Planning Commission Meeting Minutes
SEPTEMBER 19, 2002
The September 19, 2002 Planning Commission meeting was called to order by Chair
Wulff in the City Hall Council Chambers at 6:00 p.m.
Flag pledge and roll call of members:

ITEM 3 APPROVAL OF MEETING MINUTES:
The September 5, 2002 Planning Commission meeting minutes were approved as
presented.
ITEM 4: ANNOUNCEMENTS:
Mr. Morey .stated the following. items were distributed to the Planning Commission
members and staff before tonight's meeting.

ITEM 5: PRESENTATION BY PLANNING CONSULTANT DAVID LIGHT REGARDING THE
METROPOLITAN COUNCIL'S BLUEPRINT 2030
Planning Consultant David Licht presented his review of the 4~ draft of the
Metropolitan. Council's Blueprint 2030 dated August 28, 2002. He indicated that
this regional planning effort is .being pursued to establish a new framework for the
.metropolitan area, extending the planning perspective from 2020 to 2030. Mr. Licht
highlighted the major components of the .Blueprint 2030, which have an impact on
the City of Lakeville.
Commissioner Stolte asked Mr. Erickson if we have received any comments: from
other communities.

• Mr. Erickson stated that the number of e-mails he has received indicates that cities
have elections, budgets, etc. to deal with right now so they haven't had a lot of time
to review the document. He felt that the letter the City of Lakeville mailed to 180
cities encouraging their thorough review of the draft plan material and their: active
participation in the public comment process was a very good idea.
Mr. Erickson .strongly encouraged the Planning Commission members to attend
one of the public meetings that will be held on the Blueprint 2030 in various cities
over the next three weeks.
Commissioner Stolte asked how often the Metropolitan .Council's Comprehensive
Plan is updated. Mr. Licht indicated that it is mandated every ten: years. Blueprint
2030 appears to be on a fast track to get approved before the mandated ten years.
.Commissioner Grenz asked Mr. Licht what control will the Blueprint 2030 have over
.cities. Mr. Licht stated that the cities in the seven-county metropolitan area must
comply with aviation, sewer, transportation, and park and open space plans. All
City's Comprehensive Plans have to be approved by the Metropolitan Council and
their zoning must follow the Comprehensive Plan.
• ITEM 6. LAKEVILLE TOWN OFFICE DEVELOPMENT
Chair Wulff opened the public hearing to consider the application of Marmor LLC
for the vacation of public street, drainage and utility .easements related to the
preliminary and final plat and PUD rezoning of Lakeville Town. Office
Development. Assistant City Attorney Poehler attested. that the legal notice had
been. duly published in accordance with state statutes and City Code.
Mr. Morey stated that the developer has requested that the .Planning. Commission
continue the public hearing for the easement vacation associated. with the Lakeville
Town. Office Development preliminary and final plat and PUD rezoning. He
indicated that the developer is finalizing .the preliminary and final plat and site
plans for consideration, along with the easement vacation request, at the October
10, 2002 Planning Commission meeting.:

ITEM 7. EDWARD HANSON
Chair Wulff opened the public hearing to consider the application of Edward
Hanson for a Conditional Use Permit to allow total accessory building area greater
than 1,100 square feet in the RS-3, Single Family Residential District, located at 8989
210 Street. Assistant City Attorney Poehler attested that the legal notice had been
duly published in accordance. with state statutes and City Code.
Edward Hanson was in attendance at tonight's meeting to answer any questions
the Planning Commission or public may have. The applicant stated that he is
requesting the detached accessory building for the purpose of storing lawn and
garden equipment and recreational vehicles. He stated that the accessory building
will not be used for home occupation purposes.
Leif Hanson, Zoning Enforcement Coordinator. presented .the planning report.. Mr.
Hanson stated that the applicant is proposing to construct: a detached accessory
building on his property that, when combined with the floor area. of his existing
detached garage, would exceed the maximum of 1,100 square feet of accessory
.building area that is allowed in the RS-3 District. Mr. Hanson indicated that a
detached .garage constructed in 1996 with an area of 1080 square feet currently
exists on the property. The applicant is proposing to add an accessory building on
the property with an area of 576 square feet.
Mr. Hanson stated that the proposed accessory building has a 4:12 pitch roof with a
height of 15 feet, which equals the maximum height allowed in the RS-3 District.
He indicated that the accessory building .will be wood-frame construction and
.consist of white dutch-lap siding, which is compatible with the existing principal
building and detached accessory building located on the property.
Mr. Hanson stated that the applicant is proposing to locate the. accessory building
on an existing 24 foot by 24 foot concrete slab that is located in the back yard
approximately 18 feet from the west side .property line and well within the
minimum required setbacks from the rear and east side. property lines.
Mr. Hanson indicated that a row of large deciduous trees would provide same
screening of the proposed accessory building to the properties located to the west.
Mr. Hanson stated that the applicant indicated that in order to accommodate the
construction of the accessory building, one or two existing trees .may need, to be
transplanted. Mr. Hanson stated that a stipulation of the conditional use permit
will require the applicant to install additional. evergreen trees on the west side of
the accessory: building to provide year around screening to .the west. The
• additional trees will be field located by Planning Department staff.

