Roll call was taken. Present: Councilmembers Spande, Curry, Zaun, Nelson, and Mayor Lekson. Aso present: Patrick carrell, City Attorney; Darrell Schneider, City Engineer;. Patrick McGarvey, City Administrator/Clerk. 79.141 Motion was made by Curry, seconded by 7,aun to adopt Resolution No. 79-18 approving a new date for James Jepson's PERA time and eligibility. Roll call was taken on the motion. Ayes, Lekson, Curry, Zaun, Nelson, and Spande. 79.142. Motion was made bq Zaun, seconded by Currq to approve the claims for payment as presented and including a claim to the Trophy House in the amount of $83.62 and deleting the claim in the amount of $42 for conference registration to the Minnesota Planning Association. - Roll call was taken on the motion. Ayes, Curry, T.aun, Nelson, Spande, and Lekson. , Staff reports. Administrator. The City Administrator presented a claim from Attorney David L. Kraker for an alleged in~urq sustained on January 28, 1979, by Lisa Janush at Bunker Hill Park. 79.143 Motion was made by Curry, seconded by Nelson to receive a notice of claim and report to the Citq insurance carrier. Roll calS was taken on the motion. Ayes, Zaun, Nelson, Spande, Lekson, and Curry. The City Administrator advised. the Council that an ordinance should be adopted which would adopt by reference the latest edition of the model flood plain which has been prepared by .the Minnesota DNR and required bq the Federal Insurance Administration to retain Lakeville's eligibility in the flood insurance .program. The Administrator pointed out that the contents of the ordinance being adopted by reference were included in the proposed new City zoning ordinance and would be adopted and published when the new zoning ordinance is approved later this year, 79.144 Motion was made by Spande, seconded by Nelson to adopt Ordinance No. 141-adopting by reference the sample flood plain management ordinance, and waiving the second reading in adopting the ordinance. Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Curry, and Zaun. 79.145 Motion was made by Zaun, seconded by Nelson to receive the minutes of the Advisory. Committee's meeting. Roll call was taken on .the motion. Ayes, Lekson, Curry, Zaun, Nelson, and Spande. 79.146 Motion was made by Nelson, seconded by Zaun to adopt. Resolution No. 79-I3 ordering the Lake Marion area trunk sewer project and authorizing a City Engineer to prepare plans and specifications on the project along the most feasible route. Roll call was taken on the motion.. Ayes, Spande, Lekson, Curry, Zaun, and Nelson. 79.147 Motion was made by Curry, seconded by Zaun to adopt Resolution No. 79-20'ordering the sanitary sewer improvement: on the west end of>-185th Street to a_point ending at the east boundary of the Woodridge preliminary plat. Roll call was taken on the motion. Ayes, Curry, Zaun, Nelson, Spande, and Lekson. 79.148 Motion was made by Zaun, seconded by Curry to approve the second reading and adopt Ordinance No. 142 commending Ordinance No. 42 by providing under Section 13.2 Paragraph 2, a conditional use for elderly housing. Roll call was. taken on the motion. Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Curry, and Zaun. 79.150 Motion made by Curry, seconded by Zaun to authorize an order of the placement of no parking signs on the south side of 168th. Street from the Sea-Girt Inn east to the area where 168th Street abuts the Lake shore. Roll call was taken on the motion. Ayes, Spande, Lekson, Curry, Zaun, and Nelson. 79.151 Motion was made by Zaun, seconded by Spande to adopt Resolution No. 79-2I setting a public hearing on the proposed improvement of sanitary sewer and water north from Trunk Aighway SO along old Highway 65 for April 26, 1979, 7:30 p.m. at the Council Chambers.. Roll call was taken on the motion. Ayes, Lekson, Curry, 2,aun, Nelson, and Spande. .79.152 Motion was made by Spande, seconded by Curry to authorize the establishment of the position of sergeant in the Lakeville Police Department for one employee and appoint Richard Schwartz to the position effective April 2, 1979.. Ro11 call was taken on the motion. Ayes, Curry, Zaun, Nelson, Spande, and Lekson. 79.153 Motion was made. by Zaun, seconded by Curry to approve the monthly pay for the fire chief at $225 per month, second assistant fire chief at $125 per month, and training officer at $SQ per month for the. Lakeville volunteer fire department. Roll call was taken on the motion. Apes, Zaun, Nelson, Spande, Lekson, and Curry. 79.154 Motion was made by Curry, seconded by Nelson to approve two assessment abatements as recommended by the Dakota County Assessor's Office by a parcel of property owned by the City of Lakeville, and another owned by Searle Marketing Service Inc. Roll call was. taken on the motion. Ayes, Nelson, Spande., Lekson, Curry, and Zaun. 79.155 Motion was made by Zaun, seconded by Nelson to_receive a petition from the property owners in the Farmington outlet district requesting that their property be excluded from the proposed assessment for the Lake Marion trunk sewer project and from the urban development area under the City's growth-stating plan. Ro1I call was taken on the motion. Ayes, Spande, Lekson, Curry, Zaun, Nelson. 79.156 Motion made by Curry, seconded by Spande to exclude the Farmington outlet district from the urban service area of the growth-stating plan. Roll call was taken on the motion. Ayes, Lekson, Curry, Zaun, Nelson, and Spande. 79.157 Motion was made by Zaun, seconded by Curry to authorize the engineer to prepare plans and specifications for the Phase II and III improvements of the Valley Park 8th Addition as requested by Niakwa Incorporated by adopting. Resolution No.79-2 Roll call was taken on the motion. Ayes, Zaun, Nelson, Spande, Lekson, .and .Curry. At this time the City Council discussed the tabulation of the returns received by postcards on the Orchard Lake utility project.. The consensus of the Council was that the majority, of property owners who live in the community did not favor the project at this time. 79.158 Motion was made by Nelson, seconded by Lekson not to schedule any .further informational meetings., or public hearings, on the Orchard.Lake utility project as a result of the citizens' response to the City postcard questionnaires. Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson, Curry, and Zaun. 79.159 Motion was made by Curry, seconded by Zaun to receive the 197$ annual report from the Lakeville Police Department.
