HomeMy WebLinkAbout05-15-03 CITY OF LAKEVILLE Planning Commission Meeting Minutes MAY 15, 2003 The May 15, 2003 Planning Commission meeting was called to order by Chair Stolte in the City Hall_Council Chambers at 6:00 pm. :Flag pledge and roll call of members: Present: Reuvers, Swecker, Stolte, Detjen, Grenz, Drotning, ex-officio Puncochar. Pattee arrived at 6:30 p.m. Absent: None. Staff Present:: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Janice Waataja, Associate Planner; jay Rubash, Assistant City Engineer;. Roger Knutson, City Attorney; and Penny Brevig, Recording Secretary. ITEM 3: APPROVAL OF MEETING MINUTES: The May 1, 2003 Planning Commission meeting minutes were approved as presented. The May 1, 2003 Planning Commission.. Work Session notes were approved as presented. ITEM 4: ANNOUNCEMENTS: Planning Director Daryl Morey stated that the following item was distributed to the Planning Commission members and staff before tonight's meeting. 1. For Item 5, a revised Conditional Use Permit for Dan and Ellen Kroehler, which includes two stipulations from the May 9, .2003 planning report thatwere not included. in the draft CUP in the Planning .Commission packet as well as a corrected legal description.. Mr. Morey stated that there would be additional handouts under Item 7 from City Attorney Roger Knutson. ITEM 5. DAN AND ELLEN KROEHLER Chair Stolte opened the public hearing to consider the application of Dan and Ellen Kroehler for a Conditional Use Permit Amendment to allow the construction of a second detached accessory building. and to construct the building at a height greater than 20 feet, located at 8016 190th Street West. City Attorney Knutson attested. that the legal notice had been duly published in accordance with state statutes and City Code. Dan and Ellen Kroehler were in attendance at tonight's meeting to answer.. any questions that the Planning Commission or public may have. Ms. Kroehler presented an overview of their request.. Ms. Kroehler indicated that the proposed building would be used for storage of personal belongings and not used for a home occupation. Planning Commission Meeting May 15, 2003 Page 2 Associate .Planner Janice Waataja presented the planning report. Ms. Waataja stated that Dan and Ellen Kroehler have submitted an application for a Conditional Use Permit to allow the construction of a second detached accessory building: and to construct the building at a height greater than 20 feet on their property. She indicated that currently the owner has a detached garage in addition to a garage attached to the home. Ms. Waataja indicated that the owner has a shed that will be removed if approval is granted for the proposed building. Ms. Waataja stated that the property is zoned RA, Rural/Agricultural District which allows a total accessory building area up to three percent of the lot area. or 13,068 square- feet, whichever is most restrictive. The total square footage of the existing attached garage, the existing .detached .garage, and the proposed accessory building is 4,515 square feet. This complies with Zoning Ordinance requirements.. Ms. Waataja stated that the property has a stand of deciduous trees located in the southwest corner of the lot that would screen the proposed building from adjacent parcels. She indicated that the proposed building would meet all setback requirements of the RA District, including 30 feet to the rear property line: and 20 feet to the west side propertyline. Ms. Waataja stated that the Zoning Ordinance lists performance standards that must be met before a Conditional Use Permit shall be granted for and accessory building. The standards are listed in the May 9, 2003 planning report and were discussed at tonight's meeting. The applicants proposed building meets all of these. standards. Ms. Waataja stated that should the Planning Commission recommend to the City Council approval of the Kroehler's request for a Conditional Use Permit to allow the construction of a second detached accessory building and to construct the building at a height greater than 20 feet, Planning Department staff recommends approval subject to the 6 stipulations listed in the May 9, 2003 planning report, and approval of the Findings of Fact dated May 15, 2003. Chair Stolte opened the hearing to the public for comment. There were no comments from the audience. 