• Mr. Hanson stated that the existing driveway on the property is not paved. The site
plan shows that driveway access will not be provided to the proposed accessory
building. A stipulation of the conditional use permit will require the applicant to
provide a driveway access to the proposed accessory building and to submit an
escrow of $5,000 to insure that the existing and proposed driveways will be paved.
Mr. Hanson stated that should the Planning. Commission recommend. to City
Council approval of the Conditional Use Permit, Planning Department staff
recommends the 8 stipulations listed in the September 12, 2002 planning report,
and approval of the Findings of Fact, dated September 19, 2002.
Chair Wulff opened the hearing to the public for comment.
There were. no comments from the audience.

Commissioner Grenz asked .the applicant if he would be removing any trees or
• brush. The applicant indicated than .small spruce trees may be relocated. to
accommodate the building.
Chair Wulff commented that she noticed the applicant has a trailer stored in this
location now, so it will look .better to have it enclosed in the building. She .stated
that there will be a need for additional trees only if there are gaps in the tree line.
This will be determined after the accessory building is complete.
Mr. Morey commented that staff received e-mails regarding the proposed accessory
building. He clarified. that thin building will not be used for business or industrial
purposes.
02.124 Motion by Stolte Second by Reuvers to recommend to City Council approval of the
Conditional Use Permit for Edward Hanson to allow total accessory building area
greater than 1,100 square feet in the RS-3, Single Family Residential District, located
at 8989 - 210 Street, subject to the 8 stipulations listed in the September 12, 2002
planning report, and approval of the Findings of Fact dated September 19, 2002.

• ITEM 8. SOUTH CREEK
Chair Wulff opened the public hearing. to consider the .application of Laukka -
Jarvis, Inc. for a preliminary plat of 146 single-family residential lots to be known as
South Creek, and a variance for cul-de-sac street length. Assistant City Attorney
Poehler attested that the legal notice had been duly published in accordance with
state statutes and City Code.
Peter Jarvis of Laukka-Jarvis was in attendance at tonight's meeting, along with Joel
Cooper from James R. Hill, Inc., to answer any questions the Planning Commission
or public may have. Mr. Jarvis presented a shorn history of his company and an
overview of the South Creek preliminary plat. He indicated .that .the South Creek
plat would be built in three phases and would likely be completed in 2005.
Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey
stated that Laukka Jarvis, Incorporated. representatives have submitted an
application for the preliminary .plat of South Creek. He stated that the proposed
preliminary plat consists of 146 single family residential lots on 87 acres located
north Ardmor Village Manufactured Home Park, east of Cedar Avenue (County
Road 23) and abutting the city limits of Lakeville and Farmington. ,

Medium Density Residential District which allows the development of single
.family residential lots utilizing the RS-3 District requirements.
Mr. Dempsey stated that early staff reviews of the South Creek preliminary plat.
indicated that Streets F and G would need variances for. cul-de-sac street length.
The developer has revised the plans to reduce the cul-de-sacs to less than 600 feet in
length. He indicated that. a variance is not required for any cul-de-sac streets in the
South Creek preliminary plat.
Mr. Dempsey indicated that the Ardmor Village Manufactured Home Park has a
number of encroachments in the southeast corner of the South Creek property. The
developer is proposing to administratively subdivide and combine with the
manufactured home park property a 50-foot wide strip of land to be deeded to the
Manufactured Home Park owners to eliminate the encroachments.
Mr. Dempsey indicated that the minimum lot area and lot width requirements are
being met. He stated that all 146 lots have adequate building pad areas. He also
'indicated that there are 6 outlots proposed in the South Creek preliminary plat
totaling 26.06 acres.

