HomeMy WebLinkAbout03-21-02 CITY OF LAKEVILLE Planning Commission Meeting Minutes e MARCH 21, 2002 The March 21, 2002 Planning Commission meeting was called to order by Chair Wulff in the City Hall Council Chambers at 6:00 p.m. Flag pledge and roll call of members: Present: Stolte, Larson, Michaud, Wulff, Detjen, Grenz, Drotning, ex-officio Puncochar. Absent: None Staff Present: Daryl Morey, Planning Director; Keith Nelson, City Engineer; Jay Rubash, Assistant City Engineer; Roger Knutson, City Attorney; and Penny Brevig, Recording Secretary. ITEM 3: APPROVAL OF MEETING MINUTES: The. March 7, 2002 Planning Commission meeting minutes were approved as presented. • ITEM 4: ANNOUNCEMENTS: None. ITEM 5: INDEPENDENT SCHOOL DISTRICT #194 -CHERRY VIEW ELEMENTARY SCHOOL Chair Wulff turned the meeting over to Vice Chair Michaud for agenda items 4 and 5 because she wished to speak to these items as a concerned citizen. Vice Chair Michaud opened the public hearing to consider the application of Independent School District 194 for an Interim Use Permit to allow the use of temporary classroom structures at Cherry View Elementary School, located at 8600 175 Street. City Attorney Knutson attested that the legal notice had been duly published in accordance with state statutes and City Code. Director of Business Services for ISD 194 Lonnie Smith was in attendance at tonight's meeting and indicated that due to continued growth in the number of elementary school aged children in the Lakeville school district and due to a shortage of classroom space, ISD 194 officials are requesting Interim Use Permits to allow the placement of temporary classrooms at Cherry View and John F. Kennedy Elementary schools. Planning Commission Meeting March 21, 2002 Page 2 Planning Director Daryl Morey presented the .planning report. Mr. Morey stated that Independent School District 194 has submitted an application for an Interim Use Permit to allow the installation of temporary classrooms at Cherry View Elementary School located at 8600 175 Street West. Temporary classroom structures are allowed in the RS-2 District by Interim Use Permit. Mr. Morey stated that ISD 194 is proposing to install a temporary structure on the west side of the existing school building that will contain a total of 4 classrooms. The temporary classrooms are needed until additional permanent classroom space is constructed within the ISD 194 system, at which time the temporary classrooms would be removed #rorn Cherry View Elementary. Mr. Morey indicated that. the 4 temporary classrooms would only be used by 6~ grade students and each classroom is designed for a maximum capacity of 29 students. The .structure will include an enclosed hallway that will link the classrooms to an existing entrance located on the west side of the school.. Mr. Morey indicated that an exterior .entrance will be located on the south side of the hallway and a handicap accessible ramp will lead to an exterior entrance on the • west. side of the structure. The ramp is located less than five feet from the existing parking area located on the west side of the school. Mr. Morey stated that a stipulation of the interim use permit will require 6 bollards to be placed between the stairway and the ramp on the west side of the portable classrooms and the adjacent parking lot to prevent vehicles from coming into contact with the ramp. Mr. Morey indicated that the exterior of the prefabricated structure will consist of wood siding that will be painted to match the exterior color of the school and a metal skirt that will run along the bottom of the structure. The proposed height of the structure is approximately 15 feet, which complies with the 35 foot maximum height in the IZS-2 District.. Regarding parking, Mr. Morey stated that the zoning ordinance currently requires that elementary schools provide 1 parking space .per 7 students based upon building design. Cherry View Elementary has a building capacity of 700 students. The temporary classrooms will increase the building capacity to no more than $16 students, which would. require a total of 117 parking spaces on site. According to ISD 194, they are proposing to add 12 parking spaces to the Cherry View Elementary parking area located on the east side of the property for a total of 119 .parking spaces. The proposed parking area would be surfaced with gravel. Mr. Morey indicated. that a stipulation of the interim use permit will require the parking Planning Commission Meeting March 21, 2002 Page 3 urea to be paved by August 1, 2004 and will only allow employees of the school to utilize the parking area during regular school hours. Mr. Morey stated that ISD 194 has proposed to remove the. temporary classrooms from .the Cherry .View Elementary site by August 1, 2005. If the temporary structure is not removed by that time, it will be considered a permanent structure, unless an amendment to the interim use permit is approved by the. City Council. A permanent structure would require ISD 194 to pay sanitary sewer and water connection charges. Mr. Morey stated that. should the Planning Commission recommend to City Council approval of the Interim Use Permit, Planning Department staff recommends approval subject to the 5 stipulations listed in .the March 15, 2002 .planning report and the Findings of Fact dated March 21, 2002. Vice Chair Michaud opened the hearing to the public for comment. Wendi~ Wulff, 17326 Greentree Path • Ms. Wulff stated .she supports the request of the school district for temporary classrooms and parking. She feels it is not an ideal situation, but it will give the school district time to pursue a permanent solution. 