The .meeting. was called to order by Mayor:Lekson at'7:30 P.M. The pledge of
allegiance to the flag `was given...:.
Roll call was taken. Present:. Councilmembers Spande,Curry., Zaun, Nelson and
Mayor Lekson.
Also present: Frank Burg, Consulting City i~ngineer; Patrick Farrell, City Attor-
ney, Patrick McGarvey, City Administrator/Clerk,.
79.40 Motion was made by Gurrp, seconded by ?,aun o approve he Council minutes of
January 15, 1979 as-read.
Roll'Ballwas taken nn the motion. Ayes, Lekson, Curry, 7.aun, Nelson and Spande.
79.41 Motion was made by 7aun, seconded by Nelson-to approve the claims for payment
as ..presented except, two claims. One_to the `U. S. Geological Survey and the other
to Arvid King.
Roll call was taken: on the motion. Ayes, Curry,.Zaun,'Nelson, Spande and Lekson.
Staff reports;
Mr. Farrell presented xn,ardinance which.. would amend the Planning Commission
Ordinance by reducing the number of members required for a quorum>from five
down to four members. The Council agreed that a simple majority s all that
.should be required.
79.42 Motion-.was: made by Lek, on,'seconded by Curry to adopt Ordinance'~~135 changing
-the-:quorum for the Planning Commission from`-five members to four"member`s, and
to waive the second reading of the ordinance and adopt it.
Roll call was taken on the motion. Ayes, Zaun, RTelson, Spande, Lekson and Cutry.
Mr. Farrell .recommended the Council authorize the payment o~ up to $50fl for nay-
ment of taxes: and'~ssessments`on`a parcel of property the City had purchased
from the Huf€mans along'Highview.Avenue. Air. Farrell explained that this was
necessary. to take care o£ assessments and taxes for 1975 and 1976.
79.43 Motion was made by ?,aun, seconded by Curry to authorize payment of up to $500
to. Dakota County for taxes and assessments due on the parcel purchased-by the
City, from the Huffmans.

The City Engineer had no reports.

The City Administrator advised the Council of a letter handed out concerning
..public officials liability insurance with two. price quotations from the City!s
insurance agent for two different companies.- The City Administrator explained
that the City had changed from Western Insurance Company to Home ,Insurance Com-
pany as of the first of the year for the final year of the three yeax package
with Professional Writers. Home Insurance had offered a lesser premium price
for 1979.
The Administrator explained thaf Western Insurance was not offering public:
liabili~g insurance for 1979 and that at the present time the City does not:.
have that particular insurance coverage.
.:79.44 Moton`was made by;Zaun, seconded by Spande to authorize the staff to xeview the
public officials liability insurance policies from the' wo companies quoted and
report to the Council.

The: City 'Council reviewed the"site and building plans for a'cold storage building
far Elmer N. Olson Company located_to he rear and`eas of their existing .main
building. The. City, Administrator explained that the building location is the
aam~ as shown on the site plan approved in December of 1978.

79.52 Motion was made by Curry, seconded'by Nelson to approve the maintenance agreement
with Owens Services Corporation effective February: 1, -1979.`

79.55 Motion wad made by Zaun; seconded*by Spande to approve Resolution x'7!9-5 on the
agreement. with Metropolitan.,Council for-planning grants,

The Council discussed the proposed agreement with the U. S."G. S. for the fiscal'
year 1979. The Council directed the staff to arrange a'meeting with representa-
tines of-the U. S. G. S: to find out the status of data collected the past three
years and the type of wfitten report to- be provided.
79.56 Motion was made by Zaun, seconded by Curry to table the agreement with the U. S.`
G. S. for fiscal' year 1979. `

79.57 Motion was made by Curry, seconded_by 7aun to table the request of the `Savage
Jaycees as the'. Jaycees had not senta letter,or"representative.

79.5$ Motion was.,made by Curry, seconded by Spande to adopt Resolution X79-6 receiving
the engineer's preliminary report on the Airlake 2nd Addition utility project.
Roll call was taken on the motion. Ayes, Nelson, Spande, Lekson,`Curry and Zaun.
Mr.-Frank Burg presented the draft ofthe preliminary report to be submitted on
February; 20th for the trunk sewer project running from the Lakeville High School
to the Lamplighter Apartment ;complex.
79.59 Motion was made by Zaun,-:.seconded by Nelson.. to receive the draft'"of the trunk
sewer report on the proposed sewer project.

79.60 Motion was made by Curry, seconded by Nelson to set a spece.l Council me2tii~~;
for 'the purpose of an informational'meeting;with the residents on the west,
south and"southeast sides of Qrchard Lake concerning the possibility of extend-
ing utility service in that area for February: 22, 1979 at 7:30 P.M. at the Lake-
vi21e High School.

The: staff was directed to send a letter to the residents in the proposed project
area advising hem of the. informational meeting.,
The City Council discussed the request of Owobopte Industries for an, abatement
on their assessed valuation of property as anon-profit organizat on.
79.61 Motion was made by Curry, seconded by Zaun to refer the matter to `the `City. Attorney
for 'review concerning the qualification of tax-exempt status.

79.62 Motion was made by Zaun seconded by Curry to suspend the fees in Resolution 478-91
to October 1,'.1979.

79.63 Motion was made by Curry, seconded by Zaun to approve the .agreement between-the
City and Randal Slagel for assessing water utility service to his lot,

The City Administrator advised the Council that Ordinance ~~118 required a public
..hearing on renewals of gravel excavation permits. The staff recommended that the
public hearing provision for renewals be eliminated to 'save time .and money.
79.65 Motion was made by Zaun, seconded by Curry to adopt Ordinance X136 amending Or-
dinance 4118, section 6 and waive the seco~zd hearing and adopt the Ordinance..

The. City Council dscussed'the Administrator's recommendation that polciesrbe
established whereby the issuance of building permits for additions to`commercial
and: industrial buildings or for smaller new commercial buildings be handled at
the staff. level rather than making the owner go through the Planning Commission
and .City Council. It was pointed out that this process can delay the issuance
of a building permit three or four weeks depending. upon the meeting schedules.
The Council discussed the matter and directed the staff to prepare policy. guide-~
lines for the new policy an the. matter.
