Planning .Commission Meeting Minutes

The April 18, 2002 Planning Commission meeting was called to order by Chair
Wulff in the City Hall Council Chambers at 6:00 p.m.
Flag pledge and roll call of members:
Present: Stolte, Michaud, Wulff, Detjen, Grenz, Larson, ex-officio Puncochar.
Absent: Drotning
Staff Present: Robert Erickson, City Administrator; Daryl Morey, Planning
Director; Frank Dempsey, Associate Planner, Jay Rubash, Assistant City Engineer;
Andrea Poehler, Assistant City Attorney; and Penny Brevig, Recording Secretary.
ITEM 3: APPROVAL OF MEETING MINUTES:
The. April 4, 2002 Planning Commission meeting minutes were approved as
presented.
Commissioner Stolte stated that the required setbacks of the addition should be
• indicated in the Harrison work session notes.
The April 4, 2002 Planning Commission work. session notes were approved, as
amended.
ITEM 4: ANNOUNCEMENTS:
Mr. Morey stated that the. following items were distributed to the Planning
Commission members and staff before tonight's meeting.
1. April 17, 2002 Parks, Recreation & Natural Resources Committee meeting
minutes regarding the Century Ridge 2nd Addition. Preliminary and Final
plat and the Willow Ridge Preliminary and Final plat.
2. Copy. of Kerrin Swecker's application for appointment to the Planning
Commission.
3. Copy of commercial and residential mailings concerning the residential plat
moratorium and the I-35/C.R. 50 official mapping.
4. Merno from Frank Dempsey regarding John and Rose Harrison's options for
building onto their home.
5. List of current residential and commercial developments.

ITEM 5: CENTURY RIDGE 2~ ADDITION
Chair Wulff opened the public hearing to consider .the application of Weissmann
Realty, Inc. for a preliminary and final plat of 10 townhouse units to be known as
Century Ridge 2nd Addition, located in the northwest corner of 190 Street and
Dodd Boulevard (C.S.A.H. 9). .Assistant City Attorney Poehler attested that the
legal notice had been duly published. in accordance with state. statutes and City
Code.
Kelly Murray, representing Weissmann Realty, Inc., was in attendance at tonight's
meeting to answer questions. Ms. Murray provided an overview of .the
subdivision. She stated that Weissmann Realty, Inc. was able to acquire the
additional property at the .corner of 190 Street and Dodd Boulevard from the two
landowners and incorporate it into the Century Ridge townhouse development.
Ms. Murray indicated they had made provisions in their original townhome
declarations to be able to add this- land as additional_ real estate covered by the
original homeowners association documents.
Planning Director Daryl Morey presented the planning report. Mr. Morey .stated
• that Weissmann Realty, Inc. representatives have submitted applications for the
preliminary .and final plat. of Century Ridge 2nd Addition, which consists of 10
townhouse lots and 1 common area lot on .1.28 acres of land located in .the
northwest .corner of 190 Street and Dodd Boulevard (C. R. 9). He indicated that a
conceptual design of the subject property for 10 attached .townhouse lots was
included by the developer with the Century Ridge preliminary plat/PUD approved
by the City Council on December 18, 2000.
Mr. Morey stated that the subject property consists of two metes and bounds
parcels and Outlot B, Century Ridge. One of the metes and bounds parcel has a
single family home with a driveway access to Dodd Boulevard which will be
removed with the development of Century Ridge 2nd Addition. He indicated that a
$10,000 security will be required with the development contract to guarantee the
removal of the house, driveway, overhead utility lines, and septic system.
Mr. Morey stated that the proposed townhouse units meet the RM-1 District
building setback requirements.
Mr. Morey stated that Century Ridge 2nd Addition abuts Dodd.Boulevard (C. R. 9)
and 190 Street. He indicated that adead-end private drive is proposed to ..access
190 Street to serve the 10 attached townhouse units. The private drive access
i aligns with Inman Avenue, which will be constructed with the second phase of the
Dodd Marsh Highlands development.

Mr. Morey stated that the preliminary grading and tree preservation plan indicates
that 10 of the 13 significant trees will be saved. The significant trees designated to
be saved are located on Lot 11, Block 1, the common area lot
Mr. Morey indicated that the Parks, Recreation and Natural Resources Committee
recommended a cash contribution of $15,850.00 ($1,585.00 X 10 units) to satisfy the
park dedication requirements, at their April 17, 2002 meeting.
Mr. Morey. stated that the developer has submitted a preliminary landscape plan
for Century Ridge 2nd Addition. A four foot berm is proposed along Dodd
Boulevard east of the six unit townhouse building and in the northwest corner of
Dodd Boulevard and 190 Street adjacent to the four unit townhouse building. He
indicated that a three foot berm is proposed east of the dead-end private drive. Mr.
Morey indicated that Spruce trees. to screen headlights are proposed at the east end
of the private drive and south of the westerly guest parking spaces.
Mr. Morey stated that the .developer has indicated that the townhouse buildings
shall be constructed consistent with the approved Century Ridge building plans
and in compliance with zoning ordinance requirements.