03.52 Motion by Detjen, Second by Grenz to close the public hearing at 6:07 p.m. Ayes: Reuvers, Swecker, Stolte, Detjen, Grenz, Drotning. Nays: 0 Commissioner Drotning requested that City staff add to the on-going Zoning Ordinance review process to clarify that accessory buildings could not be used to store commercial equipment..: He wanted to add to Stipulation 6 that commercial activities shall not be conducted, including the storage of commercial equipment, in the proposed accessorybuilding. Planning Commission Meeting May 15, 2003 Page 3 • Commissioner brotning also thought that the Rural/Agricultural District requirement of allowing total accessory building area of up to three percent of the lot area also should be added. to the Zoning Ordinance review process to determine its appropriateness for non-farm income producing RA District properties. Commissioner Swecker .confirmed that the existing .gravel. driveway access to the proposed accessory building is allowed in the rural service area. .Commissioner Grenz confirmed that there would not be a water hook-up in the proposed accessory building. Stipulation 6 will be amended to read as follows: 6. The accessory building shall not be utilized for a home occupation or commercial activities, including the storage of commercial equipment. 03.53 Motion by Swecker, Second by Drotning to recommend to City Council approval of -the Kroehler Conditional Use Permit to allow the construction of a second detached accessory building, and to construct the building at a height greater than 20 feet, located at 8016 190th Street West, subject to the 6 stipulations listed in the May 9, 2003 planning report, as amended, and approval of the Findings of Fact dated May 15, 2003.. • Ayes: Swecker, Stolte, Detjen, Grenz, Drotning, Reuvers. Nays: 0 ITEM 6. SELECTWASH Chair Stolte opened .the: public hearing to consider the request. of Peter. White and Jason Squire. for a Conditional Use Permit to allow the construction and operation of a commercial car wash, located on property east of Glacier Way and west of Cedar Avenue (CSAH 23). City Attorney Knutson attested that the legal notice had been duly published in accordance with state statutes and City Code. Peter White and Jason Squier were in .attendance at tonight's meeting to answer any questions that the Planning: Commission or public may .have. Mr. White and Mr. Squier presented an overview of their proposal. Color renderings of the proposed building were presented by the developers. Mr. White stated that they agreed with the May 9, 2003 planning report except for two of the stipulations. He indicated that Stipulation 7 regarding the submission of a written audit and inspection bi-annually to verify that the waste-water recycling system is functioning. properly was excessive due to the fact that they will be using an industry proven system in the car wash and monthly preventative maintenance checks will be performed by the vendor. Mr. White indicated that they would prefer to do an annual audit. Planning Commission Meeting May 15,.2003 Page 4 Mr. White stated that regarding the hours of operation referred to in Stipulation 14, they want the opportunity to have the automated car wash bays open 24 hours a day. He indicated that the automated car wash doors will only open when payment is made and the doors will be closed during the entire wash and dry cycle. He stated that the self-service wash bay would not be open 24 hours a day in order to prevent loitering. Mr. White indicated that Kwik Trip does not have any restrictions on their hours of operation, and they would like the same opportunity for their business. Mr. Dempsey presented .the planning report. Mr. Dempsey stated that Peter White and Jason Squier have submitted an application and plans for a Conditional Use Permit to allow the construction and operation of an .automatic car wash in a C-3, General Commercial District at 17398 Glacier Way. He indicated the site islocated on the west side of Cedar Avenue (CSAH 23), south of Kwik Trip. The lot was platted: for commercial development with Shady Oak Shores 8th Addition. The car wash. will. utilize an existing driveway. access with the Kwik Trip motor fuel facility .and convenience store. Mr. Dempsey. indicated that the .Dakota County right-of-way needs map .identifies Cedar Avenue as a future 6-lane road which requires a total of 200 feet of right-of-way. The Shady Oak Shores 8th Addition plat dedicated 75 feet of west. half right-of-way for Cedar Avenue. He indicated that. the developers of the SelectWash have designed. the site plan to allow for possible future public acquisition of 25 feet of additional right-of- way without impacting the operations of their proposed car wash site and parking lot. Mr. Dempsey indicated .that a shared access and cross parking easement is recorded against the property, which was required as a stipulation of the Kwik Trip Conditional Use Permit to ensure that the future development to the south of Kwik Trip. would be able to have a shared. access onto Glacier Way. Mr. Dempsey described the proposed. landscaping plan. He stated that staff is recommending two additional six-foot tall spruce trees be planted along Glacier Way for screening to the existing houses to the west. He stated that all planting materials meet the size and species requirements of the Zoning Ordinance and the design requirements outlined in the 1999 Gateway Design and Corridor Study. Mr. Dempsey stated that the