CITY OF LAKEVILLE COUNCIL MEETING ~Y 7, 1975 The meeting was called to order by Mayor Mako at 8:00 P.M. Flag pledge followed. Present; ~atat, Brandes and Mako. Absent; Emond and Clarkson-Emond arrived at 8:50 P.M. and Clarkson arrived at 8:40 P.M. Also present; Richard Hogan, .City Administrator, Robert Frigaard and Robert Rosene, City Engineers and Roger Knutson and Pat Farrell, City Attorneys. 75.~+~+1 Motion by Brandes seconded by Zaun to accept the minutes of the June l6, 1975 meeting as presented. 'Zaun, Brander and Mako "aye", motion carried. 75.~+~+2 Motion by Brander seconded by Zaun to accept the minutes of the June 23, 1975 meeting as presented. Brander, Mako and Zaun "aye", motion carried. 75.~+~+3 Motion by Brander seconded by Zaun to accept the minutes of the Board of Equalization meeting of June 2~F, 1975 as corrected. Zaun, Brander and Mako "aye", motion carried. Mr. Farrell said that he would like to meet separately with the .Council. to discuss the transit tax. He advised the Council that he would. like to have a check made out to Harold & Audrey Ratzlaff fora permanent and construction easement. 75.~+~+~+ Motion by Brander seconded by Zaun to authorize the payment of $700 to Harold & Audrey Ratzlaff for a permanent and temporary easement for sanitary sewer purposes, Highview to Ipava pxojeet. Brander, Mako and Zaun "aye", motion carried. Mr. Farrell also advised that he would like a check approved this evening to Joel Frank for $950 plus 6~ interest or $28.50. 75•x+'+5 Motion by Zaun seconded by Brander to approve the change order No. 1 in the amount of X1261.15 for project No. 7~-5A water and sewer extensions. Mako, Zaun and Brander "aye", motion carried. Mr. Frigaard reported on the status of the change order for Crystal Lake sewer and water extensions and also the sewer .and water extensions to Huseby Addition.. Mr. Frigaard advised the Council that he did not recommend blacktop for the Oak Shore Drive project until next year. He will check with Burnsville at this time to see if an alternative is possible at this time. 75.46 Motion by Brander seconded by Zaun to accept the preliminary report for street improvement for Oak Shore Drive. Zaun, Brander and Mako "aye", motion carried. Mr. Rosene advised the Council that there is a $x+00 deduct to omit both. names on the new water tank and that it would cost quite a bit more if done later. He said that the lettering could be done on the top of the tank and Mr. Brander asked if a magnetic north could also be painted on the top. 75•~+~+7 Motion by Mako seconded by Zaun to appoint Mr. Brander as a committee to report to the engineer as to how we want the lettering on top of the water tank. and to authorize him to make a decision. Brander, Mako and Zaun "aye", motion carried. The omission of County Road ~+6 on the Dakota County Thoroughfare Plan was discussed. 75.~+~+8 Motion by Mako seconded by Zaun to accept the plans and specs for Television Inspection and Repair of Existing Sewers and to set a bid letting date of 11:00 A. M can July 21, 1975. Mako:, Zaun and Brander "aye", motion :carried. i 75.x+49 Motion by Zaun seconded by Brander to adopt the "Resolution Establishing Certain-Development Policies in the City of Lakevilley Minnesota". Zaun, Brander and Mako "aye", motion carried. Mr. Emond arrived at 8:50 P.M. 75.x+50 Motion by Zaun seconded by Brandes to follow the reecmmendation of the Park .Recreation Committee and temporarily close the boat launch at 202nd Street and Juno Trail. Brandes, Mako'Emond, Clarkson and Zaun "aye", motion carried. 75•x+51 Motion bg Emend seconded by Brander to authorize Steve Michaud to pursue Laweon funds as per the-attached list... Mako, Emond, Clarkson,-Zaun and Brander "aye", motion carried. 75•+52 Motion by Emond seconded by Clarkson to authorize the Clerk to issue a check in the amount of X360 to George Warweg in return for the cancellation of the lease on the Taylor property. Emond, Clarkson, Zaun,, Brander and Mako "aye", motion carried. 