CITY OF LAKEVILLE
DAKOTA COUNTY, MINNESOTA
AN ORDINANCE AMENDING TITLE 8 OF THE
LAKEVILLE CITY CODE TO ADOPT
THE MINNESOTA FIRE CODE
THE CITY COUNCIL OF THE. CITY OF LAKEVILLE ORDAINS:
SECTION L .Title 8 of the Lakeville City Code is hereby amended to provide as follows:
CHAPTER 4
FIRE PREVENTION CODE
8-4-1 STATE FIRE CODE:
A. The city incorporates by reference the Minnesota. State Fire Code
as established in Chapter 7511 of the Minnesota Rules, one (1)
copy of which is on file with. the office of the Lakeville Fire
Chief. Every provision contained in the Minnesota State Fire
Code, except as modified or amended by this Chapter, is hereby
adopted and made a part of this Section as if fully set forth
herein.
B. Wherever the word "jurisdiction" is .used in the Minnesota Fire
Code, it shall be held to mean the City of Lakeville.
C. The Fire Chief serving the city, or his. representative as
authorized by the city administrator, shall enforce the provisions
of this section.
D. A permit required by the Minnesota Fire Code may be obtained
by submission of an application to the Lakeville Fire Chief along
with any fee established by the city council from time to time.
E. Fires or Barbeques on Balconies or Patios
1. Open Flame Prohibited. In any structure containing three or
more dwelling units that have a common hallway and/or a shared means of
egress, no person shall kindle, maintain, or cause any. fire or open flame on
any balcony above ground level,. or on any ground floor patio within 15 feet of
a structure.
2. Fuel Storage Prohibited. No person shall store or use any fuel,
barbeque, torch, or other similar heating or lighting chemical or device in the
locations designated in Section EL
3. Exception: Listed electric or gas-fired barbeque grills that are
permanently mounted and wired or plumbed to the building's gas supply or
electrical system and that. maintains a minimum clearance of 18 inches on all
sides, unless listed for lesser clearances, may be installed on balconies and
patios when approved by -the Fire Chief.
SECTION 2. This ordinance shall be effective immediately upon its passage.
ADOPTED this 15th day of October , 2007, by the City.Council of the City of
Lakeville, Minnesota.
