HomeMy WebLinkAbout04-22-85 • . • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING APRIL 22, 1985 The meeting was called to order at 8:00 p.m. by Mayor Zaun. Roll call was taken. Present: Councilmembers Nelson, Sindt, Enright, and Mayor Zaun. Absent: Councilmember Harvey. .Also present: Keith Nelson, City Engineer; Roger Knutson, City Attorney; Patrick McGarvey, City Administrator/Clerk; James Robinette, Community Development Director. The meeting was a joint meeting with the Credit River Township Board for the purpose of conducting a joint public hearing on the proposed improvement of Judicial Road from 185th Street (Minnreg Road) to the entrance to the Brackett's Crossing parking lot. Members of the Credit River Township Board present: Miles Mares, John Kane, Albert Feldman, Elmer Hartman and Bill Casey, Chairman. Also present: Joe Skluzacek, Township Board Clerk. At this time the city clerk attested to the published and mailed legal notice for the joint public hearing. Keith Nelson presented slides showing the scope of the proposed street improvement project and a project cost estimate of $55,600. Mr. Nelson indicated that the project is proposed to be assessed along each side of the road at an estimated assessment rate of $10.44 per front foot. Mrs. Bartelds advised the town board and city council members that she also owned property on the west side of Judicial Road in the township, as well as in the city of Lakeville on the east side. The city administrator/clerk explained how the city had previously assessed a similar type of road improvement on 185th Street and Ipava Avenue. For those improvements, the city assessed the property owners but deferred the principal and interest until and unless the agricul- tural property was changed in use by the development or platting from the present agricultural usage. The administrator also presented a report from the city street maintenance department, indicating that the estimated maintenance cost on this portion of Judicial Road during 1985 could be as high as $6,647, not including any dust control effort that might be desirable or necessary. The estimated cost for dust control is estimated to be as high as $9,400 for the year if five applications of fluoride were necessary, based on 3,000 gallons per application at the rate of $.63 per gallon. The citizens in the township and city present at the meeting indicated that they felt the main cause for the extra maintenance on the road and dust control was due to the traffic associated with Brackett's Cross- ing, and that the owners of Brackett's Crossing should be responsible for improving the road. ` j ~ • • CITY OF r•axFVILLE SPECIAL COUNCIL MEETING April 22, 1985 Mr. Ben Meledandri, speaking for the owners of Brackett's Crossing, stated that they are willing to pick up the annual principal and interest costs on the entire road improvement project less what the city and township would be saving in maintenance costs for an asphalt road versus the gravel road. Mr. Mallery asked if there weren't agreements from years ago from the Honeywell Corporation, the former owner and developer of Brackett's Crossing, and if the company would be responsible for paving Judicial Road. Mayor Zaun indicated that the city did not have any such agreements in its files, and that at the time Honeywell developed the country club, it was not in the city of Lakeville. At this time, the town board members and the council members discussed the costs associated with the annual maintenance of a gravel road versus an asphalt road and what would be a reasonable cost to the township to pay toward the asphalt improvement in lieu of continued maintenance on the gravel road. The city administrator suggested that the town board take a look at their annual maintenance costs on their gravel road system and possibly arrive at a cost figure for this portion of Judicial Road, based on the 1984 costs and their total road system budget. The board members indicated that they would discuss this and arrive at a decision at their next regular meeting on May 20, 1985. 85.167 Motion was made by Enright, seconded by Sindt to close the city. council's portion of the public hearing. Roll call was taken on the motion. Ayes, Zaun, Sindt, Enright, Nelson. The town board clerk, at this time,. also declared a motion from the town board closing their portion of the public hearing. The city administrator suggested that until the town board has had time to study their road costs and arrive at a decision at their next meeting on May 20th, the council not take any action ordering the improvement on behalf of the city, but that the council go on record stating the policy it would use if and when the project is ordered by the council for assessing the city's portion of the project. 85.168 Motion was made by Sindt, seconded by Nelson that the policy of the City of Lakeville will be to assess the City's share of the road improvement costs to the benefited property owners on the Lakeville side of the road and then defer the principal without interest on the land in agricultural use until such time as the land is developed, rezoned or changes from its present agricultural usage. Roll call was taken on the motion. Ayes, Sindt, Enright, Zaun, Nelson. 2 CITY OF LAKEVILLE SPECIAL COUNCIL MEETING April 22, 1985 The council then advised the citizens present that the matter would be placed on the June 3, 1985, council agenda for consideration of a decision on whether or not to order the improvement project. At this time the city administrator recommended to the council that they authorize Consulting Engineers Diversified to prepare an engineer- ing feasibility report for the streetscape improvement project on Holyoke Avenue in downtown Lakeville and a portion of 207th Street and Holt Avenue. 85.169 Motion was made by Sindt, seconded by Nelson to authorize Consulting Engineers Diversified to prepare an engineering feasibility report on the streetscape improvement project. Roll call was taken on the motion. Ayes, Nelson, Zaun, Sindt, Enright. 85.170 Motion was made by Sindt, seconded by Nelson to approve and authorize the mayor and clerk to execute an easement agreement with T.F. James Company, parcel No. 325, for the Trunk Highway 50/County Road 5 improvement project. Roll call was taken on the motion. Ayes, Zaun, Sindt, Enright, Nelson. 85.171 Motion was made by Enright, seconded by Nelson to adjourn the. special council meeting. Roll call was taken on the motion.
