82.107 .Motion was made. by Zaun; aeconded by Nelson to approve the minutes of the
March`1, 1982 'council. meeting.

Staff reports..:
The City Administrator presented a copy of a lawsuit filed against the-City
concerning C7fficer Justen and-.the Police Department.
82.109 Motion was made by Sindt,..secondedby Zaun to receive the .minutes of the
Park and Recreation .and Plannina Commission meetings..
Roll call was taken on the motion. .Ayes, Zaun, Sindt,; Enright, Nelson & Jensen..
At this time. Mayor Jensen recognized Mr. John Young, who presented`. his
application fora variance to construct buildings on a ,parcel of property
he owns on' he west side of. I-35 south of 215th Street. Mr. Young presented
his arguments for the buildings"he had requested and stated that he would
be satisfied with the City allowing him to build only one single family
home'on the parcel...
82.110 After considerable discussion, motion was made by 5ndt, seconded by Zaun
to refer the matter of the use of this property and the variances requested
_ back to th'e Planning Commission and direct that a study of the potential:
use of all the. property on the south side of County Road 70, being 2-10th
Street and the west side of I-35 within the city o~'Lakevlle, be evaluated
and recommendations made, to the City. Council on the compatibility of.
present and. future land uses in that area, with all the costs for the
.City to be ,paid. for by the Ct~:of_ La:keville_

Mayor Jensen stated to Mr, Zak, who was in attendance at the meetng,...that
consideration of his application for P.U.D. zoning on his nravriertY should
also .await the study ordered by the ,council for this area of the city. l~s.
Zak indicated his willingness to wait, provided he, did not have to pay
any of the costs of the study.
82.111' Motion was made by Nelson, seconded by Sindt to include Mr. Zak's application
with the .study on Mr. Young's.. property and the .other property as x~reviously-
drected to the Planning Commission.

82.112 Motion. was made by Enright, seconded by Nelson to adopt Resolution No. 82-18
approving thefinal plat-of Central. Square .and authorizing the mayor and
clerk to sign a development agreement.

82.113 Motion was made'by Zaun, seconded by Enright to approve a special home
occupation conditional use .permit to Dr. Cindy M. Carlson Silbernagel
:for limited chiropractic services at_16278 Florida-way as per.. her appli-
'cation and..recommendations of .the Planning. Commission.

The-City Council discussed the .need for a Dakota County satellite jail
facilty'in northwest Dakota County and a court facility. It was the con-
sensus of the City Council to support such a facility, and the staff was
directed to prepare a resolution for the next council meeting stating
that position.
82.114 Motion was made by Nelson, seconded by Sindt to receive the .1981 annual.
report from the Lakeville.Police Department.

At this time, Mr. Keith Nelson, presented the preliminary engineering report
for .the improvement of 185th Street and Ipava Avenue. The council discussed-
the policy concerning the unit area assessment and coming. up with-`the
policy involving large parcels of property along these roads 'so that the
assessments are affordable at this time in relation to the dwelling units
using them.
82.115 Motion was made by Zaun, seconded by Sndt to receive the preliminary report
on improving 185th Street from Jamaica Path to Dodd. Road and Ipava Avenue
from 185th Street to 176th Street, and call a public hearing for April
26, 1982 at 7c30 p.m. at the Lakeville Senior High_School on the proposed
improvements.

A`t this time, Mr. Steve Michaud presented a report and recommendation from
the Park &.Recreation Committee and himself concerning the establishment o.f_
sail boat morings at Antlers Park an'Lake Marion.
At 9:57 p.m. Councilman Nelson had to leave the meeting to go to work.
Mr. Robert Perzel'spoke to the council on behal.f_ of the Lakeville Sa],inq
Club and argued in favor of establishing the proposed sailboat. morings.
Several citizens present spoke about their concerns. of overcrowding on the
lake and what the°additonal`morings might do.
82.116 `Motion was made by Enright,, seconded:bv Sindt to follow the recommendation
df the Bark &,Recreation Committee and establish up to 13 morings for
sailboats for a; one-year trial period at; Antlers Park on .Lake Marion.

82.118 Motion was. made by Zaun, secondedby Jensen to set the fee fora sailboat
moring at<$300 .ner season per moring.

- The City Council discussed the request of James McNearneY for;an'abatement
of interest on the storm sewer assessment he received for lots 3 and 4'
in McNearney's First Addition.' The staff is directed to meet with'_Mr.
McNearney and/or his attorney to attempt to resolve this matter.
82.120 Motion was made by Zaun, seconded by Sindt to approve the application of
Donald .Stein for a`senior citizen deferment on his assessments as per
the .application:`

82.123 Motion was made by Sndt,-seconded by Enright to receive the letter, from
Richard Ungar concerning .his request for the Gty to extend anitary sewer
and water to the Hec Fuzzy restaurant and proposed Ramada Inn near.-35,,
or a11ow an on-site we11 and septic,svstem.

82.124 Motion was made by Sindt,-seconded by Enright 'to extend the council meeting
beyond the 10x30 adjournment time.

Mr. .Keith Nelson gave a background report on the proposed mA_rovement of
Hull Avenue for street and storm sewer. work.
82.125 Motion was'made by Zaun, seconded b_y Enright to receive the preliminary
report and set a pubic'hearing for,ApriT 5,-1982 at 8:30 p.m. on the
proposed improvement of Hull Avenue .from 207th Street to `205th Street.

82.126 Motion was made `by Zaun,-seconded by .Jensen to adopt the"schedule of_ hours
effective January 2, 1983, through March. 31, 1983 for the iauor stores.
Rolla call was taken on the motion.' Ayes,`Enright, Jensen &Zaun,.. Nays, Sindt,
`who stated she wanted to see figures concerning the revenue during various
hours of the .:day.
At this time, he City Administrator gage areport-on the results of a meeting
the staff"held with residents along 175th Street from Orchard Lake Park
to Judicial Road. It was the-staff's recommendation that the council
authorize a preliminary engineering xeport for'the extension of sanitaryr
.sewer .and water along 175th Street 'west of Orchard ,Lake Park to Judicial
Road and the improvement of the road with asphalt. The City Engineer
estimated the costs of the report, including soil borings, not to exceed
$12:500.

..Diversified to take soil, borings and•to prepare a preliminary engineering
report for the extension of sanitary sewer and water. west of Orchard bake

82.128 Motion. was made by Enright, seconded by Zaun to table consideration of
a change in the City Code: concerning how developers are :allowed to pap
for park cash contributions to the city,

82,:129 Motion was made`by Sindt, seconded-by Zaun to approve spending from the
Utility Fund up to $8,500 for meter. reading. and inspecting of the flows
to various .segments of the city and metro 'sewer system. in Lakeville in
an .effort to see where problems, may exist in meter reading or infiltration.

82.130 Motion was .made by Zaun, seconded by Sindt to approve a purchase order
in the amount of $2,895 to Sauber'Plumbng to fix the roof on the water
booster station on Highv'eW Avenue.

82.131 Motion was made'. by Sndt, seconded by 7aun to receive the draft of the
lie~uor store employees manual.

82.13 Motion was made by Sndt, seconded by Zaun to approve a raffle license
for :.the. Bloomington Lioness Club and waive the .bond.

The council directed that the administrator have the signs inspected.-along
I-35 and a prepare a; .report pinpoa~ting-where the signs'°are and which .:ones
comply :and :don `t comply with the"city si~niordinance to report to the
.Planning Commission and City ,Council on the matter.