75.53 Motion by Clarkson seconded by Zaun to follow the recommendation of the i'ark and ....Recreation Comcn~..ttee and have lights installed in Antler's Park toilet facilities ~ri:th this being paid from general suxplus funds. Clarkson, Zaun, Brandes, Mako and Emond "aye", motion carried. 75.~+5~+ Motion by Mako seconded by Zaun to follow the recommendation of the Park and Recreation. Committee and provide chemical toilets at Parkview'"and Ritter Farm Park. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. 75.x+55 -Moti©n by Mako seconded by Brander to follow the recommendation of the Planning Commission and approve a conditional use permit for the period of one year to Judith Tatge and Marvel Swenson for a~day care center located at 201st St and Kenwood Trail. Brander, Mako, Emond,'Clarkson and Zaun "aye", motion carried. Mr, Olson,who had-built an authorized fence, will meet with Mr. Zaun to see what can be worked out for a solution. It was suggested that an itemshould be placed in the newsletter.. regarding the fence .ordinance. 75.x+56 Motion by Mako<seconded by Brander to table Mr. Olson's request for a variance to the fence. ordinance until the l~+th at 8:45 P.M. with Mr. Zaunand Mr. Farrell to meet with Mr. Olson: the 10th at 3:00 P.M. Mako, E:nond, Clarkson, Zaun and Brander "aye", motion carried. 75.x+57 Motion by Emond seconded by Zaun to follow the recommendation of the Planning Commission and grant Mr. Wm. Sime a rezoning from R-1C to R-3C`for 2.65 acres" as described on the attached legal. -Emond~ Zaun, Brander and Mako "aye", Clarkson: "no", motion .carried:. 75.5$ Motion by Clarkson seconded by Mako to-table a decision on a second fire station until after the. Council meets with the Board of Directors of the Fire Department sometime during.. the wek of the l~+th'and return with this Qn the third meeting in July. Clarkson, Zaun Brander, Mako and Emond "aye", motion carried. 75.x+59 Motion by Zaun seconded 'by Brander to acknowledge receipt of.the claim against the Liquor Store from Joel Huspeni. Zaun, Brander, Mako, Emond and. Clarkson "aye", motion carried.. Mr. Robinette gave a brief resume of a report he made on the level of Lake Marion and the recommendations for emergency procedures for draining some of the water through .the existing. culvert. Mr. Farrell advised that the Council had three options: l-holding a hearing as for a public improvement project with-the costs..assessed, 2-go ahead, acquiring short term easements and turn water loose or, 3-go to property owners affected and acquire temporary: drainage easements Nand run water through the natural water course. Mr. Frigaard gave elevation data of the lake. Martha_Eriekson asked what lowering the lake would do to the water table. Mr. Farrell said that there would be about five property owners who would have to be contacted for easements..: Mrs. Curry asked what'the legal ramifications were about renewing the temporaxy .easements and was told this could be a problem.. She also felt'thatthe.City should be concerned with the long term solutions to thin. problem, ~2) t i* y CITY OF LA~VILLE COUNCIL MEETING JULY 7~ 1975 .Paul Hammer .asked if waterways between Scott County and Lakeville that are draining into Lake Marion could be closed and it was felt that this is not possible. 75.460 Motion by Mako seconded by Zaun to adopt the resolution .prepared by the attorney authorizing Mr. Farrell to meet with the affected property owners in Lake Marion Swale between the outfall pipe and to the Mpls., Northfield and Southern R. R. and to authorize the City Engineer and Public. Works Director. to begin to prepare the' necessary grading and land movement to allow this water to run. Anal further, upon the. attorney's directive: that agreements have been reached with the affected property owners, the Engineer and Public Works Director may begin as soon as possible with the necessary. work. The attorney is also authorized to make necessary application for a permit and the expenditures for this project shall be taken from the general surplus funds. