CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
OCTOBER 8, 1987
The meeting was called to order at 7:00 p.m. by Mayor Zaun at the
Lakeville Senior Citizen Center. Roll call was taken. Present:
Councilmembers Sindt, Enright, Harvey, Nelson and Mayor Zaun.
Also present: Cecilia Ray, City Attorney's Office, James Robinette,
Community Development Director; Daryl Zuelke and Tim Hanson from
Donohue & Associates, consulting city engineers; Dennis Feller, Finance
Director; Patrick McGarvey, City Administrator/Clerk.
Mayor Zaun opened the public hearing on Project 86-10, Oak Shores 3rd
Addition utilities and street improvement assessments. The City Clerk
attested to the legal notice.
Mr. Zuelke presented the project final costs, and the city administra-
tor explained that the assessment roll included the city water and
sewer unit connection charges as a part of the total assessment, which
increased the costs $1,425 per lot, being the difference between the
final cost per lot and the estimated cost at the improvement hearing.
The administrator pointed out that letters had been received from a few
of the property owners requesting that the water and sewer unit
connection charges be removed from a particular lot's assessment roll
so that the owner could pay them in full at the time of hook-up for the
remaining portion of the assessment levied.
One property owner present asked information about the procedure for
paying off the assessment now or at a future date and was given the
information by the administrator. Mr. Ed Kashuba asked the administra-
tor what the city water and sewer unit connection charge money went
for, and it was explained that it goes to pay the trunk water and sewer
system capital costs in part.
The administrator explained that the assessment policy for this
improvement was to have the assessments levied over 20 years. The
first year's interest would be for a 15 month period at an interest
rate of 9.5%.
Councilman Harvey pointed out to the engineer that his written graphic
presentation included three different totals for the original project
cost, and requested the engineer to explain which total was the correct
one for the council to adopt.
87.428 Motion was made by Harvey, seconded by Sindt to close the public
hearing.

87.429 Motion was made by Nelson, seconded by Harvey to adopt Resolution No.
87-149A adopting the assessment roll for Project 86-10 at $524,655.71.
Roll call was taken on the motion. Ayes, Enright, Zaun, Harvey,
Nelson, Sindt.
At this time, Mayor Zaun opened the public hearing on project 87-8, the
1987 street seal coating in the Airlake Industrial Park area and for
the asphalt overlay improvement of Hamburg Avenue from Highway 50 to
220th Street. The City Clerk attested to the legal notice.
Mr. Zuelke presented a slide showing the final project cost for the
seal coating and asphalt overlay. It was explained that the asphalt
overlay is still remaining to be completed, but the contractor and City
had to wait for Centel Telephone to relocate some utility poles at the
intersection of Hamburg and County Road 70 so that the turn lanes could
be installed.
One property owner requested information on how and why the City
assesses for street seal coating, and Mr. Robinette explained the City
policy on seal coating and why it is necessary to seal coat streets
every seven years.
The gentleman also questioned the City process presenting a project
improvement cost at the improvement hearing and the final cost of
assessment hearings and how it works.
87.430 Motion was made by Enright, seconded by Harvey to close the public
hearing.

87.431 Motion was made by Harvey, seconded by Nelson to adopt Resolution No.
87-150A approving the Hamburg Avenue overlay project assessments for a
total cost of $118,862.40 and the assessment of the street seal coating
costs in the amount of $22,398.44.
Roll call was taken on the motion. Ayes, Harvey, Nelson, Sindt,
Enright, Zaun.
At 8:05 p.m. Mayor Zaun opened the public hearing on project 86-3, and
the City Clerk attested to the legal notice.
Mr. Zuelke presented the project costs for Project 86-3, the improve-
ment of 165th Street, Jackson's First Addition area, Oak Shores 2nd
Addition utilities and street improvements. Mr. Zuelke indicated that
the total project cost for Project 86-3 was $1,530,124.71, and that the
total amount being assessed is $1,181,514.31.
The City Administrator presented the assessment policy whereby the City
would levy the assessments over 20 years at an interest rate of 9.53
percent on unpaid principal each year.

Mr. Charles McCarty presented a written objection to the City Council
concerning his assessment.
87.432 Motion was made by Harvey, seconded by Sindt to receive the letter from
Mr. McCarty.

