L A t CITY OF LAKE{TILLE ASSESSN~+TT HEARING N~VII~Eft 12, 1975 The meeting was called to order by Mayor Mako at 7:1C P.M. Flag pledge followed. Present; Clarkson, Zaun, Brander, Mako and Emond. Also present; Patrick McGarvey, City Administrator, Roger 8rtutson and Pat e Farrell, City Attorneys and Robert Rosene, Robert Frigaard, City Engineers. The hsaessment hearing on the Dakota Heights and Cak Hills sewer and water was opened. Mr. Frigaard reviewed the project and total .project cost. A list of interested persons present is attached. George Stannard asked what the services were and it was explained that this is the charge for bringing the sewer and water from the main. line to the property line. Bob. Nelson asked if the restoration included the boulevard area and was told yes. He also asked if everything would be taken care of before the project is accepted. Mr. Frigaard assured hix~ it would be. Allen Larson asked what the time limit is for the hookup to water and sewer and was told it is two years from the time each homeowner can utilize the line. Robert Clark asked if he could stub in the water and sewer lines and not use the water. He was advised that this is not recommended as the City loses.::: control. Mr. Nelson asked if his corner assessment is the same as other property owners and was told that this had: been assess.ed_ at a unit price. 75.765 Motion by Clarkson seconded by Emond to-close the hearing on the assessments for the Dakota Heights arty oak Hills wa er and sewer. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. 75..766 Motion by Clarkson seconded by Zaun to dopt the resolution establishing the assessment rolls for the Dakota Heights and Oak Hills water and sewer.. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. The North Lake Marion area assessment hearing was opened. Mr. Frigaard reviewed the costs for t11is project. A list is also attached with the natr~s of interested property owners present for this hearing. E11a Folkrod asked why her property could be considered benefitted and objected to the cost of this project as she. has five acres and did not see how she could pay for this. The oversized trunk charge was explained tej her. Mr. Bassett asked if the restoration included the road in the 2nd. Addition and was told it did not. Ron Ley asked how many acres this project was assessed over. He felt that the developments were not paying their fair share for the cost of the project. John Clark asked if the area charge was for sewer and. water and was told it is only for sewer. Chester Fo].krod asked how long it would take to get water and sewer after a petition is subaai.tted. Mr. Bassett felt his assessment is tc>o high as this is not a buildable lot. Mr. Farrelladvised that the Council could take the request under advisement or the matter could be appealed to the. district court. Mike Danaher who lives adjacent. to the Bassett property also felt his assessment was too high in view of the fact he does not intend to develop his land. The property owners were advised they had twenty days to discuss these matters with the engineer and attorney. Harry Charnstrom asked if all the trunk lines are finished in this area. 75.767 Motion by Brander seconded by Emond to close the assessment hearing for the North Lake Marion Area. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. .75.768 Motion by Emond seconded by Clarkson to adopt the resolution establishing the assessment rolls for the North Lake Marion trunks and water axtd sewer laterals. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. The assessment hearing on the West Valley Park Tz*urtk Extensions was opened. The engineer reviewed the costs for this project. A list of interested property owners .present is attached to these minutes. ~1) CITY OF LAKL'VILLE ASSESSMENT HEARING ~ 12, 1975 Bill Studer asked how the drainage area is decided and said he did not feel his: land .would. drain except i,n a southerly direction. Lawrence feller asked where the X254 charge came from and if all his land is assessed. Robert Moreland asked what the interest was and. for how mater years. He also asked who pays~for this if the land is iri green acres. It was explained the development is paying for this now and that the costs are projected by various methods. Clint Zweber asked if the property owners were advised ar to how many acres were included for these assessments. Kathleen Zweber felt that this matter should have been discussed with the property owner. Mr. Frigaard said the drainage was decided by the use of aerial maps. 75.769 .Motion by Zaun seconded by Clarkson to close the hearing on the assessments. for the West Valley Park Trunk Extensions. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. 75.770 Motion by Clarkson seconded by Brander to adopt the resolution establishing the assessment rolls for the West Valley Park Trunk Extensions. Clarkson, Zaun, Brander, Mako and Emcand "aye", motion carried. The .hearing for the Fake Marion Street Improvement assessments was opened. Mr. Frigaard reviewed the costs and a list of interested property owners is atta.ehed to 'these minutes. Mr. Frigaard explained that this was assessed on a unit basis. George Warweg asked if some lots he owned which did not have sewer and water but. the street had been installed would be eligible for building permits. He was advised that he would have to follow the ordinances. 75.771 Motion by Emond seconded by Clarkson to close the. assessment hearing for the .street improvement to Lake Marion Area. Zaun, Brander, Matzo, Emond and Clarkson "aye", motion carried. 75.772 Motion by Emond seconded by Zaun to adopt the resolution establishing the assessment= rolls for the Lake Marion Area street improvements.. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. The assessment hearing for the Highview Avenue Street Improvement: was opened. A list of`.~z~~rested property owners present is attached. Mr. Frigaard gave a short review of the costs. Clinton Zweber asked what type of road this is and felt that it should not be charged only to the adjacent property owners as it is used as a Bask to the rest of the area. It was explained that this road would be designated as a state aid road and as soon as funds were. available it would be blacktopped. Mr. Studer did not feel this road should have"been opened up for the deve~.~pers and also objected to the development of the Woodbury Addition due to the high water table there. 75.773 Motion by Brander seconded by Clarkson to close the .assessment hearing on the Highview Avenue. Street improvement. Mako, Emond,'`'Clarkson, Zaun and Brander "aye':, motion carried. 75.77 Motion by Brander seconded by Mako to adopt the resolution establishing the assessment rolls for the Highview Avenue Street improvement. Emond, Clarkson, Zaun, Brander and Mako "aye",.motion carried. .The assessment hearing for the Iteri Avenue Street improvement was opened. Mr. Farrell advised the Council to continue this hearing until the first meeting .n December due to the late date of rending the notices of hearing. Pat Harvey said that he did not feel that the contractor had done a first rate job on this project. Be said the approaches. to his driveway were not satisfactory. Mr. Harvey was advised to meet with Mr. Rosene to work out.. this problem. Other property owners were advised to advise the engineer of their problems and they could be resolved. 75.775 .Motion by Zaun seconded by Mako to continue the assessment hearing for the Iteri Street Improvement until the first meeting in December. Zaun, Brander, Mako, Emond and' Clarkson "aye", motion Carrie d'. 75.777 Motion by Zaun seconded by Emond to adopt the resc~lutien establishing the assessment r411s for the Orchard Gardens ~#th Addition Street improvement. Brander, Mako, Emond Clarkson and 2aun "ayeTM motion carried. The hearing. for the assessments on the Woodbury-1st Addition-was opened. 1~. Frigaard reviewed the costs.. No interested persons veers present for thie hearing. ?5.778 .Motion by Emond seconded by Zaun to close the assessment hearing for the Woodbury 1st Addition sewer and water extensions. Mako, Er~ond, C~rkson,, Zaun and Brander "aye", motion carried. 75.779 Motion by Emond seconded by Clarkson to adopt the resolution establishing the assessment rolls,forthe Woodbury lst Addition water and sewer`.extensions.
