The aneeting was called to order at 7:30 ~.m. by Mayor Jensen.' The pledge
of ai~egiance to the Flag was givene
Roll call was taken. Present: Councilmembers Nelson, 7aun Sindt Enright
and _Mayor Jensen.
Also Dresent: Darrell Schneider & Keith Nelson, Consulting City Engineers;
..Roger Knutson,. City Attorney; James. Robinette, Public Works Director, Patrick
McGarvey, City Administrator/Clerk.

82.92 Motion was made by .Nelson, seconded by Sindt to a~?prove the claims .for
~avment as presented plus the claim for the snowtrackers.

The City Administrator recommended the council.receive the'advisory,committee
meeting. minutes.
82.93 Motion was made by 7aun, seconded by Sindt to receive the minutes. of the
three advisory. committee meetings.

At this time Mayor Jensen reopened the public hearing, on the orox~osed mprove-
ment of the Holyoke Avenue and 202nd Street intersection project involving
State Highway SO and Dakota County Highway 64 and 15.
The City Administrator, explained four alternatives available to the City
Council on this project at this time. He also explained=that the state
:legislature had rejected a bill that would have allowed the Minnesota
Department of Transportation to enter into an°agreement with the City to
reimburse the City for the State's. share of the highway improvement costs
at a later date.
Mr.,Keith Nelson presented a map that showed how an alternative that.would
involve improving .only thr two county legs of the intersection at this
:time might be able to be accomplished. It was indicated that it would
require M-DOT approval o~ anv flan to improve the intersection either
partially or totally.
.Mrs. Steberg asked why the improvement .could. not be put-in without concrete
curb and gutter, and thereby at cost savings. The engineer and administrator
both explained that the installation of a wider road without concrete curb
and gutter would'. result in the necessity for a wider highway. right-of-way
with the ditches being pushed closer to the fronts of he homes along
Holyoke Avenue.. Concrete:.:s~urb and gutter helps narrow the amount of right-
of-wav needed..
Councilman Nelson asked if there-could be a lesser design, for imr~roving the...
intersection that might be approved'by M-DOT?.The staff'indicated that
this could be checked out with M-DOT.
Councilman Zaun stated that he did not :feel them; shou~.d be a lesser. design,
andthat possibly the City .:should wait a couple of years until the State
can pay its appropriate.. share oL the improvement, which 'will most likely
be higher than today's fguros :for.. all parties.
Councilmember Sindt .asked about dranage`consideration, and Mr. Nelson
showed the plan for :controlling and directing storm drainage.

Councilmesztber Enright stated that-in two years, everyoneinvowed in the
project will most likely be paying more for it, including the City of
Lakeville and .property owners which .would be assessed for a portion of the
COSt. '
Mrs. Kraft mentioned that people are driving through the new stop signs
placed at the intersection. Mayor .Jensen explained that this would be an-
enforcement problem of the police department.
After more discussion, it ..was the consensus of the council to continue the
public hearing to allow the staff to meet caith Pd-DOT to see i.f other types
of improvements might meet their approval.
82.9 Motion was made by Zaun,.seconded by Sindt to continue the public hearing
to April. 5, 1982 at 8:00 p.m, at the regular council meeting,

The City Administrator advised' the council that Mr. .John Young had reeducated
the .council to able'his application for a variance and a P.U.D. conditional
use permit, as he could not be `in attendance at the. meeting.
82.95 Motion was made by Zaun, seconded by Nelson to table to the March l5, 1982
council .meeting the application of John Young as requested by the applicant.

82.96 .Motion was .made. by Sindt, seconded by Zaun to apprave the preliminary plat
of Niakwa Village 3rd Addition as recommended by the Planning-Commission.
Roll call was taken on'the motion. Ayes, Nelson, Jensen, Zaun, Sindt, Enright.
82.97 Motion was made by Sindt,'seconded by Zaun to direct and authorize the 'City
Attorney to take. appropriate steps 'to get the Ardmor _Mobile Home Park drainage
ditch project completed by the park. owner.

82.•.98 Motion was made b_y Zaun, seconded by Nelson to set he Board of Review
meeting of the City Council, for June l5, 1982 frosty 3 to 7 p.mo at the
.,council chamber, as requested by the :Dakota County Assessor°s Office.
Roll call was taken on the motion. Ayes, Zaun, Sindt, Enright, .Nelson,. Jensen.
The City council took up..consideration of the proposed Metro~?olitan Develop-
menu Framework Guide chapter on storm, water management .and directed the
,staff to prepare a resolution for adoption by the. council at the next council
meeting. -
Mr. Steve Michaud, Park & Rey:„ Director, ;was pre ent to'discuss a memorandum
to the coLaazcil concerning volunteer assistance for the park maintenance
and recreation programs: in the community.
82.99 Motion was ma~.e by'Zaun, seconded by Sindt to' endorse the concept of volunteerism
as recommended by Mr. Michaud.

82.100 Motion was made by Zaua~, seconded bV Nelson to adort Resolution No 82-3.7
requesting permission for the. City to remove a site line hazard from a
:..state road right-of-way at the intersection of Dodd Road and Trunk High~ray 50.

82.101 Motion .was madeby Nelson, seconded by Sndt to approve a purchase order
in the amount of $3,125.40 to Glarev°s forfire department equipment as
recommended by the Fire Chief.

The City,Administrator and r2r< Keith Nelson .presented arecommendation for
-added storm sewer improvement; work as a Dart of the Ix~ava avenue project
from .176th Street north..to the new elementary school sites
82.102 Motion was made by...Nelson., seconded by Zaun to authorize storm drainage
work to be added to the improvement plans on project 81-3 and authorize
-'the City Attorney to acquire the necessary easements for the storm sewer
improvement work from the affected property owners through condemnation®'
if necessary.

The City:. Administrator advised. the ,council of Mr. Richard Ungar'sxenewed
interest in building the Ramada Inn along the east side of I-35, and that
he would be requesting the City to possibly extend sanitary sewer and water,
because he has now received xenewed interest in permanent financing for
the building.
82.103 Motion was made by Nelson, seconded by ?dun to authorize the City ~~rninistratar
to approve the administrative split of lots 12 & 13, block 1, Lkvl. Village, as per a
certificate of survey for the Zw~bc~ property near the police station.

At this time Councilman Nels indicated that `he would like to have the
council reconsider their. vote on the application of Ken Zak f_or a P.U.D.
zoning on his. property on the west 'side of I-35. Mr. Nelson indicated he .
had met with Mr, Zak. and felt. that there may: be away for Chas matter to
be handled so that Mr. •Zan could operate the-body. shop in his large garage
on the property.
82.104 Motion was made; by Nelson., .seconded. by Zaun to-reconsider the vote on the
Zak rezoning application.

82.106 Motion was made by 7,aune seconded by Nelson to authorize and approve the
mayor and city clerk tosign a deed conveying a small niece ofVcity property
near Upper-209th Street and Nola Avenue.
