CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
MARCH 22, 1984
The meeting was called to order at 7:30 p.m. by Mayor Zaun at the
J.F.K. Elementary School. Roll call was taken. Present: Council
members Harvey, Sindt, Enright, Nelson and Mayor Zaun.
Also present: Keith Nelson and Darrell Schneider, Consulting Engineers
Diversified; James Robinette, Community Development Director; Roger
Knutson, City Attorney; Patrick McGarvey, City Administrator/Clerk.
Mayor Zaun explained to the approximately 70 to 80 residents present
from the Clay's Acres area that the purpose of the meeting was to
present in front of the City Council the feasibility report prepared by
C.E.D. on making improvements to the storm drainage and street system
in the Clay's Acres area to correct drainage problems. Mayor Zaun then
read the wording of a petition received by the City Council on February
6, 1984, from many of the residents in the area.
James Robinette .presented a brief history of the platting. of the area
and the maintenance problems the city has faced recently in attempting
to keep the roads in decent repair and open during the winter due to
the ground water and storm water, which runs continually. in some of the
areas and is effecting the base of the streets and the surface of the
streets all year around.
At this time, Mr. Darrell Schneider stated that the feasibility report
being presented is a concept plan only. He also stated that quotes had
been received by the City on what it might cost to extend the storm
drainage lines from the yard or house area out to the property line to
connect to the proposed drainage system being presented by the City.
Those cost estimates range from $175 to $250 per lot, depending on
whether or not sodding had to be included.
At this time, Mr. Keith Nelson presented a map showing the drainage
area that this property is involved in, plus a map showing the location
of the proposed drainage pipe system to be installed and a map showing
the street cross section and how the pipe location relates to the
street cross section in the boulevards. Mr. Nelson also showed a map
of the trunk drainage systems which will need to be made to effectively
control and convey storm drainage in this area of Lakeville.
Mr. Nelson then showed a slide giving the breakdown of the costs by
component of the project. The three major cost components of the
project are $178,600 for the 208th Street storm sewer plus street
restoration, $257,100. for the Clay's Acres drain tiles, and $217,000
for the trunk area storm sewer improvements. The total estimated cost
of these improvements is $652,700.
The city administrator presented what a typical special assessment per
lot would be in the Clay's Acres addition, which would consist of $735
per lot for the 208th Street lateral storm sewer, $100 per lot for

street patching., $1,775 per lot for the. drain tiles and $1,320 for the
area storm. sewer assessment based on the lot size of 16,500 square
feet, for a total per lot assessment in the Clay's .Acres area of
$3,930. The total principal and interest on the first year of the
assessment, which would be for a 15 month period, was .set at $687.50.
The administrator also explained that an alternative toward assessing
the costs for the.. project would be to set up a special taxing. district
rather than levy special assessments, which would provide the advantage
of having the property tax be totally deductible on the federal and
state income tax return of the property owner.
At this time, Mayor Zaun opened the meeting to questions and comments
from the audience.
Mr. Steve Adochio asked how this system would work. Keith Nelson
stated because the. drain the would collect the water and carry it away
to the storm sewer system and into the trunk storm sewer system.
Larry Olmsted, .who lives on 208th Street, asked what their assessment
would be for. It was answered that $835 is for the storm drainage
assessment for properties on the north side abutting 208th Street.
Jim Pendergrass asked if the project could be trimmed back; and the
answer was that in order to solve the entire problem, it needs to be
put in as presented so that the drainage problems can be solved and new
ones not created.
Pat Monahan asked about .the location of ponding and the 208th Street
system, and the engineer explained the reason for holding ponds and why
the 208th Street system was necessary to have an effective storm sewer
drainage system in that area.
James Emond asked the city attorney what the definition of an assess-
ment was in that it was an .improvement to .the property, and Mr. Knutson
stated that in the State statute it is considered an improvement of
equal value.
Mr. Emond then suggested that the city should possibly use a test area
first to see whether the feasibility of the concept being presented
really works.
Mr. Robert Nicholson asked why the the has to be on both sides of the
street, and the .engineer explained that it is necessary in order to
capture the drainage adequately in the area and keep the sub base in
the streets free of saturation and/or ice.
Mr. Fran Rittenhouse explained that he is concerned as to why there
should be another assessment. and that he is approaching retirement age
and did not look forward to more assessments on his property.

Mr. Jim Granville stated that he was against it if all the costs had to
be assumed by the home owners in the area. He asked if the City could
assume some of the .costs.
Mr. Fred Norgaard asked if his property would face a double assessment,
since he lives on a corner lot and has a double wide lot. The engineer
explained that if he has two lots with front footage, he would have two
assessments. If it was a corner lot, he would have only half an
assessment for the footage on the one side of the corner lot.
Mr. Andy Jaeger asked about the manhole condition in the street and
also about a house being built in the area.
Mrs. Sandy Krause asked why houses are still being built in areas with
this kind of problem. The administrator explained that in new develop-
ments that come. in, the planning for storm drainage control is much
more thorough today, and the developer is required to put in improve-
ments such as these if necessary so that these problems will not be
.forthcoming after the plat is first occupied.
Another gentleman asked about the risk factor in the contingency cost
estimate, and the city engineer answered that it was figured at 10%,
which also includes capitalized interest and is based on a percentage
of the construction costs.
Mr. Larry Chandler stated that he has no water problem now; and if the
project resulted in him having a water problem, could he sue the City.
Mr. Knutson answered that if the City definitely caused the problem
through its error, he would possibly have a case against the City.
Mr. MacGibbon asked what it would take to get the City to pay for all
of the project. The mayor answered that it was not likely that the
City would pick up the entire cost, as it has not done so for similar
situations in other areas of the city, and it would not be the type of
precedent the City would want to set.
Mr. Jim Granville asked what share of the costs the City is picking up,
and the city administrator answered that the trunk fund would be
responsible for $62,300 of the project costs out of the.. $652,700 in the
current policy. Mr. Fran Rittenhouse asked if there was any .state aid
available for the project,. and the answer was "no".
At this time., Mayor Zaun asked the City Council members for any ques-
tions or comments they had. Councilman Nelson stated that he wanted to
look into the test area approach toward solving the problems in this
area.
Council member Enright stated she hadn't heard many people at the
meeting tonight state they really have a problem. However, she said
the City has problems that need to be solved because of the water

coming from the property in this area onto the public right-of-way. She
stated she would want to take a look at the taxing district approach
toward paying for a project such as this.
Council member Sindt stated that she needed more information on the
possible test area approach toward solving the problems.
Councilman Harvey stated that while he could legally participate in
voting on the project based on the written opinion he had received from
the city attorney, he did .not believe it to be good public business for
him to participate in deciding the outcome of this proposed project,
because he is a property owner in the area.
Mayor Zaun stated that he felt the experimental .test area approach made
sense.
84.145 Motion was made by Enright, seconded by Sindt to direct the City staff
to look into the concept of finding a test area to see if the approach
toward solving these problems works before an entire project is ordered
in the future.
Roll call was taken on the motion. Ayes, Sindt, Zaun, Enright, Nelson.
Nays, none. Harvey abstained.
84.146 Motion was made by Harvey, seconded by Sindt to adjourn the council
meeting.
