CITY OF LAKEVILLE SPECIAL COUNCIL MEETING
June 7, 1979
LAKEVILLE SENIOR HIGH SCHOOL
A special meeting of the City Council was called to order by Mayor Lekson
at 7:30 p.m.
Roll call was taken. Present: Councilmembers Nelson, Zaun, Spande, Curry,
and Mayor Lekson.
Also present: Darrell Schneider, Consulting City Engineer; Patrick Farrell,
City Attorney; Patrick McGarvey, City Administrator/Clerk.
At this time Mayor Lekson opened the public hearing on the proposed
improvement of extending city sanitary sewer and water lines north from
T.H. 50 to the Connelly Mobile Home Park area.
The City Attorney attested to the proper legal notice both published and
mailed for the hearing.
Darrell Schneider presented the estimated cast for the utility improvement
project. The total estimated cost is $263,725. Mr. Schneider showed maps
giving the location of the proposed water and sewer lines and the area to be
benefited by them.
Mr. Schneider also gave estimated front foot lateral assessment rates and
area and unit connection charge rates for the property benefited by the
utility improvements.
At this time the Mayor opened the meeting for questions from the audience.
Mr. Tom Wurst, an attorney representing the Mills property, requested the
location of the lateral sewer line on their north boundary. He also stated
that they are in favor of the project.
Mr. Patrick Connelly asked when the project could be finished. Mr. Schneider
stated that plans and specifications and the bids could be taken this summer
and the project could be finished yet this year. Mr. Connelly stated that
he is in favor of the project.
Patrick Wren asked what the interest rate on the assessments would be.
The City Clerk stated that the proposed assessment period would be for ten (10)
years on an 8y interest rate on the unpaid principal each year.
At this time Mayor Lekson stated that he had received a letter from Paul
Krause requesting that by petition his property located southeast of the
Country Kitchen be added to this project so that sewer could be extended to
serve the Power Center gas station and six acres southeast of the gas station.
79.280 Motion was made by Curry, seconded by Zaun to receive the letter from Paul
Krause with the request.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Curry, Spande and Lekson.
79.281 Motion was made by Nelson, seconded by Curry to authorize the City Engineer
to include the requested sewer extension to serve=- the Power Center and six
acre,: parcel subject to the property owner signing a petition prepared by the
City Attorney for the improvement.
Ro11 call was taken on the motion. Ayes, Spande, Lekson, Nelson, Zaun and Curry.
Mr. Schneider showed the Council and citizens the area Mr. Krause had requested
service to on a map.
79.282 Motion was made by Zaun, seconded by Nelson to close the public hearing.
Roll call was taken on the motion. Ayes, Zaun, Curry, Spande, Lekson and Nelson.

79.283 Motion was made by Spande, seconded by faun to adopt. a resolution ordering the
sanitary sewer and water project authorizing the City Engineer to prepare
plans and specifications for the project.

Mayor Lekson opened the public hearing on the proposed improvement of Junelle
Path from 188th St. to the asphalt street in the Bassett's Second Addition
at 8:35 p.m.
The City Attorney attested to the proper legal notice both published and
mailed for the hearing.
Councilmember Curry stated that she wished to be excused from her Council
seat as her property is involved in this proposed project.
Mr. Terry 2.ion stated that he didn't get a notice of the hearing mailed to
his home. Mr. Farrell asked if his was the property shown on the county
maps owned by Worhalic. Mr. Zion stated that it was. Mr. Farrell advised him
that the list of property owners is obtained from the Dakota County
Auditor Office and his name is not on that list.
Mr. Darrell Schneider presented the proposed project showing a map with the
proposed .road improvement indicated in yellow.
Mr. Schneider stated that the asphalt road will be 24 feet wide with a rural
type design gravel shoulders.
The proposed assessment rate was $11.93 per front foot including the city
park property. The road would be 2-inch bituminous mat with the 4-foot
shoulder. He indicated that the proposed assessment was for ten (10) years
at an interest rate of 8% on the unpaid principal each year.
At this time Mayor Lekson opened the meeting for quesions -and comments from
the audience.
Mr. Gordon Lane asked if there would be additional base material added to the
road. Mr. Schneider explained that there would be at least 4 inches added
in certain areas and that there would be borings taken before complete plans
and specifications were finished if the project is ordered by the Council.
Terry Zion questioned the report of the engineer on the proposed assessments.
He also presented a petition on the park land and swamp issue. Mayor Lekson
read the petition in full.
Mayor Lekson also stated that the city park would be assessed like any other
property.
Val Nordin asked when 188th St. would be improved from its present gravel
status.
Mr. Schneider showed how 185th St. is expected to be extended from T.H. 50
to I-35 and how the Junelle Path could go straight north through the property
connected to the new 185th St. in the future.
Mel Henry spoke and stated that he is in favor of the project..
Kent Stever spoke and stated that he appreciated the City Council's effort
and is in favor of the project.
Gordon Lane questioned about the possibility of splitting some of the swamp
costs for the property owners in the Second Addition.
Patrick Farrell stated that the swamp is not now city property. Discussion
occurred on possibly assessing the costs involved with going past the swamp
on a unit basis for the entire area.
Mr. Hopper stated that his property would not be benefited on a unit basis
assessment for the swamp in his opinion.
Mr. Farrell stated that the City Council's notice that was. published involved
all of the property in the 1st, Znd and 3rd Additions of Bassett's and that
the Council would be eligible to assess any or all of that property. At this
time Mr. Farrell read the original petition received by the City Council
that requested the public improvement report and hearing.

Councilman Zaun stated that he thought there was a need to figure out a
so-called area charge for the cost of a road past the swamp land.
At this time the City Engineer did some quick calculations to determine
what type of area charges would be necessary if the swamp costs were
assessed under various alternatives.
Mr. Bill Wilder stated that his property is at the end of Junelle Path, but
he is still in favor of an area assessment.
Mr. Stever stated that he felt the Council has the authority to make the
decision on the matter and had received adequate citizen input.
Mayor Lekson stated that he was right, the Council does have the authority
to make the decision, but that his philmsophy is not to put in something
unless the majority of the citizens in the area who have to pay for it,
support it.
Tom Smith suggested stopping the project at the city park.
79.284 Motion was made by Nelson, seconded by Spande to continue the public hearing
to June 21, 1979 at 7:30 p.m. at the Lakeville High School.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Spande and Lekson.
Nays, none. Obstained, Curry.
79.285 Motion was made by Spande, seconded by Curry to approve the first reading,
and waive the second reading of Ordinance X144 changing the closing hours
for the off-sale liquor store to be in compliance with state statuates.
Roll call was taken on the motion. Ayes, Nelson, Zaun, Curry, Spande and Lekson.
79.286 Motion was made by Spande, seconded by Zaun to adjourn the special Council
meeting.
