Present; Zaun, Brander, Mako and Clarkson. Absent; Emond. Also present; Robert Frigaard, Citq Engineer, Pat Farrell and Rtg er Snutson, City Attornegs. 75.561 Motion bq Brander seeoruied'bq Clarkson to accept the minutes. of the August 11, 1975 meeting as presented. Zaun, Brander, Mako and Clarkson "aqe", motion carried. 75.562 Lotion bq Brandea seconded bq Zaun to paq the claims against .the City including the add ons. Brander, Mako, Clarkson and Zaun "aqe", motion carried. 75.563 Motion by Brander seconded bg Clarkson to pay the claims against the Liquor Store including the add ons. Mako, Clarkson, Zaun and Brander "aqe", motion carried. 75.56+ Motion by Mako seconded bq Brander to approve Change Order No. 1, deduct of ~~FOC,from the water reservoir contract. Claxkaon, Zaun, Brander and Mako "aqe", motion carried. 75.565 Motion by Mako seconded bg Zaun to approve Change lJrder No. 1 in the amount of $15,8+5.00 to the Dakota Heights water and sewer extension contract for adding. South Oak Shore Drive to the project. Zaun, Brander, Mako and Clarkson "aqe"', motion carried. Mr. Frigaard reported that roil borings_ had been made of Bassett's Road and that he would recommend the City install crushed rock in lieu of gravel. The additional expenditure would be approximatelq $3otx~. 75.5 Motion bq Zaun seconded bq Brander to follow the recomoaendation of the engineer and authorize the use of`crushcd rock 3.n lieu of gravel on Bassett's road. Brander, Mako, Clarkson and Zaun "aye"~ motion carried. 75.567 Motion bq Zaun seconded bq Braudes to authorize the execution of the Lake Marion street project. Mako, Clarkson, Zaun and Brander-"aqe", motion carried. 75.568 Motion by Clarkson seconded bq Brander to place the Justice of the Peace office on the November election ballot with the correct number to be elected checked out bq the attorney. Clarkson, Zaun, Brander and Mako "aqe", motion carried. 75.569 Motion by Clarkson seconded bq Zaun to adopt the proposed fee schedule as presented but change the fee for sewer pumping permit to N/C. A copy of the fee .schedule is on file and available at the Citq Hall. Zaun, Brander, Malmo and Clarkson "aqe", motion carried. 75.570 Motion bq Clarkson seconded bq Brander to authorize the Magor and the Clerk to sign the addendum to the Grohoski contract extension as prepared bq the attorney. Brander,. Mako, Clarkson and Zaun "aye"~ motion carried. The PUB amendment to the Zoning Ordinance was reviewed. The attorneq recommended no changes be made. 75.571. Motion bg Brander seconded bq Zaun t'.o adopt Ordinance 8~+, AN GRDIl1~APiCE AMENDING ORUIl~ANCE Nfl. ~F2, BEING THE Z©NING ORD:II~ANCE OF '.i'HE CITY QF L'VILLE. Ma,ko, Clarkson, Zaun and Brander "aye", motion carried... 75.572 Motion by Zaun seconded by Clarkson to adopt the resolution accepting the water and newer liner in. Lakeridge Addition. Zaun, Braa~,des and Mako "age", Claxkscm "no", motion carried. Mr. Frigaard advised the Council that if the new contractor for the.,Woaciburq Addition pro~eet would guarantee the regrading and regeeding along Highv~;ew Avenue, that the Citq could consider forgetting the liquidation damager. 75.573 Motion by Zaun seconded bq Brander to authorize the Magor and the Clerk to execute the :agreement with the bonding company for completion of the work in Woodbury Addition which was to be done by Long Lake Construction Go. rub~ect to the following conditions: 1. the work being completed by Nov. 1, 1975 and 2. the slope along Highview Avenue being regraded and reseeded at no cost to the Citq. Zaun, Brander, Mako and Clarkson "aqe",.motion carried. ~l) CITY CF L~LLE COUNCIL...MEETING AUGUST 18,,1975 75.57+ Motion by Mako seconded by Zaun to a11ow the use of the sewer lines south of Orchard Trail on Jonquil to manhole 22. 75.575 Motion by Brander seconded by Zaun to amend the shone action to read as follows:.... allow the .use of the lines sub3eet to the followingconditioaass 1. a~+"and all pining should be done at the expense of the developer and done under the direction of the City, and. 2. G ~ G Builders agree to indemnify the City for anyy costs that might arise or accrue from the use of this line. Brander, Mako, aIId Zaut1 payee, Clarkson °no", aa~ticm carried. Vote was then taken on motion no. 57.57 which is as follows: Mako, Zaun and Brander "aye",.Clarkson "no", motion. carried. The Jackson Heights, Lakeville Hills storm sewer heax~i.ng was continued at 9:40 P.M. A lint of interested persrms present is attached to these minutes.. Mr. Frigaarci reviewed the prelimix~azy report. He stated. that the plena and specs for the sewer and water to orchard Lake would be presented at the next meeting. and he would recoaaarend that if this pro3ect is ordered, it should be included in these plans. Greg Johnson. asked if the estimates for the water and sewer were still the same and was told yes. James Firm asked-when bids. would be taken and was told in September with a ~,d. completion date of approximately August 1, 1976. Don Bergstroan asked if there would be any problem with the hookups if these lines are i.n the same ditch and was told: this would be no prcblean, Bi11 Ridgeway of Jackson Heights naked 3f something can be done about-the ..water problem until the...atorm sewers are installed. Mr. Frigaard advised that this