HomeMy WebLinkAbout06-21-79 xi P S ~ 1 CITY OF LAKEVILLE SPECIAL COUNCIL MEETING June 21, 1979 LAKEVILLE SENIOR HIGH SCHOOL The meeting was called to order by Mayor Lekson at 7:40 p.m. Roll call was taken. Present: Councilmembers Spande, Zaun, Curry, Nelson and Mayor Lekson. Also present: Patrick Farrell, City Attorney; Darrell Schneider, Consulting City Engineer; James Robinette, Public Works Director; Patrick McGarvey, City AdministratorjClerk. At this time Mayor Lekson reopened the public hearing on the proposed improvement of Junelle Path from 188th St. to the improved street in Bassett's Second Addition. Mrs. Curry asked to be excused from her Council .chair as she has property in the proposed area of benefit. At this time Mr. Schneider presented alternative assessment methods prepared for the continued hearing. Mr. Schneider explained that at the June 7th hearing the proposal was for a front foot assessment rate estimated at $11.93 per front foot. This would provide for a 24 foot wide rural section street with four foot gravel shoulders. At this time Mr. Schneider presented alternative assessment methods numbered one through four. Mr. Schneider explained with an overhead projector how each method would effect a typical 100 foot wide lot with the equivalent of one unit for the area assessment. Mr. Schneider stated that he had recommended to the Council that alternate method number 3 be used and that the city park be assessed for its:.:entire 105 foot of frontage. At this time Mayor Lekson opened the meeting for questions from the audience. Mr. Danaher questioned why he should have to pay for 662 front feet and six units. Mr. Schneider stated that because he had 662 front feet, he could eventually subdivide his large parcel into smaller lots for sale. Mr. Danaher questioned why the swamp area in the Bassett's Addition, described as Outlot A, was`got assessed.. Mr.Farreil:explained that the land would have to be benefited by the proposed assessment and also explained how a parcel of land can become tax forfeited. Mr. Farrell explained that the. land is first offered to the City when it is tax forfeit, then the Minnesota DNR may choose to keep it if the City does not. If neither the City or State choose to keep it, then the land is offered to the public. Mr. Ross Bassett stated that he is not paying taxes on Outlot A. Mr. Schneider stated in response to the question that the estimated price for the pro3ect is not guaranteed. Mr. Hopper raised a question concerning the value of his property under the proposed assessment. Mr. Farrell stated that the City would obtain qualified appraisals on the value proposed to be assessed if and when the project is ordered. Mr. Zion asked the City Engineer about the soil condition in the road right- of-way. -1- CITY OF LAKEVILLE SPECIAL COUNCIL MEETING June 21, 1979 LAKEVILLE SENIOR HIGH SCHOOL Mr. Schneider explained that the estimate includes some additional fill material and that soil tests would be taken before plans and specifications were completed. Councilman Zaun asked the City Attorney when a parcel of property is benefited. Mr. Farrell stated that the benefit is as of the date of the assessment hearing. Mr. Zaun stated that he felt that the property would be enhanced and benefited and favored alternate number three. Councilman Nelson asked the City Attorney about the wetland status in Outlot A. Mr. Farrell stated that the U.S. Army Corps of Engineers would also get involved if and when anyone attempted to fill Outlot A for the purpose of subdividing. Mr. Nelson stated that he favored alternate method number three in assessing the project. Councilman Spande said that he felt the Council had responded to the petition asking for information and a chance to be heard on the proposed improvement. He stated that he favored alternate method number three. At this time Mayor Lekson stated that he also favored method number three in assessing the project if it is ordered. 79.313 Motion was made by Zaun, seconded by Nelson to close the public hearing. Roll call was taken on the motion. Ayes, Nelson, Zaun, Spande, and Lekson. 79.314 Motion was made by Sgande, seconded by Nelson to adopt Resolution X679-55 ordering the project and authorizing the City Engineer to prepare plans and specifications for the improvement. Ro11 call was taken on the motion. Ayes, Zaun, Spande, Lekson, and Nelson. Nays, none. Obstained, Curry. 79.315 Motion was made by Spande, seconded by Zaun that the Council favors alternate number three presented by the City Engineer as the best procedure for assessing the project. Roll call was taken on the motion. Ayes, Spande, Lekson, Nelson and Zaun. Nays, none. Obstained, Curry. 79.316 Motion was made by Zaun,'seconded by Nelson to adjourn the special Council meeting.
