HomeMy WebLinkAbout08-01-85 r , c CITY OF LAKEVILLE SPECIAL COUNCIL MEETING AUGUST 1, 1985 The meeting was called to order at 7:00 p.m. by Mayor Duane Zaun at the Lakeville High School. Roll call was taken. Present: Councilmembers Sindt, Enright, Harvey, Nelson and Mayor Zaun. Also present: Patrick McGarvey, City Administrator/Clerk; James Robinette, Community Development Director; Keith Nelson and Tim Hanson, Consulting Engineers from C.E.D.; Roger Knutson, City Attorney. Mayor Duane Zaun introduced the city staff present and explained the procedure for the public hearing. The City Clerk attested to the legal notice for the hearing. At this time, Keith Nelson presented slides showing how the installa- tion of storm drain the on the west side of Jacquard Avenue was constructed. Mr. Nelson also reviewed the past history from 1983 to the present of the previous informational meetings and public hearing concerning the storm drainage and road restoration improvements proposed for the Clay's Acres area. Slides were shown of the larger area drainage plan the city has for storm water from this area of Lakeville and a cross section of how the system looks and works. Slides were shown of the street conditions in April of 1984 as they were being affected by ground water running onto the streets from various lots in the area. Mr. Nelson then showed a slide of the storm drainage pond area number lU and a slide showing the areas where the street patching and overlay would be constructed if the improvement project were ordered. Mr. Nelson then indicated that after the streets were patched and overlaid in the worst areas, the entire street system in the area would be seal coated, and this project would not be assessed for the seal coating. Mr. Nelson then showed a slide of the phase one project cost estimates which total $595,200 and for the total project cost estimate of $752,800. The slides showed the components of the project which total these amounts. Mr. Nelson then advised those present which streets or plats in the area would be assessed for which part of the improvements being proposed. At this time the City Administrator/Clerk gave the citizens present the total estimated amount of principal assessment for the Clay's Acres area with storm drainage the in front of their homes and the areas without the storm drainage tile, plus the property owners on the east and west side of Jacquard Avenue and those in The Meadows ist Addition on the north side of 208th Street. The first year's principal and interest payment on an annual basis and a monthly basis was then given for these respective areas, with the range being from approximately $22.00 per month principal and interest for 1986-87 to $67.00 per month • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING AUGUST 1, 1985 for the lots that receive assessments for all of the improvements proposed, street restoration, storm drain the in front of their property, storm sewer area charge and the 208th Street storm sewer. At this time Mayor Zaun opened the hearing for questions and comments from citizens present. Mr. Larry Olmstead stated that in his opinion, the residents in The Meadows 1st Addition should only pay for. the street restoration costs at an estimated $447.00 per lot and not for the storm sewer system proposed along 208th Street, as he felt the swale at the rear of their lots is the only storm sewer system that benefits their property, and it had been paid for by the developer of their lots. Keith Nelson indicated that the swale installed at the rear of the lots in The Meadows 1st Addition was put in by the developer in lieu of the cash contribution for the storm sewer area trunk charge at the time the property as being developed. The engineer indicated that the swale at the rear of the lots still does not pick up the run-off from the property in the front of the lots, which runs on to 208th Street and would be picked up by the proposed storm sewer system along 208th Street. Diane MacGibbon asked why some streets would have the street restora- tion assessment, when there is no actual improvement on that street and compared the policy of assessing all of the street restoration over the area to the proposed policy of assessing the storm drain the only to those lots that actually receive the drain the in front of them.. She indicated she felt the City should reconsider the area of benefit for the storm drain tale and spread some of the costs on the entire area, and the policy proposed for street restoration. Andy Jaeger questioned why the storm drain the should not be extended further south on some streets where there is a known problem, as compared to the map showing the proposed extension. Keith Nelson indicated that the area would be checked, and if the extension needed to be further south at this time to effectively collect known storm water problems, the system would be in the design of it. Larry Chandler stated that water runs onto Isle Avenue on the east side further south. Don Hay said he felt there should be a show of hands from the citizens present as to who favors this project. At this time Mayor Zaun indicated that his research of assessment records at city hall indicated that there was an assessment in the early 197U's for the installation of sewer and water in the area and for the assessment of the street at that time after the utilities went in. 2 • i CITY OF LAKEVILLE ,~ECIAL COUNCIL MEETING AUGUST 1, 