WORK SESSION MINUTES
MARCH 20, 2003
8:30 P.M.

A. Discussion With Peter Thelen. Peter Thelen, 12119 Lucerne Trail was invited to
speak to the Planning Commission regarding his proposed second detached
accessory building. A conditional use permit would be required to allow the
second .detached accessory building. The property is zoned RA, Rural/Agricultural
District which allows up to 3% of the property area to be accessory building area.
Staff noted that while more than one detached accessory building is allowed by
the Zoning Ordinance with the approval of a conditional use permit, the City has
not previously approved a conditional use permit for a second detached accessory
building. Mr. Thelen said that the second building would be used to store personal:
property and yard maintenance equipment. The Planning Commission felt that the
• request was reasonable given the physical characteristics of the property and
screening and Mr. Thelen should proceed with the conditional use permit
application.
B. Motor Fuel Facilities, Outside Sales/Display. The Planning Commission
discussed outside sales and display for motor fuel facilities. The Planning
Commission supports outside sales and display up to 5% of the building area not to
exceed 200 square feet in area in front of the building or on the pump islands. A
minimum 5 foot wide pedestrian area shall be maintained between parked vehicles
and outside sales and display area at the front of the convenience store building.
Ice freezers can be located in front of the building if they meet the area and
pedestrian access requirements, otherwise they must be located at the side or rear
of the building and fully screened with materials consistent with that of the principal
building.
Conditional use permit amendments will be required #or all motor fuel facilities that
have outside sales and display areas limited by previous conditional use permits..
Staff will send the draft Zoning Ordinance revisions to motor fuel facility owners and
managers and will invite them to attend a future Planning Commission work session to
receive their input before finalizing an amendment of the current Zoning Ordinance..

C. Residential Buffer-Yard Screening. Staff informed the Planning Commission
thatthe City Council referredtwo sections of the proposed draft Zoning
Ordinance back to the Planning Commission for reconsideration.
1. An issue was raised with Section 22 (Fences) of the draft Zoning Ordinance
as to whether. a privacy fence should be allowed in the side yard of a corner lot
abtatting a major collector or arterial street. Mr. Licht provided language to the
Planning Commission that would allow for a privacy fence in these situations
while requiring landscaping on the street side of the fence. The Planning
Commission recommended a 15 foot setback for the fence such that the
landscaping is not required to be within a drainage and utility easement and
subject to removal. The Planning Commission unanimously supports the
proposed language with the change to a 15 foot setback.
2. Section 25 (Design Standards) of the draft Zoning Ordinance included a
provision that required shrubs to be installed between shade tree plantings.
The Planning Commission discussed if the shrub requirement should apply if
a wall or fence is installed as part of the subdivision or site plan review
process. The unanimous recommendation by the Planning Commission is
..for the shrub requirement to remain as proposed in the draft amendment.
The Planning Commission also recommended that a gate or other means of
accessing the street side of the fence be required.
