CITY OF LAKEVILLE
DAKOTA, COUNTY, MINNESOTA
AN ORDINANCE AMENDING TITLE 10 OF THE
LAKEVILLE CITY CODE, THE SUBDIVISION ORDINANCE
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 10-1-6 of the Lakeville City Code is amended by adding the
following definition:
Buildable Land:. All land except wetlands, public waters, "major drainageways" as
defined in the City's Comprehensive Plan,. and land dedicated for
County roads.
SECTION 2. Section 10-4-8, paragraphs A, E, I and J, of the Lakeville City Code are
amended to read as follows:
A. As a condition of subdivision approval; subdividers shall dedicate a reasonable
portion of the buildable land in the proposed subdivision for conservation
purposes or for public use as parks, recreational facilities as defined and outlined
in Minnesota Statutes Seciton 471.191, playgrounds, trails, wetlands, or open
space; provided that the City may choose to accept an equivalent amount in cash
for part or all of the poirtion required to be dedicated based on the fair market
value of the land at the time of final approval.
E. When a proposed park, playground, recreation area or other public ground has
been indicated in the City's official map or comprehensive plan and is located in
whole or in part within a proposed subdivision, it shall be conveyed to the City. If
the subdivider elects not to dedicate an area in excess of the land required
hereunder for such proposed public site, the City may consider acquiring the site
through purchase or condemnation.
L In residential subdivisions where a land dedication is required; the. following
formula will be used to determine the dedication requirement:
Land Dedication Percentage
Density Units Per Acre Based Upon Buildable Land
0 - 2.5 10 percent
2.5 - 4 11 percent
4+ - 6 13 percent

6+ - 8 15 percent
8+ - 10 17 percent
10+ 17 percent - 20 percent
In commercial or industrial subdivisions. where a land dedication is required the
following formula wil be used to determine the dedication: five percent (5%) of
the buildable land being subdivided.
J. In lieu of land dedication the City may required the following cash contribution:
2007 2008
Commercial $7,058 $7,693 per acre
Industrial $4,182 $4,558 per acre
Multi-family dwelling units $3,810 $4,153 per dwelling unit
Single-family dwelling units $4,355 $4,747 per dwelling unit
SECTION 3. This ordinance shall be effective immediately upon its .passage and
publication.
ADOPTED this 20th day of February , 2007, by the City. Council of the City of
Lakeville, Minnesota.

THE CITY COUNCIL OF -THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
