Commission Meeting Minutes SEPTEMBER 4, 2003 The September 4, 2003 Planning Commission meeting was called to order by Chair Stolte in the City Hall Council Chambers at 6:00 p.m. Flag pledge and roll call of members: Present: Reuvers, Pattee, Swecker, Stolte, Detjen, Grenz, Drotning, ex-officio Puncochar. Absent: None. Staff Present: Daryl Morey, Planning Director; Frank Dempsey, Associate Planner; Ron Mullenbach, Associate Planner; Jay Rubash, Assistant City Engineer; Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary. ITEM 3: APPROVAL OF MEETING MINUTES: The August 21, 2003 Planning Commission meeting minutes were approved as presented. ITEM 4: ANNOUNCEMENTS: .Planning Director Daryl Morey stated that the Public Hearing for Mills Fleet Farm will be tabled to the September 18, 2003 Planning Commission meeting due to republishing the Public. Hearing Notice with the corrected size of the proposed wall. Mr. Morey indicated that it was Associate Planner Ron Mullenbach's last Planning Commission meeting and that he would be leaving the City of Lakeville to work for the Avalon Group. He thanked Mr. Mullenbach for all his hard work and dedication over the past six years. ITEM 5. LAMETTRY PROPERTIES, LLC Chair Stolte opened the public hearing to consider the application of Richard A. LaMettry for a Conditional Use Permit to allow the construction of a major automobile repair use in the C-2, Highway Oriented Commercial District, located at the southwest quadrant of Cedar Avenue (CSAH 23) and 210th Street. Assistant City Attorney Poehler attested that the legal notice had been duly published in accordance with state statutes and City Code. Darren Botz from Smuckler Architecture was in attendance at tonight's meeting representing Richard LaMettry to answer any questions that. the Planning Commission or public may have. Mr. Botz presented a brief overview of the project. Associate Planner Ron Mullenbach presented the planning report. Mr. Mullenbach stated that Richard LaMettry of LaMettry's Body Shop has submitted an application for a conditional use permit to allow a .major. automobile repair use in the C-2 Highway Planning Commission Meeting September 4, 2003 Page 2 Oriented Commercial District. He indicated that the subject property was final platted as part of the SuperAmerica 2nd Addition and lies at the southwest quadrant of 210th Street and Cedar Avenue. Mr. Mullenbach discussed the performance standards for major. automobile repair uses. He indicated that the proposed building meets or exceeds .all setback requirements. Hours of operation will be between 7:00 a.m. and 6:00 p.m., Monday through Friday. Mr. Mullenbach stated that an evaluation of the performance .standards of conditional use permit requests, including sufficient street capacity, adequate off-street parking and off-street loading, landscaping, exterior lighting,. and architectural appearance, were included in the August 29, 2003 planning report. He indicated that where would be no access onto Cedar Avenue from this property. Mr. Mullenbach stated that should the Planning Commission recommend to the City Council approval of the LaMettry Conditional Use Permit, Planning Department staff recommends approval subject to the 8 stipulations listed in the August 29, 2003 planning report. Chair Stolte opened the hearing to the public for comments. There were no comments from the audience. 03.99 Motion by Drotning, Second by Pattee to close the public hearing at 6:13 p.m. Ayes: Reuvers, Pattee, Swecker, Stolte, Detjen, Grenz, Drotning. Nays: 0 Commissioner Grenz asked if there was .any other land available for development. on this site and what the zoning. of the property. to the north was. Mr. Mullenbach indicated that there is one more lot available in the .SuperAmerica -2nd. Addition plat northwest quadrant of Glade Avenue and Lakeville Boulevard. The property to the north is currently zoned RST-2, Single to Two-Family Residential District and is guided for medium/high density residential. 03.100 Motion by Drotning, Second by Swecker to recommend to City Council approval of LaMettry's Body Shop Conditional Use Permit to allow the construction of a major automobile repair use in the C-2, Highway Oriented Commercial District, located at the southwest. quadrant of Cedar Avenue (CSAH 23) and 210th Street, subject to the 8 stipulations listed in the August 29, 2003 planning report and approval of the. Findings of Fact dated September 4, 2003. Ayes: Pattee, Swecker, Stolte, Detjen, Grenz, Drotning, Reuvers. Nays:0 Planning Commission Meeting September 4, 2003 Page 3 ITEM 6. MILLS FLEET FARM 03.101 Motion by Detjen, Second by Pattee to table the Public Hearing for Mills Fleet Farm to the September 18, 2003 Planning Commission meeting. Ayes: Swecker, Stolte, Detjen, Grenz, Drotning, Reuvers, Pattee. Nays: 0 Item 12. New Business Mr. Morey pointed out that he would like to schedule a work session after the September 18, 2003 Planning Commission. regular meeting to discuss outstanding issues related to he zoning ordinance update. Mr.Morey updated the Planning Commission on the. September 2, 2003 City Council action on the Zoning Ordinance Amendment related to outdoor sales and display for Motor Fuel Facilities Ordinance.
