Planning commission Work Session

The Planning Commission work session commenced at 11:45 p.m. in the Marion
Conference Room.
Commissioners Present:. Wendy Wulff, Karl Drotning, Gerry Grenz, Jeff Larson, Tom
Michaud, Lowell Miller Stolte, and Jim Puncochar.
Staff Present: City Administrator Robert Erickson, Planning Director Daryl Morey,
Associate Planner Frank Dempsey.
On April 4, 2002, the Planning Commission met with John and Rose Harrison, 10213 -
Upper 196t" Way, at an informal work session to discuss the Harrison's plans to build an
addition onto heir house.
An as-built survey. was. done for the house showing the front and side property lines.. The
existing house is 21.7 feet from the Upper 196t" Way right-of-way line. An addition must
meet the 30 foot front yard setback, 10 foot side yard setback and 17 feet from the
delineated wetland edge. The proposed addition would be approximately 7 feet from the
right-of-way line. Staff provided a planning issues memo describing the existing conditions
and the criteria for a variance if that option were to be considered.
The Harrison's requested a partial vacation of the right-of-way in order to make their
existing. house and proposed addition conforming to a 30 foot front yard. setback. Staff
stated that aright-of-way vacation may not be a viable option because the Antlers Park
plat is poorly monumented and mathematically does not close. A survey showing the
existing Upper 196t" Way right-of-way for the entire block would have to be developed to
identify the location of all existing structures adjacent to the road, total existing road right-
of-way, the location of roadways and existing utilities. After this information is provided it
could be used to determine how much, if any, road right-of-way could be vacated and still
meet minimum ordinance requirements and future roadway needs. Staff agreed to
contact Assistant City AttorneyJim Walston to discuss this option.
The Harrison's builder, Don Morris said that he would call Gopher State One Call to have
the utilities in the vicinity of the Harrison parcel identified.
