul.evard They .pointed out that the property..
owners wished to give th,e property to the City'but were.. requesting City
support in possibly receiving a rebate an property taxes they had paid
on the property. in r~cent,:years.
82.295 Motion .was made by Zaun, seconded by Nelson to accept the donation of a
2.65 acre parcel of Land from the.. estate of Herbert.: A, and.-Jenny Griep
throughtheir trustee, Crystal.~~ein, and. authorize and direct the City
attorney to prepare .the deed necessary for the .conveyance of the property-
to the City .and-request Dakota County to rebate the property taxes on
the property. -

Keith Nelson presented the plans and specifications for Project $2-3,
the_Orchard Lake utility project on 175th Street and street, improvement'.
82.296 Motion was made by Enright, seconded by Zaun-to approve the plans and
specifications for Project. 82-3 and set. August 6, 1982 as the bic~ taking
date at 10:40 a.m.
Ro11 call. was taken on the motion. Ayes., Zaun, Sndt, Enright, Nelson, Jensen.
....82.297 Motion was :made by Enright; seconded,.by Sndt to adopt .the budget schedule
proposed by staff for preparation of the 1983 City budget.
Roll call-was taken on the motion. -Ayes, Sindt,.Enright, Nelson, Jensen, Zaun.
The City Attorney recommended approval of an easement with Myron and Al
Falkner for parcels No. 3 and 4 for payment in the amount of_ $90.00 for
parel 3: and $675.00 for parcel 4 on project No. 81-12.
82.298 Motion was made by Zaun, seconded by Nelson to approve the easement agreement
and payment to:Myron and Al Falkner as recommended by the City attorney.
Roll call was taken on the motion. Ayes, Enright, Nelson, Jensen, Zaun, Sindt.
82.299. Motion was made by Zaun, seconded by Sindt to amend ,Resolution No. 80-45
and. the development contract with Lake Villa Golf Estates to include the
corrected legal'clessription for the property being platted in the plat
as recommended by the Ci y attorney, Resolution No.-82-49(A),
Roll call was taken on the motion. Ayes, Nelson, Jensen, Zaun, 5indt, Enright.
The City attorney discussed with the council the policy the council may
wish: to use in`the assessment of the Ames-Everson property on the south
side of-185th Street: Councilmembers indicated that they would treat-the
property in a fair manner consistent with the other policy they had set
for assessment of the 185th Street improvement.
82.300 Motion was.made by Nelson, seconded by 5in,dt to extend the contract by
30 .days with McNamara`Vivant'on Project 82-2 for the sewer construction
as reques ed by he contractor.

82.301 Motion was made-by Zaun, seconded by Enright to direct .the City administrator
to prepare a r€~so3.ution"establishing a consent agenda far COnsideratian'
by the council at'the July 19thcouncil meeting fore. the _~surpose of the
consent agenda being used by the council at future council meetings.
Roll call was taken on the. motion. Ayes; Zaun, Sindt, Enright, Nelson, Jensen.
82.302 Motion was made by Enright, seconded by Nelson to direct the City administrator
to place on regular council agendas an item for, "Citizen Comments", to be
apart of each. agenda in the-future"with up to 30 minutes allocated for
this item, and that the council_begn the regular meetings at 7:00 p.m.;
and end them at 10:00 b.m.

82.303 Motion was made by 5indt, seconded by Enright to establish a policy of_
the 5th Monday in any month beinga regularly scheduled work session for,
the City Council-with a written agenda prepared for the work session.
