RESOLUTION NO. 08-91
RESOLUTION IMPOSING WEIGHT RESTRICTIONS
ON 7UDICIAL ROAD FROM 185T" ST. TO 205T" ST.
WHEREAS, Judicial Road is jointly owned and maintained by Credit River
Township and the City of Lakeville; and
WHEREAS, Minnesota Statute §169.87, Subd 1 grants local road authorities,
with respect to highways under their jurisdiction, the right to prohibit the operation
of vehicles upon any such highway or impose restrictions as to the weight of
vehicles to be operated upon any such highway, whenever any such highway, by
reason of deterioration, rain, snow, or other climatic conditions, will be seriously
damaged or destroyed unless the use of vehicles thereon is prohibited or the
permissible weights thereof reduced; and
WHEREAS, the Credit River Township Engineer has informed the City
Council that Judicial Road from 185th St. to 205th St. has deteriorated in that visible
forms of pavement damage are present including, but are not limited to, pothole
development, shoulder damage, rutting and bituminous load cracking and such
deterioration will continue unless weight restrictions are imposed upon said roadway;
and
WHEREAS, the .City Council desires to prevent further deterioration of Judicial
Road from 185th St. to 205th St. and agrees with the Engineer's recommendation that a
5 ton weight restriction be imposed.
NOW THEREFORE, BE IT RESOLVED BY THE LAKEVILLE CITY COUNCIL,
DAKOTA COUNTY, MINNESOTA:
1. That Judicial Road from 185th St. to 205th St. given its current level of
deterioration shall now be designated and posted as a 5 ton road. As such, the
weight on any single axle shall not exceed five tons on Judicial Road from
185th St. to 205th St.
2. The 5 ton weight restriction shall not apply to those vehicles identified in
Minn. Statute 169.87, Subd. 3 through 6. However, said vehicles shall
comply in all other respects with their respective portions of Minn. Statute
169.87, Subd. 3 through 6.

3. The Director of Operations and Maintenance .shall cause to be erected and
maintained signs that plainly indicate the prohibition or restriction at each
end of Judicial Road from 185th St. to 205th St. advising the traveling public of
the 5 ton weight restriction.
4. The City Engineer is directed to inform the Credit River Town Board of the
City's Council's adoption of this Resolution.
ADOPTED this 16th day of June, 2008 by the City Council of the City of Lakeville,
Minnesota.
