Planning Commission Work Session
Thursday, February 20, 2003
Marion Conference Room
The Planning Commission work session commenced at 7:05 p.m. in the Marion
Conference Room.
Commissioners Present: Karl Drotning, Gerry Grenz, Lowell Miller Stolte, Kerrin
Swecker, and ex-officio Jim Puncochar.
Staff Present: Planning Director Daryl Marey, Associate Planner Frank
Dempsey, Zoning Enforcement/Recycling Coordinator Leif Hanson, Assistant
City Attorney Andrea Poehler, and planning consultant Dan Licht of NAC.
The Planning Commission reviewed the regulatory issues raised in the February
13, .2003 memorandum prepared by Dan Licht of NAC. The Planning
Commission agreed that they are addressing the issue of the outdoor display of
items for sale. The Planning Commission also agreed to consider allowing the
outdoor display of items for sale in conjunction with. motor fuel facilities provided
that performance standards are adopted related to the following:.
• Limit the outdoor display area to 5% of the area of the principal structure or
200 square feet, whichever is less.
• Allow the outdoor display to be located on raised pump islands and/or on a
raised. sidewalk in front of the building provided there is at. least five feet of
width for pedestrians clear of any outdoor display items and parked vehicles.
• The outdoor display cannot be located within parking stalls or driveway areas
or otherwise interfere with vehicle circulation.
• The outdoor display area will be counted in the calculations for off-street
.parking.
• The height of the outdoor display on pump islands will be limited to three feet
for traffic visibility and in front of the building will be limited to five feet.
• Ice machines are considered outdoor storage and should be located at the
S side or rear of the building and screened from public rights-of-way and
abutting residential properties.

Assistant City Attorney Andrea Poehler distributed a memo that identified the
existing motor fuel facilities approved by conditional use permit. The memo
recommended that those motor fuel facilities. approved after the separate motor
fuel facility performance standards were adopted on August 18, 1997, as well as
all motor fuel facility conditional use permits approved prior to August 18, 1997
that limit outdoor display items or location, will require an amendment to their
conditional use permits to allow any modification to outdoor display allowed.

Planning. Director Morey pointed out that two existing. motor fuel facilities (Cenex
and Amoco at 167th/Cedar) are grandfathered and are not operating under a
conditional use permit.
The Planning Commission agreed that all motor fuel facility conditional use
permits approved after August 18, 1997, as well as all motor fuel facility
conditional use permits approved prior to August 18, 1997 that limit outdoor
display items or location, will require a conditional use permit amendment if a
Zoning Ordinance amendment is adopted.
Those motor fuel facilities with conditional .use permits approved prior to August

sidewalk to achieve the five. feet of width for pedestrians clear of any outdoor
display items and parked vehicles) are required to meet the performance
standards that may be adopted by the Planning Commission as part of a Zoning.
Ordinance amendment.
The Planning Commission agreed that staff should prepare draft language
incorporating the performance standards discussed tonight for review at a future
work session. The motor fuel facilities owners and managers could then be
invited to another work session to provide. input on the proposed. outdoor display
performance standards.
The work session was adjourned at 8:45 p.m.