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.461 Motion by Brandes seconded by Emond to adopt the " Resolution Identifying the Lake Marion Food Control and Erosion Problem and Requesting Assistance from Other Governmental Bodies.": Mako, Emond, Clarkson, Zaun and Brandes "aye", motion carried. 7.462 Motion by Emond seconded by Zaun to acknowledge receipt of the letter from Virgil Tonsager yin regard to water in the basement of his home. Emond, Clarkson, Zaun, Brandes. and Mako "aye", motion carried. 75.463 Motion by Zaun seconded by Clarkson to adopt the Open Meeting Resolution, copy attached. Clarkson, Zaun, Brandes, Mako and Emond "aye", motion carried. The space survey was discussed.. 75.464 Motion by Clarkson seconded,. by Zaun that the Planning Commission be charged with holding informal hearings on possible site locations for a new City hall and return with a recommendation to the Council b3' November 10 of this year. Mr. Hogan will assist them in this matter. Zaun, Brandes, Mako, Emond and Clarkson "aye", motion carried. 75.465 Motion by Zaun seconded by Emond to acknowledge receipt of the petition for water and sewer. extensions to Jaguar Court in Oak Hilts. Brandes, Mako, E~nond, Clarkson and Zaun "aye", motion carried. 75.466 Motion by Clarkson seconded by Zaun to authorize the engineer to investigate the extension of water and sewer to Oak Hills lst Addn with a possible lift station installed also. The Water & Sewer Committee to assist in this matter. Mako, Emond, Clarkson Zaun and Brandes "aye", motion carried. 75.467 Motion by Emond seconded by Brander to award the contracts for the fire truck as follows: 1. Town's Edge Fords chassis with a bid of $14,738,2.Akins Fire Equipment, fire equipment with a bid of $5,025.18 and 3. General Safety , fire truck body with a bid of $28,175. Emond~ Clarkson, Zaun, Brandes and Mako "aye",' motion carried. 75.468 Motion by Emond seconded by Clarkson to pay the claims against the City with the exception of 12313 and 1234+ which will be paid upon Mr. Emond's ok and to make out an additional. check for ~g78.50 to Jmel Fraxik. Clarkson, Zaun, Brandes, Mako and.E~nond "aye", Motion-carried, 75.469 Motion by Mako seconded by Zaun to extend this meeting to last no later. than 11:30 P.M. Zaun, Brandes, Mako,,and Emond "aye", Clarkson "no", motion carried. ' 75.470 Motion by Zaun seconded by Brandes to authorize the Mayor and the Clerk to execute the contract for the Orchard Gardens 4th Addition street improvements. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.471 Motion by Emond seconded by Clarkson to hire Grace Jaeger full time. in the Police Department immediately. Mako, Emond, Clarkson, Zaun and Brandes "'aye", motion carried. 75.472 Motion by Zaun seconded by Brandes to acknowledge receipt of the petition for water and sewer extensions to the proposed shopping center north of T. H. #50 and west of Holyoke Avenue. Emond, Clarkson, Zaun, Brandes and Mako "aye", motion carried. 75.473 Motion by Emond seconded by Brandes to adopt the "Resolution Confirming. Adoption of Chapter 125, Laws, 1975-An act relating to the Fire Relief Association and Firemen's Service Pensions. in the City of Lakeville". Mako, Emond, Clarkson, Zaun and Brander "aye",motion carried. 75.x+77 Motion b~ F3nond seconded by Brander to accept the plans for the street improvements, Iteri and Lake Marion, and set the bid letting date for August 1 at 11:0 A. M. Eattond Clarkson, Zaun, Brander and Mako "aye", motion carried.. 75•x+78 Motion by Mako seconded by Brandes acknowledging receipt of the-letter from Mr. Hogan-in which he states he is seeking another position and will submit a formal resignation later, Motion by Zaun seconded by Clarkson to adjourn carried unanimously.