Mr. Morey indicated that the developer is proposing to provide five off-street guest
parking spaces_to serve the 10 townhouse units in Century Ridge 2nd Addition in
compliance with Zoning Ordinance requirements.
Mr. Morey stated that should the Planning Commission recommend to City
Council approval of the preliminary and final plat of Century Ridge 2nd Addition,
Plaruzing Department staff recommends the 13 stipulations listed in the Apri112,
2002 planning report.
Chair Wulff opened the hearing to the public for comment.
There were no comments from the audience.
02.41. Motion by Michaud, Second by Detjen to close the public hearing at 6:16 p.m.

Nays: 0
Commissioner Detjen indicated that the Planning Commission during their review
of the Century Ridge preliminary plat expressed their desire that the developer
acquire the subject properties and incorporate ahem into the development. He
i commended the developer for achieving this outcome.

Chair Wulff indicated that .she would prefer a continuous berm along Dodd
Boulevard with a few more trees.
Commissioner Michaud confirmed that the developer has .exceeded the
landscaping requirements. He doesn't feel that more rees should be added, but
suggested instead that proposed trees be shifted .from an internal location in the
,development to the Dodd Boulevard berm.
Ms. Murray indicated that they are willing to extend the berm and relocate trees to
the berm.
Assistant City. Engineer Jay. Rubash requested that the -final plat be revised to
include additional drainage and utility easements over the proposed storm sewer
catch basins in Lots 1 and 7, Block L
Mr. Morey recommended the following modifications to the 13 stipulations listed
in the April 12, 2002 planning report:
Addition of Stipulation 14: A continuous berm along Dodd Boulevard shall
• be provided and landscaping shall be installed along Dodd Boulevard
adjacent to Lot 10.
Addition of Stipulation 15: Additional drainage and utility easements shall
be provided over the storm sewer catch basins adjacent to Lots 1 and 7, Block
1.
02.42 Motion by Detjen, Second by Grenz to recommend to City Council approval of the
application of Wensmann Realty, Inc. for a preliminary and final plat to be known
as Century Ridge 2nd Addition, subjecf to the 13 stipulations listed in the April 12,
2002 Planning Report, with the addition of Stipulations of 14 and 15, as stated
above.
Ayes: Michaud, Wulff, Detjen, Grenz, Larson, Stolte.

ITEM 6. WILLOW RIDGE
Chair Wulff opened the public hearing to consider the application of Willow Ridge,
LLC for a preliminary and final plat of 29 single family residential lots to be known
as Willow .Ridge, located on the north side of 210 Street and west of Juno Trail
• Assistant City .Attorney Poehler attested that the legal notice .had been duly
published in accordance with state statutes and City Code.

Rick Osberg, Engineer for James R. Hill, Inc. was in attendance at tonight's
meeting and gave a short presentation of their application for Willow Ridge. Mr.
Osberg questioned Stipulation 7 regarding the underground utilities and asked for
a clarification.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey.
stated that Willow Ridge, LLC representatives have submitted an application for
the preliminary and final plat of Willow Ridge, which consists of 29 single family
residential lots on 18 acres located north of 210 Street and west of Junco Trail. He
indicated that the Willow Ridge preliminary and final plat area is zoned RS-2,
Single Family Residential District.
Mr. Dempsey indicated that there is one Outlot proposed in the Willow Ridge
preliminary and final plat. Outlot A will be deeded to the City with the final plat
for stormwater ponding purposes.
Mr. Dempsey stated that the Willow Ridge preliminary and final plat abuts 210
Street and 209 Street. He indicated that 210 Street is designated' as a Major
Collector .roadway and 209 Street as a Local Street, in the Comprehensive
Transportation Plan. jury Court includes a 60 foot wide right-of-way and will.
provide access to the development from 210 Street.
Mr. Dempsey indicated that. the proposed grading, drainage, erosion control, and
utilities for the Willow Ridge preliminary and final plat is shown on the grading,
drainage and erosion control plan and the utility plan included in the April 12, 2002
Planning Report. Mr. Dempsey clarified Stipulation 7 of the April 12, 2002
Planning Report as requested by the project engineer. He stated that staff is
:recommending that the developer submit a cash escrow to guarantee the future
burial. of the existing overhead utilities lines along 210 Street adjacent. to-the
Willow Ridge plat.
The Parks, Recreation and Natural Resources Committee reviewed the _Willow
Ridge preliminary and final plat at their April 17, 2002 and their recommendation
for approval, including a cash requirement of $45,965 to satisfy the. park dedication
.requirement, was distributed to the Planning Commission at tonight's meeting.
Mr. Dempsey stated that 258 out of the 323 significant trees located in the Willow
Ridge preliminary and final plat will be saved. Five of the significant trees are oak
trees and they will all be saved,
• Mr. Dempsey indicated that a landscape plan has been submitted .that shows a
berm and landscape buffer along 210 Street as required by the Zoning Ordinance.

