CITY OF LAKEVILLE
DAKOTA COUNTY, .MINNESOTA
AN ORDINANCE ESTABLISHING A PUD, PLANNED UNIT DEVELOPMENT
DISTRICT FOR HERITAGE COMMONS.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS:
Section 4. Legal Description. The legal description of the property
included in the PUD District shall be as follows:
See attached Exhibit A
Section 2. Zoning Map Amendment. The property is hereby rezoned
from C-3, General Commercial. District to PUD, Planned Unit Development
.District subject to the terms and conditions set forth herein.
Section 3. Allowed Uses. The allowed uses within the PUD District
shall include all. permitted uses, permitted accessory uses, conditional uses,
interim uses and uses allowed by administrative permit within the C-3 District
subject to approval of a Development Stage Plan in accordance with Section 11-
96-5 of the Zoning Ordinance, except:
A. Motor fuel facilities shall be allowed within the PUD District only as
an accessory use on Lot 1, Block 1, Heritage Commons 3~a
Addition.
Section 4. Lot Requirements.. Lot requirements within the PUD District
shall be as established for the C-3 District except as may be modified by
approval of a Development Stage Plan in accordance with Section 11-96-6 of the
Zoning Ordinance.
Section 5. Setback and Building Height Requirements. The setback
and building height requirements within the PUD District shall the be same as
applicable to the C-3 District except as may be modified by approval of a
Development Stage Plan in accordance with Section 11-96-7 of the Zoning
Ordinance.

Section 6. Building Type and Construction. Buildings within the PUD
District shall be conform to the minimum requirements specified by Section 11-
17-9.A of the Zoning Ordinance applicable to structures within the C-3 District
and the Heritage Commons Town Square Design Standards as required by
Section 11-17-9.A.3.a.(1) of the Zoning Ordinance except as may be modified by
approval of a Development Stage Plan in accordance with .the criteria. established
by Section 11-17-9.D of the Zoning Ordinance..
Section 7. Other Provisions. The following additional allowances,
standards or restrictions shall apply within the PUD District:
1. Mid-block access points to Heritage Drive- shown for the potential
development scenario south of Heritage Drive, east of Dodd Boulevard,
north of 202"d Street and west of Iberia Avenue are subject to further
review at the time of final plat approval based. on the traffic generated by
the uses to be developed.
2. The tenant signage on the clock tower monument at the corner of Dodd
Boulevard and 202"d Street shall be limited to 231 square feet on two
sides. In addition to the tenant signage, the clock tower shall .identify
"Heritage Commons" above the tenant signage, but on all four sides.
3. The private drive connecting Idealic Avenue and Heritage Drive must be
seal coated to cover the existing parallel parking striping located on the
east side adjacent to the multi-tenant retail center constructed within
Heritage Commons 2"d Addition.. In addition, the developer must install
"No Parking" signs along both sides for the entire length of this private
drive for site circulation and traffic safety purposes.
Section 8. Future Phases and Amendments. Approval of PUD
Development Stage Plans for land included within the PUD District, modifications
of performance standards established by the PUD District or this Ordinance and
the inclusion of additional lands within this PUD District shall be processed in
accordance with Section 11-96-21 of the Zoning Ordinance.
Section 9. Zoning Map. The zoning map of the City of Lakeville shall not
be republished to show the aforesaid rezoning,. but -the City Clerk shall
appropriately mark the zoning map on file in the City Clerk's office for the
purpose of indicating the rezoning hereinabove provided for in this Ordinance,
and all of the notations, references and other information shown thereon are
hereby incorporated by reference and made part of this Ordinance.

Section 10. Effective Date. This Ordinance shall be effective upon its
passage and publication.