02.28 Motion by Detjen, Second by Stolte to close. the public hearing at 6:10 p.m. Ayes: Stolte, Larson, Michaud, Detjen, Grenz, Drotning Nays: 0 Commissioner Drotning wanted to confirm that the parking. lot would not be paved until August, 2004. Mr. Morey confirmed this and stated thafi the additional parking is needed to bring the parking into compliance with current Zoning Ordinance requirements. Commissioner Drotning questioned why Cherry View Elementary has one access to the school. Mr. Morey indicated that 175 Street is designated as a major collector and. Highview Avenue is designated as a minor arterial/parkway in the City's Comprehensive Transportation Plan. He stated that when the school was constructed, the driveway access was placed on the lessor of the two classification streets. If an access to Cherry View was proposed at a future date for Highview Avenue, it would be a right-in, right-out access due to the median that will be constructed when Highview is upgraded to a parkway design. Planning Commission Meeting March 21, 2002 Page 4 Commissioner Drotning thought it would be beneficial to put in another driveway access to Cherry View Elementary, even if it was a right-in, right-out access. Commissioner Puncochar stated that one entrance is beneficial for .safety reasons because additional school patrols will be required for. more than one driveway access. Commissioner Grenz commented .that there is a considerable grade difference between the existing parking area located on the. east side of the school and Highview Avenue. Commissioner Grenz asked when enrollment at all of the elementary schools would be at' or exceeding capacity. Mr. Smith indicated that five elementary schools are at capacity now and four schools are near capacity. There would be no addition to Cherry View Elementary if the Apri123, 2002 Bond Referendum passes; rather a 200 student capacity addition to Oak Hills Elementary would be completed if the referendum passes. In addition, Mr. Smith indicated that if the referendum passes, ..the sixth graders would be moved to the junior high schools to reduce crowding in • .the elementary schools and ninth graders would be moved to the senior high schools. Commissioner Stolte asked if the temporary parking spaces could be paved sooner. Mr. Morey indicated. that the City and school district agreed that the temporary space will be paved no later than August 1, 2004, however, the school district may pave them sooner. Commissioner Michaud asked if the Bond Referendum doesn't pass, are these temporary portables going to become permanent. Mr. Smith: indicated that the school district would. have to come back to the City and ask for an extension of the interim use permit time frame of August 1, 2005. Commissioner Stolte asked how often do the boundaries change for the elementary schools. 1VIr. Smith stated that Lakeville has gone three years without a boundary change, with the previous boundary change occurring two years prior to that. Usually when a new elementary school opens, the. boundaries need to be changed. 02.29 Motion by Drotning, Second by Detjen to recommend to City Council approval of the application of Independent School District No. 194 for an Interim Use Permit to allow the use of temporary classroom structures at Cherry View Elementary School, subject to the 5 stipulations listed in the March 15, 2002 Planning Report, and' approval of the Findings of Fact dated March 21, 2002. INDEPENDENT SCHOOL DISTRICT #194 -JFK ELEMENTARY SCHOOL Vice Chair Michaud opened the public hearing to consider the application of Independent School District No. 194 for an Interim Use Permit to allow. the use of temporary classroom structures at John F. Kennedy Elementary School, .located at 21240 Holyoke Avenue. City Attorney Knutson attested that the legal notice had been duly published in accordance with state statutes and City Code.. Mr. Morey stated that Independent School District No. 194 has submitted an application for an Interim Use Permit to allow the installation of temporary classrooms at John F. Kennedy. (JFK) Elementary School located at 21240 Holyoke Avenue. Temporary classroom structures are allowed in the RM-1 District by Interim Use Permit. Mr. Morey stated that ISD 194 is proposing to install .one temporary structure on . the west side of the existing school building that will contain a total of 2 classrooms. The temporary classrooms are needed until additional permanent classroom space is constructed