Present; Clarkson, Zaun, Brander, Mako and Emond. Also present; Pat McGarvey, City Administrator, Robert Rosene, City. Engineer and. Pat Farrell and Roger ISiztttson, City Attorneys. utes of 75.800 Motion by Brandes seconded by Emond to accept the Special Bond Sale meeting of November 17, 1975 as presented. Clarkson, Zaun, Brandes, Mako and Emond "aye",.motion carried. 75.801 ~Sotion by Zaun seconded by Emond to accept the minutes of the Regular November 17, 1975 meeting as presented. Zaun, Brandes, Mako, Emond and Clarkson "aye'", motion carried. 75.802 Motion by Zaun seconded by Brandes to approve the claims against the City. Brander, Mako, Errand, Clarkson and Zaun "aye", motion carried. 75.803 Motion by Mako seconded by Zaun to authorize the administrator to act on the matter of the sharing in the cost for the taking of water samples by the United States Geological Survey in connection with the drainage study of the lakes. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. Mr. Rosene reported on the study he has made regarding the elevations of Lake Marion in regard to the lowering of the lake in compliance with the D1UR's recommendation and what can be done to alleviate the .flooding .situation for next spring. Mr. .Farrell advised the Council that it has two alternatives:. 1- to do nothing, and 2-proceed with the lawsuit in district court in the matter to have the land across which the water will flow declared a natural waterway. Mr. Sayers said that this water would add to the property owner's problems. Mr. Etnond felt that the City should wait for the drainage report before doing anything• Other involved property owners argued that the water should be lowered to remove the flooding problem for next spring. Mr. Hammer asked why a culvert is, not installed under the driveway of the church property . 75,$c?~+ Motion by Mako seconded by Emond to instruct the attorney to withdraw the. suit without. prejudice regarding the natural waterway from Lake Marion. Emond, Zaun, Brander and Mako "aye",.Clarkson "no", motion carried.. 75.805 Motion by Mako seconded by Emond to instruct the attorney to meet with the owners of the church property to discuss the alternative of a culvert under their driveway and return to the .Council next week with this information. .Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. Mr. Farrell requested that the engineer give his opinion as to what amount of the church property will be flooded by installing a culvert and if there will be any danger to the homes in the area. The continued hearing for the Iteri Street assessments was opened. Pat Harvey questioned if the problems have been or will be taken care of. He was assured that the street project would not be accepted until these had been corrected. 75.806 Motion by Mako seconded by Zaun to adopt the assessment rolls for the Iteri Street improvement as presented. Zaun, Brander, Mako and Clarkson."aye", Emond abstained, motion .carried. 75.847 Motion by Brarles seconded by Zaun to authorize the Mayor and Clerk to sign the a~mini,strator's contract with .the City. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. The ordinance amending ordinance No, 25 was read for the second time. 75.808 Motion by Clarkson seconded by Emond to adopt the "Ordinance Amending Ordinance No. 25, etc" Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. ~l} CITY OF LAKE;VILLE COUNCIL A~i'ING DECE~F~R 1, .2975. Ray ,Skelton appeared in regards to his request for a variance and a moving permit to move a building from Apple Valley to his business in Lakeville. 75.809 Motion by IIuond seconded by Zaun to follow the reeom~nendation of the Plaxanin Commission and grant Mr. Skelton a wing permit to move their electrical building to the new location in Lakeville but it is the Comrgission's recommendation that there is no variance required for height because the: actual height°of equipment .above grade is only thirty-five feet. E'mond, Clarkson,'2aun, Brander and Mak~a "aye", motion carried.. 75.810 Motion by Clarkson seconded by,Mako to adopt the resolution abolishing the Sewer and Water Commission. Clarkson, Zaun, Brander, Mako and Emond "aye", nation carried... Various concerned citizens did not feel air committee should be abolished but it was explained that the Planning Comao:i.ssion would. probably be taking care. of any. problems that might develop. .75.$11.. Motion by Mako seeonded,by Clarkson to appoint Nis. Spande and Mr. Hazel to fulfill' the unexpired terms of the people who had. resigned from the Planning Commission. This motion was withdrawn as_there had been no notice placed in the papers that the Council is now receiving applications for. the openings. cane the commission. Don Petexson and Len Nelson asked the Council to give these appointments careful. consideration. ;75.812 Aiotion by Brander seconded by Zaun to approve change prder No: 2 for the Oak Shores Street. Improvement in the amount of $1,x+28.50. Zaun, Brander, Mako, h~nond and ,Clarkson "aye", motion carried. Jim Heneke of Valley Park suggested that the Council hold the meeting in the Valle~r View School when there is discussion for. the new fire hsll. 75.813 Motion by II~nd seconded by Mako to table the building permit for'Dexn~q Dunham until next week.
