CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
AUGUST 29, 1985
The meeting was called to order by Acting Mayor Nelson at 8:00 p.m.
The meeting was a joint meeting with the Credit River Township Board
and the Lakeville City Council.
Acting Mayor Nelson asked the clerk to call roll.
Roll call was taken. Present: Council members Nelson, Sindt,
Enright and Harvey. Absent: Mayor Zaun.
At this time, Mr. Joe Skluzacek, Clerk of the Credit River Town
Board, took the roll for the board members. All board members were
present.
The city clerk and town board clerk both attested to the legal
notices for the public hearing.
At this time, Mr. Keith Nelson, Consulting City Engineer, presented
slides showing the location and scope of the proposed project and
estimated cost. He indicated that the project is two miles in length
from 205th Street to 185th Street.
Mr. Nelson indicated that 20 soil borings were taken in the two mile
stretch of the road, and the base of the road is from 28 to 30 feet
wide in various areas. The proposal is to construct a 22 foot wide
asphalt road with two and one-half inches of asphalt on top of four
inches of additional gravel base. Mr. Nelson indicated that improve-
ments to the storm drainage along the road would be made in critical
areas. The total estimated cost for the improvement is $324,135,
with the City of Lakeville to pay one-half of the cost and Credit
River Township to pay one-half of the cost, and each body to assess
the cost in accordance with their adopted assessment policies.
Mr. Nelson indicated that the City of Lakeville, for its side of the
road, uses an assessment policy where wetlands abutting the road are
not assessed because of their unbuildable condition. Mr. Nelson
indicated he had subtracted the estimated footages of the property
affected by wetlands on the Lakeville side of the road that reduced
the assessable front footage to 9,600 lineal feet at an estimated
assessment rate of $16.88 per foot. He then indicated that a rough
estimate of the assessable lineal feet on Credit River's side of the
road would be approximately 9,925 at an assessable rate of $16.32 per
foot. He indicated there were 41 parcels of property involved in the
project.
The city clerk stated that the Lakeville policy would be to assess
the road over 20 years, with the first assessment payment being due
in 1987 at an estimated rate of interest of 10 to 10-1/2 percent on
the unpaid principal.

At this time the meeting was opened for questions and comments from
citizens present.
Mike Schmidt from the Minneapolis Gun Club asked if the design
proposed for the road would be adequate to handle the type of traffic
using it. Mr. Nelson indicated that in his opinion, he felt would be
adequate.
Chuck Rgnonti stated that he was opposed to the improvement.
Char Schabinger stated that she was in favor of the improvement.
Ron Walker indicated that he felt the commercial uses on each side of
the road were the ones guilty of causing the wear and tear on the
road and the heavy traffic count and should, therefore, pay more of
the costs.
At this time Mr. Nelson showed a slide of the estimated assessable
front footage property on the Lakeville and Credit River sides of the
road.
The city administrator stated that the City of Lakeville has used the
policy for assessing state aid streets whereby commercial zoned
property is assessed one and one-half times the rate that a residen-
tial zoned property is for a road improvement. It was indicated that
the city council, and possibly the town board, could adopt a policy
whereby the property being used in a commercial nature would receive
a higher per foot assessment than the residential property along the
road.
Clarence Van Zee indicated that the assessment formula should also
consider an area factor in addition to front footage.
Wayne Brown indicated that he was against the project.

Norbert Asfeld indicated that he supported the project.
Ken Ehrhardt, who owns property on both sides of the road, indicated
he felt something needed to be done to improve the road.
Mike Schmidt indicated that he felt something should be done to cut
down the grade of the hills in the road for the sake of safety. Mr.
Nelson indicated that if there is going to be substantial cutting of
the hills to improve safety, it would add to the estimated project
cost.

Wally Hilgenberg indicated that he felt something should also be done
to cut down on the hills for the sake of safety.
Mary Driver indicated that she felt something had to be done to
improve the road and reduce the speed limit and weights on the road.
Wendy Larson indicated she felt something needed to be done to
improve the road..
Discussion was also held on the need for better signage on the
Minnreg Road as it approaches Judicial Road, especially from the
Scott County side due to the hill involved.
85.369 Motion was made by Councilman Harvey, seconded by Councilmember Sindt
to close the City of Lakeville public hearing.
Roll call was taken on the motion. Ayes, Nelson, Sindt, Enright,
Harvey.
At this time Credit River Board members also adopted a motion closing
their portion of the hearing.
Mr. Kane from the Credit River Board indicated he .felt something
needed to be done to improve the gravel road, and that possibly
Credit River could take over the maintenance on this portion of
Judicial Road so that the citizens would have an improved gravel
road. He also indicated that he felt the Credit River Town Board,
possibly through the Scott County engineer's office, should take
another look at other alternatives for improvement the road rather
than paving it with asphalt.
85.370 Motion was made by Harvey, seconded by Sindt to table further
consideration of ordering or denying this proposed improvement
project pending the review of other alternatives for improving the
road.
Roll call was taken on the motion. Ayes, Sindt, Enright, Harvey,
Nelson.
85.371 Motion was made by Sindt, seconded by Enright to table action on the
proposed joint powers agreement with Credit River Township for the
proposed improvement of Judicial Road between 205th Street and 185th
Street.
Roll call was taken on the motion. Ayes, Enright, Harvey, Nelson,
Sindt.

85.372 Motion was made by Harvey, seconded by Sindt to adjourn the special
council meeting.
