Present; Clarkson, Zaun, Brandes, Mako and r'cnond. Also present; Robert Pinscher, Financial Consultant, Patrick McGarvey, City Administrator and Pat Farrell, City Attorney. Mr. Pinscher presented three bids on the X1,560,000 bond sale,whieh were then opened; and read. He recommended that the bid be awarded to the low bidder. .75.781 Motion. by Emond se Bonded by Brandes to accept the bids on the $1,560,000 bond issue.. Clarkson, Zaun, Brandes, Mako and Emond "aye", motion carried. ..75.782 Motion by Emond seconded by Brandes to award the bond issue. to the low bidder. .Allison-Williams, whose net interest dollar cost is $~1,226,08~+.78 and with a net interest rate of 6.7776. Clarkson, Zaun, Brander, Mako and Emond. Also prese~at: Robert Rosene, City Engineer, Pat Farrell, City Attorney and Patrick McGarvey, City Administrator. 75.783 .Motion by Brander seconded by Zaun to accept the minutes of the November 12, 1975 meeting as presented. Clarkson, Zaun., Brander, Mako and Emond "aye", motion. carried. 75.784 .Motion by Emond seconded by Clarkson to acept theminutes of the Special November 12,.1975 meeting as presented. Zaun, Brander, Mako, Emond and Clarkson. "aye", motion .carried. 75.785 Motion by Clarkson seconded by Zaun to pay the claims against the City with the exception of 13116. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.786 Motion by Emond seconded by Brander to pay the claims against the Liquor Store. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. Mr. Farrell reported on the following matters: the deed to the Sauser property and what the Council's directive would be in renting out this property, a notice of intent to arbitrate the claim regarding the Clay's Acres street, a petition that had been received regarding sewer and water to Dakota Heights 7th Addition. .75.787 Motion by Eanond seconded by Clarkson to .acknowledge the receipt of .the petition for sewer and water laterals to the first phase of Dakota Heights... 7th Addi:~tion. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. 75.788 Motion by Clarkson seconded by Brander to authorize the engineer to prepare the plans and specs for sewer and water laterals to Dakota Heights 7th Addition and to add this tosthe 75..3 project. Clarkson, Zaun, Brander, Mak© and Emond "aye", motion carried. Mr. Rosene reported that he had .met with wo property owners regarding their sewer assessments and would refer them to the assessment review co~mnittee. Mr. Zaun will have a recommendation regarding the home occupation ordinance by December 15th. Mr. Joe Schweich appeared before the Council with his proposed replatting of land he owns north of Lake Marion. The Council approved of this concept and told him_he would now have to proceed according to City ordinance. Mr. Fred Fredrickson explained to the Council and interested home owners from Oak Shores 2nd Addition why the Water & Sewer Committee had voted against .installing laterals to this area at this time. He said this would be a deficit project as there were difficulties to overcome that would add to the cost of this project. One of these would be a lift station. to be installed which would cost approximately X30,000. Mr. .Rosene also advised against this project due to the lift station and force main which would have to be installed to get water and sewer to this area.. A petition was presented from homeowners who are against this project due to thehigh cost. .75.789 Motion by Emond seconded by Zaun to accept the petition from the homeowners in Oak Shores 2nd Addition who oppose the installation of sewer and water at this time. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. Mr. ldysoeki asked if it would be possible to hook up to the Burnsville line now. 75.790 Motion by Mako seconded by Emond to follow the recommendation of the Water 8c Sewer Committee and deny the request for sewer and water laterals to Oak Shores 2nd Addition. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. Mr. Harnack from the DNR appeared .regarding the City of Lakeville's request to lower Lake Marion. He said that the DNR was recommending the lake level be 982.1 and said that the DNR might consider another level after the storm sewer ~1) • CITY t3F LAKE~TILLE COUNCIL MEETING Nov~~ 17, 1975 .study had been completed by engineers. A written report will be presented by the I~1R in December.. Various matters will be reviewed with the engineer to bring back some solutions for the problems and the attorney to cheek out: the status of the temporary easements. This will be discussed :further at 9:3Q P.M. atthe December lst meeting.. .75.791 Motion by Brander seconded; by Clarkson to authorizs the Mayor and Clerk to sign the contract for the Comprehensive Drainage Plan, with the engineer and with an additional`chargeof $150© for the Water Quality.. Study. Mako, gnond,-Clarkson, Zaun and Braz~les- "aye",.:motion carried. 75:792 Motion by Clarkson seconded by Mako to .authorize the Mayor and Clerk to sign the contract for the<Planning Tactical Review. This motion rescinded. 75.793 Motion by Zaun seconded hY' Brander to aut',horize the Mayor and, Clerk to sign the Planning Tactical Review subject to the Planner's concurrence with `.the changes. Emond; Clarkson, Zaun, Brander and Mako "aye",'motion carried. ~n ordinance amending'ordnan~e No. 25, .being an ordinance licensing and regulating the sale and consumption of non-intoxicating malt liquors was-read .for :the firet time. 75.794 Motion by Clarkson seconded by Errand to grant the abatements as listed on the.. attached sheet sent over from the assessor's office and dated November 12, 1975. £larkson, Zaun, Brander, Mako and Emond "aye", motion carried. 75.795 'Motion by ..Clarkson seconded by Mako to accept the bids on the four police cars as presented.. Zaun, Brander, Mako, F~nond and Clarkson "aye", motion carried. 75.796 Motion by Mako seconded by Clarkson o follow the .recommendation of the administrator and police chief and purchase the four cars from Suryside Chrys3er Plymouth at a purchase price of $17,565.2fJ and trading in"the two 7~'s at a: trade in .value of $2,100.. Total purchase price, $15,x+65.20. Brander, Mako, E~nond, Clarkson and Zaun "aye"', motion carried« Item 18 was tabled. 75.797 M©ton by ,Clarkson seconded by Emond to accept the.resignations of Joel Haglund a9r~d. Henry Lau from the Planning Commission.. Mako, Emend, Clarkson, Zaun and Brander "aye",:motion carried.. 75.798 Motion by Zaun'seeonded by Clarkson tp adopt the resolution. as prepared by Mr. '14tako commending Mr. Lau 'and. Mr. Haglund for. their. years of service to' the com~aunity. ~rtd, Clarkson, Zaun, Brander and Mako-"age", motion carried. The Council'dscussed disbanding the Water & Sewer .Committee andrecomanended that Mr. Spande, Mr. Hazel and Bob Nelson's names be presented for the,Pla'nning Commission. 75.799 Motion by A4ako seconded by Brander to accept'the xeturn of the J C's beer license and repay the fee on a pro rata basis.