developers are proposing a freestanding monument sign, ..which will be 15 feet in height. A wall sign is also proposed. on the north wall of the car .wash building. Also, Mr. Dempsey indicated. that two directional signs are proposed to identify the drive entrance off of Glacier Way and into the site.. He indicated that a sign encroachment agreement shall be recorded against the property which will allow the proposed freestanding sign to locate in the area proposed on the situ plan... The sign :.shall be moved at the owner's expense. to meet setback requirements at,the time Cedar. Avenue is upgraded to a six-lane design and the 25 feet of additional right-of-way is obtained.. • Planning Commission Meeting May 15, 2003 Page 5 Mr. Dempsey stated that the SelectWash would include two. automatic car .wash bays and a tandem self-service car wash bay. There will be attendants on site periodically to assist customers and manage and maintain the site. He indicated that the .car wash. system would automatically. notify the car wash vendor of any malfunction in the car wash system. Mr. Dempsey stated that the Zoning Ordinance lists performance standards that must be met before a Conditional Use Permit shall be granted for commercial car washes. The standards are listed in the May 9, 2003 planning. report .and were discussed at tonight's meeting. Mr. Dempsey stated that should the Planning Commission recommend to .the. City Council approval of the SelectWash Conditional Use Permit, Planning Department staff recommends approval subject to the 18 stipulations listed in the May 9, 2003 `planning report, and approval of the Findings of Fact dated May 15, 2003. Chair Stoite opened the hearing to the public for comments. There were no comments from the audience. 03.54 Motion by Drotning, Second by Reuvers to close the public hearing at 6:34 p.m. Ayes: Swecker, Stolte, Detjen, Grenz, Drotning, Reuvers, Pattee. Nays: 0 Associate Planner Frank Dempsey indicated that Stipulation 7 was included. at the Metropolitan Council's request because the SAC units are being reduced from 27 to 19 due to the waste-water recycling system.. The City of Lakeville does not have an .ordinance requiring this audit. Regarding Stipulation 14, Mr. Morey indicated that staff recommended restricting the hours of operation to coincide with Kwik Trip's existing hours of operation so that if a customer had a problem at the car wash at night, they could use the Kwik Trip facility to contact car wash management or maintenance staff. Mr. Morey pointed out the Conditional Use Permit could be amended in the future to expand the' .hours of operation. The Planning Commission discussed with the developers how the automated car wash.: bays work and how the vendor is linked to them so there can be immediate response to any problems. They were pleased with the surveillance equipment and how the blowers inside. the automated car wash are able to dry the vehicles before the doors at the exit are opened. Commissioners Puncochar and Grenz felt that restricting the hours is a good idea, due to potential crime and vandalism. The developers commented that they are not planning to be open 24 hours a day initially, but they want the option to do so given the development of the Crossroads mixed-use project at Cedar Avenue. and Dodd Boulevard. Planning Commission Meeting May 15, 2003 Page 6 The Planning Commission felt that because the wash water recycle system is in the best interest of the developers because they realize a significant savings in water usage, and because City staff does not perform the maintenance inspections, that Stipulation 7 should be modified to reflect a less intensive method to monitor water usage.. The Planning Commission agreed to amend :Stipulation 7 to read as follows: 7. Prior to City Council consideration, City staff will contact the Metropolitan Council Environmental Services to determine alternate methods to verify compliance with the SAC units. The Planning Commission stated that Stipulation 14 should be deleted. Mr. Morey extended City staff's appreciation to Mr. White and Mr. Squier for their cooperation on this project.. 03.55 Motion by Drotning, Second by Reuvers to recommend. to City Council approval of the SelectWash Conditional Use Permit to allow the construction and operation of a commercial car .wash, located on property south of Glacier Way and west of Cedar Avenue. (CSAH` 23), subject to the 18 stipulations listed in the May 9, 2003 :planning. report, as amended, and approval of the Findings of Fact dated.May 15, 2003. Ayes: Stolte, Detjen, Drotning, Pattee, Swecker, Stolte. Nays:. Grenz Commissioner Grenz felt that Stipulation 14 (regulation of hours of operation) should remain in the Conditional Use Permit. Function of the Planning;Commission City Attorney Roger Knutson discussed the Planning Commission function and duties, and answered questions from the Commissioners.
