HomeMy WebLinkAbout11-10-83 z = ~ , • • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING NOVEMBER 10, 1983 The meeting was called to order at 7:05 p.m. by Acting Mayor Nelson. Roll call was taken. Present: Council members Nelson, Sindt, Enright, and Harvey. Absent: Mayor Zaun. Also present: Roger Knutson., City Attorney; Frank Kriz and Keith Nelson from Consulting Engineers Diversified; James Robinette, Community Development Director; Patrick McGarvey, City Administrator/Clerk. At this time the city council received the canvas report from the city clerk's office on the November 8, 1983, city election. 83.521 Motion was made by Enright, seconded by Sindt to approve the report of the November 8, 1983 cixy election results. Roll call was taken on the motion. Ayes, Nelson, Sindt, Enright, Harvey. At this time Mayor Zaun arrived and took his chair. Mayor Zaun opened the public hearing at 7:30 p.m. on the proposed improvement of the intersection of 202nd Street and Holyoke Avenue, which is County Roads 64 and 15 and Trunk Highway 50, and outlined to the citizens present how the meeting would progress and be conducted. The city clerk attested to the legal notice for the hearing. One resident indicated that they did not receive written legal notice, and the clerk checked the records and indicated that the mailed notice had been sent to their address under the name of the former owner and themselves and it had been returned by the U.S. post office. At this time Mr. Keith Nelson showed slides and maps showing the proposed 1982 intersection improvement project and the revised layout number 3 for the proposed 1983 improvement of the intersection. Mr. Nelson indicated that the street would. be 44 feet wide where it meets the intersection of 205th Street. Mr. Nelson also showed slides showing the cross section of the road where it is to be constructed with concrete curb and gutter versus a ditch section, both of which would meet Minnesota Department of Transportation requirements. The slides indicated that the curb and gutter section would save more trees along the route and would require less right of way and acquisition of the citizens' front yards. Mr. Nelson showed a slide of the project costs, which were estimated to be $950,600. He also showed a slide .indicating the project schedule for construction of the project in 1984. ' • • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING November 10, 1983 At this time the city administrator indicated that the policy of -the city has been such that assessments at the rate of $25.1.0 per front foot for the residential zoned, developed and used property and $37.65 per front foot for the commercial zoned property would be the maximum rate to be assessed for these. improvements in 1984. At this time Mayor Zaun opened the meeting for questions and comments from the citizens present. Mrs. Perry indicated that they own 388 feet of property on 202nd Street and that the plan .indicated only 312 feet would be improved. She indicated that they did. not feel they needed the improvement or could they stand an assessment for that amount of front footage at the proposed rate. Mrs. Myrna Steberg stated that she did not feel the benefit to their property would be $12,000 based on the proposed rate for the footage they own. Mr. Bruce Elgersma asked how much was assessed on the Dodd Road and Holyoke/T.H. 50 project. The city administrator explained that there were no assessments on that project, because the city was not involved in any of the road work and did not have to pay for any of it. The reason there was no assessment also included the fact that the money for that intersection improvement project came out of a special fund from the Minnesota Department of Transportation due to the safety involved by eliminating the railroad crossing. Mr. Glenn Markinson asked the engineer about how the storm drainage would be handled along Holyoke Avenue from the rear of his property onto the street, and the engineer indicated that some storm sewer pipe and catch basins would have to be installed in the project, and that some of the storm drainage would be over the top of the curb into the gutter. Mr. Leo Gray asked about the correct .rate for the residential assessment based on the preliminary report, and the city administrator explained that the dollar figures shown per parcel were based on $25.10 per front foot, and that a typing error on the report indicated $24.10 at the top to the column. Mr. Gray also asked about the need for. leaving the curb and gutter off on the .portion of the road for the property on the northwest corner of Holyoke and 202nd Street so that additional turn lanes could be installed when the property is developed for commercial purposes. The engineer explained that the need for storm drainage control and conveyance indicated that concrete curb and gutter would best serve the purpose .and hold down the additional amount of right of way needed to accomplish the project. The city administrator pointed out that the 2 ` • • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING November 10, 1983 1982 plan provided for additional turn lanes and a wider road surface and right of way., but that the majority of the property .owners involved in the project opposed it. Mr. Chuck Zweber gave a history of the assessments against their property at the northwest corner and indicated he did not feel more assessments could be afforded. Mr. Kurt Huber complained. about the sod restoration from the previous utility project along Holyoke Avenue. and asked for assurances that the project would be put in without such problems. The city administrator explained to those present that the proposed improvement for Trunk Highway 50 and County .Road 5 near I-35 in 1985 would be assessed at higher. rates than those stated for this project with the concrete curb and gutter on the commercial property being quoted to people at an informational meeting on October 19th at $42.10 per front foot for that project. The administrator also indicated that the council may wish to choose the option of assessing $8.35 on the residential zoned, developed and used property on this project and then assess the $25.10 afoot on the residential zoned property where there is only a gravel road in front of the property at this time. He also indicated that the council may wish to assess the commercial zoned property at a $37.65 rate but defer the payment on the .principal and interest on the undeveloped commercial or residential property until it is built on, developed or platted. Councilman Harvey pointed out that the State Highway Department's report indicated that the accident rate at the intersection was double the .normal rate for this type of an intersection. Council member Enright stated that she would support an assessment policy of $8.35. per front foot for the residential zoned property with the present asphalt road in front of it and a rate of $25.10 per front foot for the residential zoned property with a gravel road in front of it and $37.65 per front foot for commercial zoned property for either type of road. She also. indicated that she would. be in favor of defer- ring the principal and interest on the assessments for the undeveloped property until it is developed, built on or platted. Council members Sindt and Nelson indicated they would support the same policy. Mayor Zaun stated that he felt the assessment of $8.35 for the curb and gutter on the project was fair for the residents involved and to the entire community. Motion was made by Harvey, seconded by Sindt to close the public hearing. 3 • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING November 10, 1983 Roll call was taken on the motion. Time: 9:20 p.m. At this time the city administrator reviewed the proposed assessment policy on the project, that being $8.35 per front foot for the residen- tial zoned property that is built on and has an asphalt road in front of it at this time; $25.10 per front .foot for the residential zoned property that has a gravel road in front of it; and $37.65 per front foot for the commercial property for either type of road existing in front of it at this time, which the assessments to be deferred on the undeveloped property until it is developed, built on or platted. 83.523 Motion was made by Enright, seconded by Harvey to adopt Resolution No 83-116 and 83-117 ordering the project and authorizing Consulting Engineers Diversified to prepare plans and specifications. Roll call was taken on the motion. Ayes, Zaun, Sindt, Enright, Harvey, Nelson. 83.524 Motion was made by Nelson, seconded by .Harvey to adjourn the council meeting. Roll call was taken on the motion.
