January 28® 1982
The meeting was called to order by P?avor Jensen at 7:30 p.m. 'Mollcall-
was taken. present:: Cbunci.lmembers Nelson, Zaun, Sindt, Enright & Mayor
Jensen.

Mayan..Jensenopened the publichearing on the ,proposed improvement of
Holyoke Avenue/202nd Street;.. which involves State Trunk Highway SO and'
Dakota County 'Highways 64 and°15, and gave a statement to the citizens
present. concerning the importance of good .roads and transportation.''
The mayor_alsostatedthat the purt~ose of the hearing was to ~oresent the
.project to the citizens and to listen to tkteir ideas regarding it.'
The .City Clerk attested to the proper .legal. notice for the hearing..
The City Administrator/Clerk gave a history of the planning for this project
which began as far .back. as 1976 and 77 when some of the citizens on the
corner requested city. utilities be extended. It was explained that the`
utilities could: not be extended, because the sanitary sewer treatment
plant capacity was limited at the time and the City could not get hermits
to extend the city sewer system until the new Empire Treatment ]?lane
taas finished by the Metropolitan Waste Control Commission. planning for
the improvement of the roads within the intersection began 'in 1979®; to"-be
coordinated with the completion of the utilities once 'th'ey could be. ,
extended into the intersection. The city did extend sanitary sewer and
water into the intersection'n 1981..
The administrator explained...,.that the Dakota County Board of Corr:~mmissioners
had .budgeted the county°s share of the road improvement costs for 'County
.Roads 64 and 15 in 1981 for the 1982 budget. ~'he county pays a share of
the improvement costs on the counttl highways on a percentage sx~lit with
the city that the improvement .falls withinJJ The administrator explained
that the Minnesota Department of Transportation does not have its share
of the costs available in 1982; and for that reason, an agreement would...
be•necessary withthe state whereby the city_ may advance the state its
,share of the costs from our MSA fund. and be repaid by the state a later
year when M-DOT can fund its share from its budget.
At this time ~Mr. Keith Nelson from Consulting Engineers Diversified explained
that their firm had been retained by-the city to prepare the encxineering
plans on the _nroject, and then. he presented slides showing the layout of
the proposed improvements and c~aV`e the breakdown of `the cost estimate.
- The estimated, cost of the nrC3 j ect is $756, 400 , ~aitls Dakota County expected
to .t?ay approximately $110,(10Q, .Minnesota r~epart?iaent of Transportation
to pay $240,000, City. of Lakeville to _pay $211,806,. and $194,594 to be
assessed against parcels of property along the'road-right-of-ways. Mr.
Nelson stated that the current city .policy for assessing. street. costs
on MSA streets is $24 per front foot for. residential property and $36
for Commercial or industrial. and institutional property- The; City of
Lakeville owns two parcels within the project area for which the assess-
ment based on the above pokey would be apxroximate].y $24,000 out of the
$194,000 proposed to be assessed to proner~Cy owners'.
At this time Mayor Jensen called upon those wishing to speak regarding
the. project.
Ms. :Leonard Benison, an attorney, stated that he was representing many of
the property owners in,the area, and that there had been a meetingon
January 26th attended by most of the people in the area. Their opinion,
was that one, they .don°t want to see sidewalks along Hol~~oke Avenue; t~ao,
the .project does not need curb and..guttera hree, in their opinion, the
ditches will adequately convey drainage water, and they don°t feel the~z
should be assessed any of the costs.
Mr. ~entson stated that then,felt the intersection does need improvement,
but that it is the responsibility of the state, city and county to pay
for the imx~rovement costs.

Mr. Bentson stated that the :people he represented are very ox~posed to
..the project as proposed.
;b2r. Elgersma stated.'.that he lived in the area for `30 years and cauestioned
why there-could not just be a four-way stop intersection installed.:
Mrs. Stab@rg spoke against the installation of sidewalk and concrete curb
and ':.gutter..
.Mrs. Frances..Kraft stated that she had had mud. damage her promerty as a
result of :the utility improvement project and. would. not want to go through
that again.
Mr. Dennis.Kolbrek asked what the. estate ,laws are regarding this type of
a project and questions concerning the di~:ensons of the project.
Mr. Paul Clark stated that he lived Near the cattle pass on Holyoke Avenue..
and was concerned with the vroposed slope-gf his yard'.
Mr. Elmer Morris., representing the ~~nnesott~a. Department of Transx~ortation
State Aid Department, stated that :.after .conferring with. the design people
at the District 9 office, the protect as proposed. was what `the department
was recommending for improving his `intersection.
Mr. Keith Nelson stated that if the ,project goes ahead, there would be a
detour necessary to 'accommodate the construction of from'four.to six :weeks
with access being provided only to local -residents living in the. area..
Pfd'. Bentson asked why the city is loaning money to A4-DOT interest free.
Mayor Jensen explained that the: city may loan the ~aoney if it has an agree-
ment with PSI-DOT to be repaid at.a future°date, and that the ctv is not
receiving'intereston its money directly at this time and by advancing
the .construction of the project, both the state and city would save money.
because it could be built at today°s costs rather than at an anticipated
higrier cast. in later Years .
Mr. Babe Murphy asked about the lowering of Holyoke Avenue as it pertains
to drainage north of 202nd Street.
Mr. David Hendricks stated that he has been a resident along I3olvoke
Avenue for 19 years and did not'want to .c~ay for an_y more road improvement
projects nor .any assessments.
At this time counclmember Sindt-asked if 'Trunk .Highway 50 might be ~°e-
located in-the .future...
Elmer Morris .stated that there had been some :discussion, but there has
been no decisions on it and probably wouldn°t be for some time.
Councilman Zaun stated that he felt the design is probably acceptable as
is, 'but that he was concerned with the definition of °°benefit°' and would
the benefit to the property owners be as proposed. He stated that curb
and gutter has not. been along these roads~in the past, and that installation
at this time may constitute a benefit. Councilman Zahn also :thanked
the peolale for their fine comments during the hearinc°o
Councilman Nelson asked if the state would particx~ate for its share in
a lesser project. Again, Mr. Morris stated that.. he felt from his
conversation. with thedesign people that this was what the state would
be requiring as a minimum design for improving the intersection.
The city administrator read from the city transportation plan the projected
traffic flows at the intersection of 202nd and Holyoke versus 210th and
Holyoke.

At this time Mayor.Jensen thanked.. the peot~le for their comments and
attenc~ance.at the meeting and suggested that the council. table the 'decision
on the project to the first meeting in March.

ao March 1, 1982.

`nroject.79.15 for the Dakota Heights. well for the set-un and extra bailing
of sand-from the well.