Mr. Dempsey stated that staff is recommending that the developer substitute
Norway .Maple trees for .the Sugar Maples `trees and Black Hills or Colorado Green
Spruce trees for the Austrian Pines. These trees are known to have a greater
tolerance for salt spray and salt soils.
Mr. Dempsey stated that there was a neighborhood meeting held on Monday,
March 25, 2002, hosted by representatives from Brandl/Anderson Homes, Inca and
Willow. Ridge, LLC. The purpose of the-.meeting was to allow area .residents to
review the plans for .the development of the 18 acre property for 29 single family
lots. There were approximately eight .residents in attendance at the meeting. The
questions .that the residents raised were related to .proposed grading, tree
preservation, the extension of 209 Street, and 210 Street right-of-way.
Mr. Dempsey stated that should the Planning Commission recommend to City
Council approval of the Willow Ridge preliminary and final plat, Planning
Department staff recommends the 14 stipulations listed in the April 12, 2002
planning report.
Chair Wulff opened the hearing to the public for .comment.
Mike Herald, 20790 Junco Court
Mr. Herald was in favor of this development. His concerns were:
¦ Thedeveloper needs to be aware of Dutch. Elm disease in this area and help
prevent .the spread of the disease.
Chair Wulff asked Mr. Morey to comment on Mr. Herald's concern. Mr. Morey
- stated that individual lot tree preservation plans must be prepared for each lot with
saved significant trees. The developer's forester should review the elm trees for the
presence of Dutch Elm disease and take steps to prevent the spread of the disease.
John Harding;-20701 Jasmine Circle
Mr. Harding's concern was:
¦ Is the area. adjacent to the northwest. corner of the Willow Ridge plat
included as part of this development.
Mr. Dempsey indicated... that this area includes a wetland and was platted as an
Outlot that was deeded to the. City with the Lakeview Estates development.

Commissioner Grenz asked, due to the possibility of a new high school being built
in this area, is there enough right-of--way for a trail to be built on both sides of 210
Street. Mr. Rubash indicated that there is adequate right-of-way fora 3-lane
roadway to be built along with an 8 foot wide trail on both sides of 210 Street.
Commissioner Detjen confirmed. that the overhead utility lines referred to in the
Planning Report is the distribution line fronting the property .and thaf the
development will be served with underground lines.
Commissioner Stolte asked if a trail access could be constructed between Lots 9 and
10, Block 1 to access to the adjacent property owned by ISD 194. Mr. Rubash
indicated that the grades in that area are too steep. Trail access would not be
feasible. .
Chair Wulff asked about traffic projections for 210 Street. Mr. Dempsey indicated.
in 1999-2000 there were approximately 3,000. - 4,000 trips per day. The. 2020 traffic
projections- indicate approximately. 6,000 - 7,000 trips per day. This does .not take
into account the proposed high school.
Chair Wulff asked about building. pads with large .amounts of fill proposed... Mr.
Morey suggested that a stipulation be added that building pads with .significant
depth of fill remain through. one freeze/thaw cycle prior to building permits. The
developer agreed with this stipulation.
Mr. Morey recommended the following modifications to the 14 stipulations listed
in-the April 12, 2002 Planning Report:

. An escrow shall be submitted by the developer with the final plat
to guarantee burial of the overhead. utility lines.
Stipulation 12: Should be corrected to read $1,500.00 per lot security. The
following sentence should be added:. The developer's forester or landscape
architect shall review the elm .trees .for .the presence of Dutch Elm Disease with the
individual lot Tree Preservation Plans. If Dutch Elm Disease exists, the developer
shall take necessary steps to prevent the spread of the disease.
The addition of Stipulation 15 should read: Lots with building pads with an
average fill of 8 feet or more below the garage floor elevation shall be required to
• remain through one freeze/thaw cycle prior to the issuance of building permits.
The affected lots are Lots 4, 5, 6, Block 1 and Lots 5, 6,10, and 11, Block 2.

02.44 Motion by Stolte, Second by Michaud to recommend to City Council approval of
the application of Willow Ridge, LLC for a preliminary and final plat to be known
as Willow Ridge, subject to the 14 stipulations listed in the April 12, 2002. Planning
Report, as amended, and with the addition of Stipulation 15, as listed above.
Ayes: Detjen, Grenz, Larson, Stolte, Michaud, Wulff.

ITEM 7: NEw BUSINESS
City Administration Robert Erickson gave an in depth presentation on the adoption.
of the interim ordinance temporarily prohibiting the approval of new residential
plats and prohibiting the development and .new construction in the area east of the
I-35/Co. Rd. 50 interchange. He indicated that these ordinances will be in effect
until the adoption of official maps. and other official controls or April 14, 2003,
whichever occurs first.
There being no further business, the meeting was adjourned at 8:20 p.m.
