Punning Commission Work Session

The Planning Commission work session commenced at 6:30 p.m. in the Marion Conference
Room at City Hall.
Commissioners Present: Chair Drotning, Glad, Grenz, Lillehei, Manikowski, Pattee, and
ex-officio Bussler.
.Staff Present: Planning Director Daryl Morey and. Assistant City Engineer Jay Rubash.
Also Present: Doug and Karla Pietsch, -12299 Lucerne Trail
Unsewered Lot Area Exceptions
Mr. Morey summarized the discussion sewered lot area exceptions for wetlands, steep
slopes, etc. from the May 1St Planning Commission work session. He stated that Planning
Department staff has prepared a draft amendment to Chapter 11-17-21 Of the Zoning Ordinance
based upon the Planning Commission's direction from the May 1St work session when the
Planning Commission agreed to consider exceptions to the lot area definition for Unsewered lots
incorporating the following provisions:
• Each parcel must be at least 10 acres in area with a minimum contiguous buildable lot
area of at least 2%2 acres excluding wetlands, water bodies, road rights-of-way, steep
slopes, etc.
• .The properties must meet the plumbing code and State requirements for private sewer
systems.
• A ghost plat must be provided by the property owner taking into consideration the future
street right-of-way, wetland and wetland buffer area that would be dedicated/deeded to
the City if/when the property is platted.
The Planning Commission's discussion centered on whether 2%2 acres is an appropriate. size for
the buildable lot area, whether or not the 2'/2 acres should be contiguous, and what should
constitute the contiguous buildable area.
Staff stated that the intent of the Zoning Ordinance amendment would be to retain the rural
character of the Unsewered areas of the city and to allow the subdivision of Unsewered parcels
greater than 20 acres (with wetlands) while minimizing problems with subdividing the property in
the future when City sanitary sewer will likely be available.
In addition, staff expressed concerns about the ability to extend City sanitary sewer and water
services to previously Unsewered areas (i.e. Appaloosa Farms) if one or more of the Unsewered
parcels in an area cannot subdivide in the future to help pay the cost of the assessment
associated with the public improvement project dui to the lack of a substantial, and regular
shaped, contiguous buildable lot area..

A majority of the Planning Commission concurred. that a narrow strip of the parent parcel under
a roadway easement should not be used to connect two larger buildable areas on an
unsewered lot in order to achieve the minimum 2%2 acres of contiguous buildable lot area due to
the concerns expressed by staff.
The Planning Commission directed staff to set a public hearing on July 17, 2008 for an
amendment to Chapter 11-17-21 of the Zoning Ordinance. as presented.
