DAKOTA, COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 11 OF THE LAKEVILLE CITY CODE CONCERNING SIGNS THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: SECTION 1. Title 11-2-3 of the.. Lakeville City Code is amended by adding the following definitions: Dynamic Display: Any characteristics of a sign that appear to have movement. or.that appear to change,.. caused by any method .other than physically removing and replacing the sign or its components, whether the apparent movement or change is in the display, the sign structure or any other component of the sign. This includes displays. that incorporate technology or methods allowing the sign face to change the image without having to physically or mechanically replace. the sign face or its components as well as any rotating, revolving, moving, flashing, blinking or animated display and any display that .incorporates rotating panels, LED lights manipulated through digital input, digital ink or any other method or technology that allows the sign face to present a series of images or displays, SECTION 2. Section 11-23-7 of the Zoning Ordinance (Signs -Permit Not Required) is hereby amended to include the following provisions: G. Sandwich board signs are allowed within commercial zoning districts, provided that:: 1 1. Not more than one (1) sign is allowed per principal building except that one (1) sign is allowed per tenant within a principal building having two (2) or more tenants each with an exclusive exterior entrance. 2. The sign shall only be displayed when the business is open to the-public. 3. The sign shall be placed only 'on the business property and shall not encroach into any principal building setback, except within the C-CBD District where the sign may be located upon public sidewalks directly abutting tine business property or wit:nin required principal building setbacks, and not placed on any vehicle. 4. The signs shall be located. so as to maintain a minimum five (5) foot pedestrian walkway and so as not to obstruct vehicular traffic. 5. The sign shall be setback a minimum of two (2) feet from the back of curb of a public street or private drive aisle. 6. The sign shall conform to the following maximum dimensions: a. Height: four (4) feet. b. Width: three (3) feet. 7. For signs within the C-CBD District to be located upon the sidewalk or boulevard portion of a public right-of- way, issuance of a sign permit in accordance with Section 11-23-5 of this Title. shall be .required annually. a.' In addition to the provisions of .Section 11-23-5.C of this Title, the owner of the sign shall provide a certificate of general liability insurance with minimum coverage of $300,000 naming the 2 City as anadditional insured for the sign to be located upon the .public right-of-way within the C- CBD District. SECTION 3. Section 11-23-15.H of the Zoning. Ordinance (Signs - GeneraleRegulations) is hereby amended to read as follows: H. Temporary signs: The .use of banners, pennants and similar devices shad require. a permit valid. for no more than ten (10) consecutive days. No more than three (3) permits per business shall be granted during any twelve (12) month period. The area of a banner, pennant or similar devise shall not exceed. the area allowances for the specific zoning district in which the .sign is located.. Not more than one (1).banner, pennant or similar device shall. be displayed upona property at any one time. SECTION 4. Section 11-23-17 of the Zoning Ordinance (Signs - Prohibited Signs) is hereby amended to include the following provisions: 11-23-17: PROHIBITED SLGNS: The following signs are. prohibited: A. Any sign, signal, marking or device which purports to be or is an imitation of or resembles any official traffic control device or railroad sign or signal, or emergency vehicle signs, or which attempts to direct the movement of traffic or which hides from view or interferes with the effectiveness of any official-traffic-control device or any railroad sign. or signal. B. All signs over six hundred (600) square. feet in area, except .within the P/OS District. C. All off-premises signs greater than. six (6) square feet in area except as allowed by Section 11-23-15.M and Section 11-23-15.Y of this Title. D. Balloon signs. 3 E. Changeable copy signs, electronic. F. Content classified as "obscene" as defined by .Minnesota Statutes section 617.241. G. .Dynamic display signs. H. Electronic graphic display signs. I. Flashing signs.. J. Multi-vision signs. K. Portable signs. L. xoof signs.. M. Rotating signs.. N. Shimmering signs. 0. Signs painted, attached or in .any other manner affixed to trees or similar natural surfaces, or attached to utility poles, bridges, towers, or similar public structures. P. Video display signs. SECTION 5. Section 11-23-19.E.3.a.2 of the Zoning Ordinance (Signs - District Regulations) is hereby amended to read as follows: 2. In the case of a single occupancy. building or .single tenant space with a gross floor area of 45,000 square feet or larger, additional secondary wall signs shall be allowed on one (1) facade fronting a public street. SECTION 6. Section 11-23-19.E.3.a of the Zoning Ordinance (Signs - District Regulations) is hereby amended to add the following provision: 3. Within the C-CBD District, one (1) additional sign shall be allowed to be displayed on a side or rear wall of a 4 building, which may or may not front a public street. SECTION 7, Section 1'I-23-19.G.3.a.2 of the Zoning Ordinance (Signs - District Regulations) is hereby amended to read as follows: 2. In the case of a single occupancy building or single tenant space with a.gross floor area of 45,000 square feet or larger, additional secondary wall. signs .shall be allowed on one (1) facade fronting..a public street. SECTION 8. .Section 11-23-19.H of the Zoning Ordinance (Signs - District Regulations) is hereby amended to include the following provisions: H. Within the P/OS District the following additional regulations shall apply: 1. Freestanding Sign. One (1) sign is allowed per lot. The area of a freestanding sign may not .exceed one hundred (100) square feet each side with a maximum height of twenty (20) feet. 2. Wall, Canopy, or Marquee Signs.. For single occupancy buildings, not more than one (1) .wall, canopy, or marquee signs shall be .permitted on one (1) facade fronting a public street, except in the case of a corner lot or through lot where wall signs may be..installed on two (2) facades .fronting a public street. Thearea of individual .signs shall not be limited. 3. Changeable Copy Signs: In addition to the sign allowed by Section 11-23-19.H.1 of .this. Title, one (1) changeable copy sign (but not including electronic changeable copy signs} shall be allowed per frontage to a major collector or arterial street provided-that the area of the sign not exceed forty (40) square feet fora freestanding or wall sign. 5 SECTION 9. This ordinance shall be effective. immediately upon its passage and publication and shall apply to all sign permits applied for or pending prior to its enactment. The ordinance revisions, which include adding portable and balloon signs to the list of prohibited signs and creat- ing provisions for the allowance of sand- wich board signs in commercial zoning districts, are contained in the following sections: 11-2-3: Definitions 11-23-7: Permit Not Required 11-23-15: General Regulations 11-23-17: Prohibited Signs 11-23-19: District Regulations A printed copy of the entire ordinance is available for inspection by any person dur- ing the City Clerk's regular office hours.
