HomeMy WebLinkAbout03-22-79 }1 ~ ~ t' CITY OF LAKEVILLE SPECI®L COUNCIL MEETING. ..March 22, 1979 -The meeting was called to order by Mayor Lekson at 7:30 p.m. at the Lakeville High School. Roll call was taken.. Present: Councilmembers Spande, Zaun, Curry, Nelson, and.Mayor Lekson. Also present: .Roger Knutson, City Attorney; Frank Burg and Darrell Schneider, City Engineers; James Robinette, Public Works Director; Patrick McGarvey, City .Administrator/Clerk; JoAnn Taft, Deputy City Clerk. At this time Mayor Lekson explained to the citizens present at the special Council meeting the .procedure for the evening's two public hearings and to select a seat where they could see the projector screen for the presentations by the City Engineers on the two improvement projects. At this time Mayor Lekson opened the public hearing on the proposed .trunk sewer improvement project from the Lakeville High School property, south and.. southeast to the existing trunk sewer line near the Lamplighter apartment complex in Lion's Park. The City Attorney attested to the proper legal notice for the public hearing and advised the Council that it was a duly constituted hearing. At this time Mr. Darrell .Schneider explained. that there was a major spill on January 4,.197$ in one of the small lift stations, a neighborhood sewer system that temporarily is used to convey the sewage from the Orchard Lake trunk system and Lake Marion to the existing trunk system in the Old Village area. Mr. Schneider explained that the proposed project would eliminate the use of the neighborhood system and complete the Orchard Lake trunk sewer system as it was in vision for the past 10 years. Mr. Schneider also explained that the proposed .project has the assistance of a $219,000 grant from the U.S. Department of Housing Urban Development to help defray some of the cost. Mr. Schneider advised the citizens that the assessment on the area basis proposed at $340 per acre. In addition, there would be a lateral benefit charge for properties where the trunk sewer ~~ould also serve as their lateral. Mr. Schneider then presented a-map showing three alternate locations fore the pipe and explained that a fourth alternate was considered in preparing the report but was rejected.. The fourth alternate would.have placed. a pipe along the Minneapolis, Northfield railroad, racks where it would have been of minimal benefit. Mr. Schneider explained that the submitted project cost ranged from $905,260 .for alternate No. 3 to $987,275 for alternate No. 1. Each route has its advantages. and disadvantages, he stated. Mr. Schneider stated that the actual placement of the pipe whould be in a location which would best benefit the property through which is to be constructed. At thin time Mayor Lekson opened the meeting for.: questions and comments from the audience.. Mr. Anderson raised a question as to what properties benefited by the line. Mr. Schneider explained that the trunk line benefits a large area, which when it develops, would connect to this portion of the trunk system. Dick Todd is who requested this project. Mayor Lekson explained that the City of Lakeville is responsible for seeing that the trunksystem is completed. Mr. Schneider explained that the Farmington Outlet District Would go either of two directions to receive trunk sewer service. Old Village District was one of those directions. -1- • • CITY OF LAKEVILLE SPECIAL COUNCIL MEETING March 22, 1979 Mr. Charles Parish questioned the legal. description in the notice as compared to the actual property and asked,if, the area is too small shown on the map compared to legal written description? Mr. Schneider explained. that the description is difficult to write based on topographic lines and that they usually write the description for a greater area than what the map may show. Mr. Schneider explained that in the Old Village District, and Farmington Outlet District there is an estimated 1150.. acres of Land that could be served by this trunk line. Future lateral links would. have to be constructed throughout the two districts to connect to the trunk with the largest of the lateral lines estimated at 15-inch`in size. Mr. Glen Nord asked if a smaller line along Lake Marion could be upgraded in place of building this proposed trunk. Mr, Schneider explained that there lass no feasible way to use the laterals, a part of .the ultimate trunk system. Mr, Schneider explained that there are four. different revenue sources to pay for the trunk sewer system. The first is the area acreage charge currently at $340 per acre in 1979. Second is the lateral benefit charge, the third is the unit connection charge which is currently: $425 per building unit in 1979,. and the fourth source for this protect is the U.S. Department of Housing Urban Development with a::$219,OOQ grant. At this time the City Administrator. explained the assessment policy. It was explained that the Council must adopt the assessment :role on or b~.fore October 10 of each year,. with 'the maximum period of assessment for this trunk project at 2A years at 8 percent interest on the end principal:; At this time each of the City Council members gave-their comments, and positions concerning the proposed project, The consensus was.that the project is necessary to complete the trunk sewer system and provide the City with the opportunity for orderly:. growth in this parCicular area of the City and an effective sewer system. - 79.136 Motion was made by Curry, seconded by 7.aun to receive letters from individuals concerning the project. Roll call was taken on the motion. .Ayes, Spande, Zaun, Curty, Nelson, and Lekson. 79.137. Motion was made by Nelson, seconded by 7a.un to close the public hearing.>and table the decision-on the project until the Anril 2, 1979 Council meeting. Roll call was taken on the motion.. Ayes, Spande, ?aun, Curry, Nelson, and Lekson. Time: x:20 p.m. After a-brief recess, Mayor Lekson opened the public hearing on the proposed -185th Street sanitary sewer project at 9e35 pm. The City Attorneyattested to the legal notice for the hearing and stated that the hearing was legal. Mr. Frank Burg, City:. Engineer, presented the proposed project using slides. Mr. Burg presented the-three alternate routes for servicing property at the west end of 185th Street, and more particularly the Woodridge preliminary .plat located on the north side of 185th Street. Mr. Burg gave the ;estimated cost of the three. alternates which range from $.136,500 for alternate one to $210,950 for alternate two. Mr. Burg explained that the primary way of fnancing;this project would be for a lateral beneft:assessment of the property which the line would actually serve, and from the:;$425 unit charge made for'each towing unit connecting to the line at the 1979`rate. Mr. Burg explained that it does connect to the existing sewer system and would use the new trunk. Mr. Burg also explained and answered the question how the legal description is written and that it does. differ from the exact drainage area topal lines due to the difficulty of writfng a Legal description based strictly on topography. Mr. Burg explained what is meant by a lateral.benefit. Mr. Burg further explained that the estimated per.-foot rate for lateral benefit in this project may be in the 15`to 18 dollar cost range, Mr. Burg explained that the sewer line ,could be stopped short of Ionia Avenue now. He further explained that the line should be extended easterly on 1$Sth Street in the future before l$5th Street is'improved so than area could have City sewer. Mr. Gary Christienabn stated that 15 acres"in the south side of 185th Street did not need City sewer at this time. Mr. Ron Grapey who lives oaf the south side of ,185th Street could be effected by alternate one stated°that he was not in favor of it. - At this time the City. Council members stated their comments concerning the proposed project and alternate routes. Each of the Council members stated that in this case. it was a matter of using the route that- was;most financially feasible and has 'the most acceptance from the benefit of property°°owners who would have to pay the assessment. The consensus was that alternate number three was the most feasible route under these circumstances.. 79.138 Motion was made by-Curry, seconc~$d by 7.aun to close the. public hearing and to table action on this proposed project until the April 2, 1979 Council meeting. Roll call was taken on the motion. Ayes, Spande, Zaun, Curry, Nelson, and Lekson. Time: 10.40 p.m. 79.139 Motion was made by Spande seconded by Nelson to appoint Mr. Marvin Geisness'to a erm on the planning commission expiring on January':`1, 1981. Roll call was taken on the motion. Ayes, Spande, Zaun, Nelson, Curry,. and Lekson. 79.140 Motion was made by Spande, seconded by 7aun to adjourn the Special Council l+leeting.