Harvey.
87.433 Motion was made by Harvey, seconded by Nelson to receive the letter
from Delta Action Group representing Mr. J.E. Lowney.
Roll call was taken on the motion. Ayes, Sindt, Enright, Zaun, Harvey,
Nelson.
87.434 Motion was made by .Sundt, seconded by Harvey to receive an objection
from John Connelly and William Jackson concerning the assessments on
their properties.
Roll call was taken on the motion. Ayes, Enright, Zaun, Harvey,
Nelson, Sindt.
Mr. Hanson questioned why there wasn't a completed road on 164th Street
adjacent to his property and also advised the council that the proper
waiver or easements had not been obtained from him to work on his
property. The City Engineers and City Attorney's office were directed
to look into the matter.
Mr. Hanson presented a letter of written protest to his assessment and
a letter of written protest for his assessment was received from Mr.
Mark Parranto for his property.
87.435 Motion was made by Harvey, seconded by Nelson to receive the letters
from Mr. Hanson and Mr. Parranto.
Roll call was taken on the motion. Ayes, Zaun, Harvey, Nelson, Sindt,
Enright.
Mr. Parranto questioned what the $16,000 assessment on this project for
trail improvement costs was in relation to the $135 per lot trail
assessment he paid through the development contract for his plat.
87.436 Motion was made by Enright, seconded by Sundt to close the public
hearing.
Roll call was taken on the motion. Ayes, Harvey, Nelson, Sindt,
Enright, Zaun.
87.437 Motion was made by Harvey, seconded by Enright to adopt Resolution No.
87-151A adopting the assessment roll on Project 86-3 in the amount of
$1,181,514.31. The staff was directed to meet with the property owners
concerning their objections and report to the City Council at the
November 2, 1987, council meeting for the final resolution concerning
their objections by the council.

At this time, Mayor Zaun opened the public hearing on project 84-19B,
assessment of street lighting along Kenrick Avenue from Highway 50 to
the north side of the Connelly Mobile Home Park, and the City Clerk
attested to the legal notice.
The City Administrator advised the council that a letter had been
received from Mr. Pat Connelly objecting to the assessments on the
mobile home park property.
87.438 Motion was made by Sindt, seconded by Nelson to receive the letter from
Mr. Connelly and to close the public hearing.
Roll call was taken on the motion. Ayes, Sindt, Enright, Zaun, Harvey,
Nelson.
87.439 Motion was made by Nelson, seconded by Harvey to adopt Resolution No.
87-152A adopting the assessment roll on Project 87-19B in the amount of
$63,569,56.
Roll call was taken on the motion. Ayes, Enright, Zaun, Harvey,
Nelson, Sindt.
At this time, Mayor Zaun opened the public .hearing on Project 87-15,
the extension of utility lines to two lots on the south side of County
Road 64 near Antlers Park owned by Ken Larson. The City Clerk attested
to the legal notice. There was no one present in the audience wishing
to hear the engineer's presentation or ask question, or make comments.
87.440 Motion was made by Sindt, seconded by Nelson to close the hearing.

Nelson.
87.441 Motion was made by Nelson, seconded by Harvey to adopt Resolution No.
87-153A adopting the assessment roll on Project 87-15 in the amount of
$24,163.78.

Enright, Zaun.
Mayor Zaun opened the public hearing on the assessment of project 87-2,
public improvements to the Valley Park 8th Addition, Phase 4. The City
Clerk attested to the legal notice.
There was no one present in the audience wishing to hear the engineer's
presentation on the project casts, ask questions or make comments.

hearing.

Mayor Zaun opened the public hearing on Project 87-3, improvements in
the SouthFork Village Apartments, Phase 2 development. The City Clerk
attested to the legal notice.

presentation on the project costs, ask questions or make comments.
87.444 Motion was made by Harvey, seconded by Nelson to close the public
hearing.

87.445 Motion was made by Nelson, seconded by Sindt to adopt Resolution No.
87-155A adopting the assessment roll on project 87-3 in the amount of
$194,240.68.

Mayor Zaun opened the public hearing on the assessment of Project
85-11, utilities along Cedar Avenue to serve the NEI property and other
parcels. The City Clerk attested to the legal notice.
There was no one present in the audience wishing to see the engineer's
presentation on the project costs, ask questions or make comments.
87.446 Motion was made by Sindt, seconded by Enright to close the public
hearing.

87.447 Motion was made by Enright, seconded by Harvey to adopt Resolution No.
87-156A adopting the assessment roll for Project 85-11 in the amount of
$65,684.96.

The City Clerk handed out a report from Orfield & Associates concerning
the requirement standards for the new city hall for the council to
review.
