CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
May 24, 1982
The meeting was called to order ,at 7:30'p.m. by Acting Mayor, Duane'
Zaun. Roll: cah w'as taken. Present: Counclmembers Nelson, Zaun,
-Sindtand Enright.. Absent:' -Mayor Jensen.
Also present:.. Darrell Schneider and Keith Nelson, Consulting City Engineers;
Roger Knutson, City 'Attorney, James Robinette, Public Works Director;
Patrick McGarvey, City Administrator/Clerk.
Acting Mayor Z,~un'openedthe public hearing on Project. 82-3 at 7:30 p.m.
and explained that Mayor Jensen would be arriving at the meeting later,
as he had another meeting commitment. Mr, Zaun explained the purpose of
the public hearing and introduced the staff present to the citizens in
attendance.
The City attorney attested to the proper legal notice for the public
hearing,
Keith Nelson gave a presentation using slides on the project and estimated
costs. It was explained that a t~ublc information meeting was held on
Marchll, 1982 between the staff and interested property owners along
175th Street from Orchard Lake Parke to Judicial Road. The engineering
consultants' preliminary estimate of the project costs for a typical.
lot wasfrom $12,100 to 14,800. Mr. Nelson gave a report on the 12 soil
borings taken along 175th Street and indicated. that the sanitary sewer.
would be an eight inch gravity line to Judicial Road, and the water line
would be 2 inch in size.. He further indicated that-the existing .road
is 16 to 24 feet wide presently. He indicated that the new road would
be put in at about the same location asthe existing road, and that..
the. asphalt .paving may have to wait until 1983 depending on the progress.

asphalt road would be approximately 24 feet wide but may have to be as
narrow as 20 feet in some locations.
Mr. Nelson indicated. that the estimated project cost is $313.,000:. He
showed a slide of the project area and area of proposed assessment and '
indicated that a 100 foot wide lot on a front foot method had an estimated
cost of $13,135, and that on a unit basis the estimated assessment would
be $12,825,
At this time, Acting Mayor Zaun opened the meeting for questions and
comments from citizens in attendance.
Steve Johnson asked if the current contractor on the-KOdiak.Avenue project
could be doing the work on this project. Mr. Nelson stated. that it would
be an individual bidding process for this project., anc~_hecouldnot
guarantee that Richard Knutson, Inc. would be .the low bidder, although
he would have an interest. in it due to his work nearby.
Glenn Stifle asked about the need for a retaining wall infront'of his
property. Mr. Nelson answered that they would c1o all they can to try
to avoid the need for one...
At this time, Mayor Jensen arrived and took his. seat.
Ralph Trabant asked about the possibility of getting the project extended
to serve property he owns along Judicial Road just north of 175th Street.
The City administrator explained that it'would be necessary for him and
any other property owners to sign petition and have .the council<receive
it and approve it and add.-it to the project or for the council to call
another public hearing if the other property owners did not wish to sign
a petition waiving the need for the public improvement hearing,
Mr. Robert Layeux asked about connection charges, and, Mr. Nelson explained
why they area used and. what they pay. for.

Stever Johnson asked about. the design of the road through. the hill area
_by unit four in the. project area, and Mr. Nelson explained how he intended
to design for that area.
:Councilman Nelson .asked those in attendance if ..they were in agreement
with the project going ahead given"the cost estimates they had juste'
been given.
Most of those in the audience did not indicate any opposition.
The City administrator explained that the project would be assessed over
a 20 year period with 20 equal principal payments, and that the interest
would be paid on the unpaid principal each .year most likely at a rater
at thin time of l2g per year an the-unpaid principal with. the first.
year to be fora 15 month period.
Most citizens in attendance at the meeting were in favor of_ the council
using the unit assessment method.
Bob McDonald asked about the number of units assigned toparcel No. 17,
and it was indicated that'one unit was calculated.
.82.228 Motion was made by Sindt, seconded by Nelson to close the public hearing.
Roll call was taken on the inotori.~ Ayes; Nelson, Jensen, Z~un, Sindt, Enright.

82...229 Motion was made .by Zaun,'seconded`by Nelson to adopt Resolution No. 82-40
ordering project 82-3 and authorizing Consulting Engineers Diversified
to prepare plans and specifications.
Roll call. was taken on the motion,. Ayes, Jensen, Zaun, Sindt, Enright, Nelson.
At this time the City administrator brought up the request by Dominion
Development to have the Gty authorize an'extension on ;awarding the
contract to Fredrickson Excavating for Valley Park 8th, Phase III, f_or'
60 days from June 1 to August 1, 1982.. It is recommended the council
authorize the extension subject to Fredrickson Excavating sending a letter
to the City indicating their approval of the extension as the-low bidder,,
82.230 Motion was: made by Zaun,.seconded by Nelson to grant '.the extension on the
Val~.ey Park 8th, Phase III; improvements to August 1, 1982, subject to
receiving a letter from Fredrickson Excavating agreeing to the extension..
Roll call was taken on the-motion. '.Ayes, Zaun, Sindt, Enright,, Nelson, Jensen.
82.231 Motion was made by Zaun, seconded b_y Nelson. to authorize the filing of
two comprehensive plan amendments by the City of Lakeville for. the. purpose
of including in the 1990.Urban Service Area. acreage for aroperty being
served by sanitary sewer under project 81-12 and for. the~Orchard'Lake
Estates plat, to the Metropolitan Council.
Roll call was: taken on the motion. Ayes,. Sindt, Enright, Nelson, Jensen, Zaun.
At this time the Public Works Director discussed with the council work
needed. to alleviate a'problem with a pond in Dakota Heights. which had
.reached a highelevaton due to test pumping from. the new"city well.
The property owner near the pond indicated their willingness to live with
the temporary. so cation to see if it utill be satisfactory.
Mayor. Jensen adjourned the meeting at 8:40 p.m.