1985 James Emond indicated that the property owners on Iteri were also assessed a second time for street improvements in 1975. Mr. Stan Whittingham spoke in testimony of the effectiveness of the storm drain the system installed on the west. side of Jacquard Avenue and how it improved his property and eliminated his water problem in the basement and yard. Jim Brandt stated that the city engineer should check further south on Iteri, as new springs had developed further south than the engineer's exhibit map showed. Joel Frank indicated that he did not feel his property at the corner of 210th and Jacquard should be assessed for two units as proposed but should be considered as only one parcel. Steve Brown indicated he felt the City should bear some of the finan- cial responsibility for the proposed improvements, due to the past history of this development and how it was approved by the City. Mark Miller indicated he felt something should be done to correct the problems in the area, but that he felt the cost for the proposed storm drain the system seems high, and that the cost of the storm drain the system should be spread on a basis where the property owners who are not receiving it at this time pay at least some of the cost. Steve Adochio indicated he felt the assessment for the street restora- tion represented a double assessment for streets, due to the early 1970's assessment. Mr. Robert Nicholson indicated that he felt something needs to be done to make improvements in the area and asked the engineer why storm pond area number lU was on the Hammer property rather than the Lankas property. Mr. Nelson indicated that the reason for this was that the Lankas property has a preliminary plat approved on it from previous years, and the Hammer property does not. Mr. Nelson indicated that in the phase one estimated cost of $595,000, the City of Lakeville would be picking up $94,848 from the storm sewer trunk fund, which brings the actual amount estimated to be assessed to the property in the area under this proposal to $5U0,ODU under phase one. Bernie Ryan indicated he felt Isle Avenue has no water or street problems. At this time Mayor Zaun asked the council members if they had any questions or comments. Councilmember Sindt asked the city attorney if the council were to assess all the lots for storm drain the system at this time, even though some did not actually receive the drain the system in front of their property, whether or not they could be 3 CITY OF LAKEVILLE SPECIAL COUNCIL MEETING AUGUST 1, 1985 assessed later if an extension is needed to correct the future problem. Roger Knutson indicated that the council could assess those costs in the future if benefit can be shown to the property at that time. Councilmember Sindt then indicated that a test area was installed in 1984 on the west side of Jacquard Avenue, and according to some of the property owners and the city engineer, the system has worked very effectively. Nancy Enright indicated that she felt the time had come after previous informational meetings and public hearings to address .these problems and solve them. Councilmember Nelson indicated that the council spent two years studying these problems and attempting to find solutions to them that would be cost effective and yet eliminate the. drainage problems and street problems in the area. Councilmember Harvey stated that he will vote on the proposed project as a property owner in the area, as the revised phase one plan does not include his property for storm drain the pipe at this time. At this time Joe Chamber on Ixonia Avenue indicated that he does not have a water problem in front of his house, but rather has a problem of water running down the back yard. Mayor Zaun then asked the engineer if he is sure the streets will last with the amount of proposed work to be done, and if they did not, whether or not they would be assessed for additional work that might be necessary in the future. Mr. Nelson indicated that he felt with the installation of the system as proposed, the streets should last for a number of years. 85.325 Motion was made by Sindt, seconded by Harvey to close the public hearing. Roll call was taken on the motion. Ayes, Harvey, Enright, Zaun, Sindt, Nelson. Time: 8:55 p.m. 85.326 Motion was made by Sindt, seconded by Enright to approve the phase one project as proposed and authorize the consulting engineer to prepare the plans and specifications for the phase one improvements, by adopting Resolution No. 85-61. Roll call was taken on the motion. Ayes, Enright, Zaun, Sindt, Nelson, Harvey. 85.327 Motion was made by Harvey, seconded by Enright to approve the plans and specifications for the streetscape improvement project No. 85-3 and set the bid date for September 6, 1985, at 10:00 a.m., by adopting Resolution No. 85-62. 4 • • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING AUGUST 1, 1985 Roll call was taken on the motion. Ayes, Zaun, Sindt, Nelson, Harvey, Enright. 85.328 Motion was made by Enright, seconded by Sindt to call a public hearing on the proposed improvement of Holt Avenue for the streetscape project 85-3 for the Wren, Inc. property on the west side of Holt Avenue between 208th Street and 209th Street for August 19, 1985, by adopting Resolution No. 85-63. Roll call was taken on the motion. Ayes, Sindt, Nelson, Harvey, Enright, Zaun. 85.329 Motion was made by Enright, seconded by Sindt to adjourn the special council meeting.
