The meeting was calved to order by Mayor Mako at 8:00 P.M. Flag pledgee
followed.
Present;.. Zaun, Brandes, Mako, Emond and C~.arkson.
Also present; Robert Pinscher, Financial Consultant, Robert Frigaard, City
Engineer, Pat Farrell, City Attorney and Richard Hogan, City Administrator..
75.x+29 .Motion by Clarkson seconded by Zaun to acknowledge receipt of the petition
for. the blaektopping.of Oak Shore Drive,.as presented by the homeowners.
Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried.
75.x+30 Motion by Errand seconded by Brander to authorize the engineer to prepare'a
preliminary report for the street improvement of Oak Shore Drive with the
report to be ready by the first meeting in July. Brander, Mako, Emond,
Clarkson and Zaun "aye", motion carried.
75.431 Motion by Emond seconded by Zaun to approve the Supplement to Joint Powers
Agreement between The City of Burnsville and The City of Lakeville which pertains
to the improvements at Crystal. Lake.. Mako, Emond, Clarkson, Zaun and Brander
"~,ye", motion carried.
75.432 Motion by Emond seconded by Brander to send the Dakota Heights.? Addition plate
.and the request for rezoning back to the Planning Commission for further
recommendations. Emond, Glarksc~n, Zaun, Brander and Mako "aye", motion carried:.
75.433 Motion by Brander seconded by Zaun to approve the amendment to the Four Star
Corporation development contract.. Clarkson, Zaun, Brander, Mako and Emond
"aye",.motion carried..
It was reported that various City organizations had requested to change
the: fireworks permit from the Chart House to Aronson Park.
75.43 Motion by Mako seconded by Emond to adopt a policy permitting fireworks to be
discharged in Aronson Park subject to the Administrator's approval of required
insurance, fire chief's approval, proper planning and .coordination with the
proper City departments. Zaun, Brander, Mako, Emond and Clarkson "aye",
motion carried.
75.435 Motion by Ecnond seconded by Brander to accept the bids for the $945,000 Temporary
G. 0. Improvement Bonds of 1975, Series B. Brander, Mako, Emond, Clarkson and
Zaun "aye", motion carried.
75.x+36 Motion by Zaun seconded by Clarkson to accept the bids for the.$805000 Improvement
Bonds of 1975. Mako, Fmond, Clarkson, Zaun and Brander "aye", motion carried,
75.437 Motion by Emond seconded by Zaun to award the $945,000 Temporary G. O. Improvement
Bonds of 1975, Series B. to the low bidder, First National Bank of St.-Paul-with
a net interest dollar cost of $145,108.75 and a net interest rate of 5191726.-
Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried.
75.438 Motion by Emond seegnded by Zaun to award the $$05,000 Improvement Bonds of
1975 to the low bidder, First National Bank of Mpls., with a net interest dollar
cost of X611,569.50 and net interest rate of 6.909. Clarkson, Zaun, Brander,
Mako and Emond "aye", motion carried.
A letter from homeowners in the -area of Lake Marion endangered_by flooding was
received by the Council. Many homeowners were present for this meeting.
Mr. James Robinette reviewed the history of the lake level and told about various
steps that could be taken to lower the level. of the lake. He said that the
U. S. Army Corp of Engineers could give alternative temporary sonutions but that
a long term solution would have to be found.
Joe Williamson said-that there are five. homes that are .endangered by the high
water and that the road would soon be under water. The problems of the homeowners
on Crystal ..Lake were mentioned.
Mrs. .Curry felt that it would be necessary to do a storm sewer study if this has
note already been .done.
Mr. Frigaard said that his firm had given an estimate of $40,000 to do a study
and that an estimated cost for aerial maps had been about $100,000.

The various solutions to controlling the level of this lake were discussed
by residents and the council.
75.x+39 Motion by Mako seconded by Brander to authorize the engineer and the Public Works
Director to meet with the U. S. Army Corps of Engineers and Civil Defence Director
to study the alternate temporary. solutions to control of the level of Lake
Marion to get some immediate relief and to proceed to take action with the
expenditure of up to $5000 and whereas this is an emergency, to take this
money from the surplus fund. 2aun, Brander, Mako, Emond and Clarkson "aye",
oration carried.
75.~+~40 Motion by Emond seconded by Zaun to authorize. the Administrator to look into
the possibility of funding the lake level project with a bond issue in the fall
or other alternate financing and to report back on this by the l~Fth of July at
9:15 P.M. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried.
Motion by Emond seconded by Zaun to adjourn carried unanimously.

Dear Ed:
Two years.. ago, on May 7,.1973, I appeared before the council and asked
if anybody knew how high Lake Marion could go before it would flood. None
of the council members knew the :answer, At the same meeting a man had
gotten a permit to build a new home along the lake. The main concern was
where he would locate his septic system. The only mention of elevation
concerning the property was that it was on high ground. Over the last
35 years Lake Marion has had a vertical elevation that has varied 14 feet.
I would like to point out, based on this figure, that high ground on Lake
Marion is a very relevant thing based on what year one builds his home.
At this meeting I pointed out to the Council that there are five homes
located on Lake Marion in Bassets lst addition that are in danger of being
flooded, I was told that the following year, 1974, a lake study would be
performed and an outlet installed that would protect all properties. The
only change to come forward from my meeting with you was based on informa-
tion I had given to you, and that was a revision to the building code
that no homes could 6e built below 985' above sea level on Lake Marion.
Now that you have taken this action to protect the people who build
in the .future, what are you going to do to protect those of us who live
here now? The shores of Lake Marion are being hard pressed with develop-
ment, which brings increased run-off into the Lake Marion basin. People
purchase land that is not true lakeshore, but is backwater. Development
brings more run-off, increasing the lake level, and. the backwater becomes
good lakeshore. .Those of us who paid a premium to have good lakeshore get
flooded out, and the people who bought cheaper land on the slew or back-
water get better shoreline. This is an irreversable cycle.
I have asked that Lake Marion be locked at a maximum height of 980.5'
above sea level. This is approximately where the level of the lake. is now.
I have enclosed a graph showing the maximum levels of Lake Marion.
since 1938, These records come from the Department of Natural Resources.
As you can see, the lake was very erratic in its elevations up to 4 years
ago. It has been maintaining a consistently higher elevation for the last
5 years. The elevations of the homes and the road that are in danger of
flooding are also on this graph.
I ask that you review these documents. I will be glad to come before
the Council to answer any questions you may have.
What I am seeking is affirmative action by the Council that would
include a complete plan for controlling the lake's maximum level,. and the

_ time frame in which that plan will be implemented.
Lakeville has three major lakes. Orchard Lake has an outlet. Crystal
Lake, at great expense, will be controlled. Lake Marion is the last one to be
controlled.
Please act now so that we who have invested our time and money can breath
easy and enjoy the good life that Lakeville offers.