project could be done first but that he would not like to see the streets torn upthswinter. Joyce.Strege'askect if this problem could pare been averted with mare strict inspection in this area and has anything been done to cut out this sort>of problem....... Kenneth Stair asked why Mr. Krause is not forced to pay far this and was told that a proportionate share of this pro~jeet would be charged beck to that addition. James Firm asked if a .firm figure could be giveaa before next _fall. Stan Kraaa~er asked. why this pro~eethadnot been started last spring and what will .keep mud from flowing into the lake. The hearing was closed at 9:3o P.M. 75.576 Motion: by Mako seconded by Zaun to order this storm sewer pxw,ject for Lakeville.: Hills, Jackson. Heights and Jackson Heights 2nd Additions: and authorise the engineer to prepare the plans and epees. .Clarks©n, Zaun, Brander anci Mako "aye", motion carried. The conti.riued hearing for the Oak Shore Drive street improvement was opened. A list of interested persons present is attached-- to these minutes.. Mr. Frigaard`review~ed the report and said that the price far the B 618 curb would. be approximately ~1~95, the .surmountable concrete curb would 'be an estimated 30¢ a foot cheaper and for the bituminous shoe ford curb the cost would be approximately ~11C5 per to Dennis Getzell of South Oak Shore asked/is small portion of street is included. He was advised. that it was not but could be included by a change .order if all the homeowners would. sign the petition for i.nelusi.on. Glen Kirkeby did not feel the extra expense of a concrete curbwas`warranted. Dick McCoullogh said he would .like to see the ~urfac~.put down before winter. Tom.LeJeune said he would like to see the curb and mat installed this year. ,Walt Lundeen felt. that the continuity would be carried out with the installation of a concrete curb. Steve VanSlyke said he would be happy with a shoe formed curb but would like to see the 'mat installed before winter. The hearing was closed at 9:~+5:P.M. Mr.'Mako said that a concrete curb would:. make more sense than a shoe formed curb due to the durability of concrete. 75.577 Motion by Brander;seconded by Clarkson to follow the recoa~mnendation,of the engineer and order the street-improvements for Oak. Zaun, Standee, Mako and Clarkson "aye", motion carried. 75.578 Motion by Zaun seconded by Mako to accept the plans and specs for the Oak Shore Drive street improvement and'to set a bid letting date for September l2, at Il:OO A. M. Standee, Mako, Clarkson and Zaun "aye", motion carried. There was a four minute break. The Mobile Home Ordinance was read for the second time. . Claxksbn felt the number of gears should be extended. Mr. Walt Sternberg said he was concerned about the broadness of this ordinance. 75.579 Motion by Mako seconded by Zaun to adopt Ordinance No. 85, AN ORDINANCE AMENDING NO. ~F2, WHICH IS THE.ZONING ORDINANCE, ETC. regatdi.ng mobile homes,as recorsaended by the Planning Commission with one. exception, to change the number of years to ten years. Clarkson, Zaun, Brandes and Mako "aye",.motion carried. 75.580 Motion by Clarkson seconded by Zaun to amend the above motion to read under See. ~F-ten years from the ne~'c renewal. date. Malco, Clarkson and Zaun "aye", Brander "no", motion carried. John Waters asked if this would not be the taking of property rights from these individuals. The Redevelopment Act was discuss~sd. .75.581 Motion bey Clarkson seconded by Brander to authorize the Mayor to contact Mr. Pinscher to give a report on the tax increment bonds as they relate to the Lakeville Central .Business District. Clarkson, Zaun, Brander and Mako "dye", motion carried. 75.5$ Motion by Ma3to seconded by Clarkson to adopt the resolution approving the cooperative purchasing agreement between the City of Lakeville and the State of Minnesota. Zaun, Brander, Mako and Clarkson "aye",.motion parried. 75.5$3 Motion by Zaun seconded by Brander to follow the recommendation of .the administrator to advertise the health insurance for bids and .include the Dakota County Tribune for advertising. Brander, Mako, Clarkson and Zaun "aye", oration carried. Glenn Nord and Tom Farber were present to discuss the street improvement request for ..the common road to the maintenance building. Mr. Farber and Mr. Hawthorne would donate the easement needed to make thin a legal road and said that they would like the City to participate in the blacktoppiag of the road. Their estimate for'the cost was ~~F64O. 75.58 Motion by Clarkson seconded by Zaun to instruct the engineer to furnish a cost estimate to make this a nine ton,blacktopped road. Mako, Clarkson, Zaun and Brander "aye", motion carried. There will be further negotiations between the concerned parties. 75.585 Motion by Mako seconded by Clarkson to authorize the attorney to negotiate with the concerned parties regarding this common road. Clarkson, Zaun, Brander and Mako "aye", motion carried. 75.586 Motion by Mako seconded by Brax~des to extend this meeting until 112OP. M. Zaun, Bran~eies~ Mako and Clarkson "aye"~ motion carried. 75.587 Motion by Brander seconded by Clarkson to adopt the resolution for interim procedures for overall city planning coordination in re the Planning Consultant with the committees strictly on an hourly basis.