within the ISD 194. system, at which time the temporary classrooms would be removed from JFK. Mr. Morey indicated that the 2 temporary classrooms would only be used by 6~ grade students and each classroom is designed for a maximum capacity of 29 students. The structure will include an enclosed hallway that will link the classrooms to an existing entrance located on the west side of the JFK school .building. Mr. Morey stated that exterior entrances will be located on the south side of the hallway and west side of the temporary structure. The exterior of the prefabricated structure will consist of wood siding that will be painted to match the exterior color of the school and a metal skirt that will run along the bottom of the structure. The proposed height of the structure is approximately 15 feet, which complies with the 35 foot maximum height in the IZM-1 District.. Mr. Morey indicated that the student capacity is 725 at JFK Elementary. With temporary classrooms, the capacity would be 783.. Mr. Morey stated that 112 parking spaces would be required at JFK Elementary. JFK Elementary has a total of 62 parking spaces located on the south side of the school but shares an additiona197 parking spaces with McGuire Junior High School located west of JFK. • Mr. More stated that a sti ulation of the interim use ermit will require the Y 1' p temporary classrooms to be removed by August 1,.2005. Mr. Morey stated that should the Planning Commission recommend to City. Council approval of the Interim Use Permit, Planning Department staff recommends approval, subject to the 3 stipulations listed in the March 15, 2002 planning report and the Findings of Fact dated March 21, 2002. Vice Chair Michaud opened the hearing to the public for comment: Wendy Wu~, 17326 Greentree Path Ms. Wulff suggested that the shared parking lot between JFK and McGuire junior High be re-striped to achieve the maximum possible number of parking spaces. 02.30 Motion by Drotning, Second by Detjen to close the public hearing at 6:30 p.m. Ayes: Larson, Michaud, Detjen, Grenz, Drotning, Stolte. Nays:O Commissioner Drotning indicated that there are parking problems at JFK Elementary whenever there is a special event going on. Mr. Smith concurred that there is event parking problems at all the schools in Lakeville. Mr. Morey stated that the City has a good working relationship with .the school district and City staff will work with the school district to achieve: solutions to parking problems, wherever possible. 02.31 .Motion by Stolte, Second by Grenz to recommend to City Council approval of the application of Independent School District No. 194 for an Interim Use Permit to allow the use of temporary classroom structures at JFK Elementary School, subject to the 3 stipulations listed in the March 15, 2002 Planning Report, and approval of the Findings of Fact dated March 21, 2002. CITY OF LAKEVILLE • Chair Wulff opened the public hearing to consider the request of the City of Lakeville for the adoption of a Five Year Capital Improvement Program for 2002- Planning Commission Meeting March 21, 2002 Page 7 i 2006. City Attorney Knutson attested that the legal notice had been duly published in accordance with state statutes and City Code. Assistant City Engineer Jay Rubash stated that the Capital Improvement plan (CIP) provides a foundation for construction of the City's infrastructure in such a manner as to enable development to occur in an orderly and fiscally responsible manner. Mr. Rubash provided an overview of the proposed 2002 - 2006 CIP .and briefly described the significant projects and/or major changes and their timetable. Chain Wulff opened the hearing to the public for comment. There were no comments from the audience. 02.32 Motion by Michaud, Second by Detjen to close the public hearing at 6:50 p.m. Ayes: Wulff, Detjen, Grenz, Drotning, Stolte, Larson, Michaud. Nays: 0 Mr. Rubash and City Engineer Keith Nelson responded to questions from the Commissioners and provided clarification of the proposed projects and their relationship to land use. Chair Wulff asked about the Holyoke Avenue, 165, and 175 street overlay for 2004, 2006, and 2008 under Exhibit A in the CIP. Mr. Rubash indicated these would be modified to correct any errors before the CIP is presented to the City Council Mr. Nelson responded to questions from the Commission regarding. the design of the 185 Street/I-35 interchange improvements. Commissioner Michaud asked whether taxes would be increased for. Lakeville residences to pay for the proposed road improvements. Mr. Nelson indicated that the City Council. has hired Springsted to do a financial analysis for our interchange improvements. He indicated the City will be utilizing state aid funds to assist in funding roadway improvements. 02.33 Motion by Michaud, Second by Drotning that. the Planning Commission finds that the proposed 2002 - .2006 Capital. Improvement Plan is consistent with the .City's Comprehensive Land Use Plan and recommends to City Council approval and adoption of the 2002 - 2006 Capital Improvement Plan.