• Mr. Dempsey stated that the South Creek preliminary plat is proposed to be
developed in 3 phases.
Mr. Dempsey. indicated that the South Creek preliminary plat abuts Cedar Avenue
(County Road 23). Cedar Avenue is designated as a High Density Minor Arterial
roadway in the City's Comprehensive Transportation Plan. There are two
proposed connections to Cedar Avenue. Street A will include. a full access
intersection with Cedar Avenue at the north end of the plat. The southerly access
will be right-in, right-out only.
Mr. Dempsey stated that the South Creek preliminary plat is located in an area that
has 644 significant trees consisting mostly of cottonwood, elm, box elder, poplar
and willow trees. The plan proposes to remove 465 trees. A total of 28% of the
significant trees will be saved. A .tree inventory and tree preservation plan were
submitted by the developer and have been reviewed by Engineering Department
staff.
Mr. Dempsey indicated that the developer will install a berme and landscape
screening in the buffer yard area of the Lots 1-3, Block 5 that abut Street A: A
landscape. plan has been submitted that shows a landscaped buffer along Street A
• as required by the Zoning Ordinance for double frontage lots.
Mr. Dempsey stated that there are three wetlands located within the South Creek
preliminary plat boundaries. Wetland fill totaling 1.12 acres is proposed. Proposed
wetland fill and mitigation has been reviewed by Engineering Department staff.
Mr. Dempsey stated that a future neighborhood park is planned for the north side
of the South Creek development and the south side of the adjacent property to the
north. The South Creek final plat will dedicate 4.20 acres of land to satisfy part of
the park dedication requirement. The required amount of park dedication is 10% of
the plat area or approximately 8.7 acres. The remaining park dedication will. be
cash and will be determined with the phase. one final plat. Mr. Dempsey indicated
that when the property to the north develops, additional park land will. be
dedicated and combined with the 4.20 acres. of park land being dedicated with
South Creek for the development of a neighborhood park.
Mr. Dempsey indicated that the Parks, Recreation and Natural Resources
Committee recommendation related to park dedication and trails. for the South
Creek preliminary plat from their September 18, 2002 meeting,. was distributed at
tonight's meeting.

• Mr. Dempsey stated that should the Planning Commission recommend to City
Council approval of the South .Creek Preliminary Plat, Planning Department staff
recommends the 10 stipulations listed in the September 13, 2002 planning report.

Commissioner Grenz asked how the encroachment happened and why the
elimination of the encroachment needed to be a stipulation if it doesri
t involve the
City directly. Mr. Dempsey indicated that Laukka-Jarvis and the owner of Ardmor
Village Manufactured Home Park have agreed to this solution for ' the
.encroachment problem.
Mr. Morey stated that an administrative subdivision/combination is required,
which falls .under the .requirements of the subdivision Ordinance, as does the
preliminary plat; therefore, staff is recommending the stipulation as part of the
preliminary plat approval.
Chair Wulff indicated that it is standard practice to resolve encroachments when
the property is platted.
Commissioner Detjem asked about screening for the lots in the southeast corner of
the preliminary plat adjacent to Ardmor.. Village Manufactured' Home Park. Mr.
Dempsey.. indicated that there is no buffer screen requirement because the two uses
are single family. detached. dwellings. Mr. Jarvis stated that it is to his advantage to
install a landscape screen for these lots, which he will do with this development.
Chair Wulff was concerned about .transitional screening on the north end of the
preliminary .plat, especially if townhomes are developed on the adjacenfi RM-1
property to the north. Mr. Morey indicated that the responsibility. for landscape
screening typically falls upon townhouse developments where they abut single.
family developments. Mr. Morey stated that new single family developments are
.required to install 2 new trees .per lot. He suggested that the 2 trees for Lots 1, 16
and 17, Block 1 could be evergreen trees installed on the north side of the lots.
Mr. Rubash explained that when the 22 acres to the north develops, a ponding area
would be constructed as identified in the Comprehensive Storm Sewer Plan in the

low area of that property, which he .indicated would be directly north of the
northerly cul-de-sac in the South Creek plat.
Chair Wulff asked about the temporary turnaround off of Street A. Mr. Rubash
indicated the temporary turnaround could be placed on the future park property,
subject to the approval of the Parks and Recreation Director. -The temporary
turnaround would be removed when the adjacent property to the north develops,
and Street A is extended and the future park is constructed.
The adjacent property owner to the east in Farmington, John Sayers, indicated that
he did not receive notice of this plat until 2:00 p.m. today. He was not against the
.project at this time, but wanted to be updated about downstream drainage.
Mr. Morey commented that notices were sent out September 6, 2002 to property
owners within 500 feet of the proposed development.. There was also. a public
notice sign posted on the property facing Cedar Avenue informing people of the
proposed development.
Joel Cooper from James R. I-Iil1, Inc. explained the existing drainage pattern and
how this development will .redirect approximately 80% of the existing drainage
• from .the South Creek site away fromthe Sayers property. City staff will provide
Mr. Sayers with a copy of the planning and .engineering reports, and the
preliminary plat plans.
Chair Wulff explained to Mr. Sayers that he will have the opportunity to discuss
any questions regarding the preliminary plat and drainage with staff before the
preliminary plat is considered by the City Council on October 7.
