~ ~ ~ ~ . CITY OF MLLE COUNCIL MEETING - ' 19, 1975 t The meeting was .called to order. at $:OO P.M bg Mayor Mako. Present; Zaun, Brandes~ and Mako. Absent; E~nond and Clarkson. Also present; Richard Hogan, City Administrator, Robert Frigaard, City Engineer and Pat Farrell and Roger Knutson,. City Attorneys. 75.3+1 Motion by Brander seconded by Zaun to accept the minutes of the May 12, 1975. meeting as .presented.. Zaun, Brander and Mako '}rage",motion carried.. 75.3+2 Motion by Brander seconded by Zaun to pay the claims against the City with the exception of No. 12156. Brander, Mako and Zaun "aye", motion carried. 75.3+3 Motion. by Zaun seconded by Brander to pay the claims against the Liquor Store. Mako, Brander and Zaun "aye"~ motion carried. Greg Kopi.schke and David Licht of Midwest Planners were present to show their. land use plan to the Council. Mr. Farrell inquired about the zoning for the Gephart Warehouse in view of the Council's actions and lawsuit regarding the requested rezoning for this land. Also :present for this. discussion were various downtown merchants and their planner. Mr. Emond and Mr. Clarkson arrived at 8:30 P.M. Mr. Pinscher appearing it regard to the proposed bond sale, mentioned that the Council could increase the $795,0 sale to x$05,000 to pay for the interest owed to Burnrvaale. 75.3+4 Motion by Emond seconded by Brander to adopt the resolution calling for public sale of x$05,000 improvement bonds of 1975 and setting the bond sale date for Suite 23. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. 75.345 Motion by Zaun seconded by Emend to adopt the resolution calving for public sale of ~g45,000 temporary im~arovement bonds of 1975, Series B and setting the bond sale date for June 23, Brander, Mako, Emond, Clarkson and Zaun ':aye", motion carried. 7S•3~+6 Motion by Brander seconded by Zaun to adopt the resolution Authorizing: the Acquisition, Installation and Leasing of a Project under the Minnesota N[unicpal Industrial Development Act and the i.ssianee of Industrial Development Revenue Bonds to Finance the Project,. these bonds for Chas. M. Freidhei.m. Mako, Emond, Clarkson:, Zaun and Brander "aye':, motion carried. Discussion was ccmtinued on the Downtown Development plan. Mr. Zaun said he found it difficult to follow the suggestion of the eventual use along the track. Zt was felt that this should. remain open space. 75.347 Motion by Mako seconded.. by Emond to table action on the CBD plan until the first meeting in June. Motion was withdrawn. Mr. Glenn Noxd, Jerry Eri.ekson and John Enggren felt that a decision would be no easier to make Hater and this would cause more delay in bui.ldix?g'plane. Mr. Farrell said that he did not feel that the traffic situation was .the sole basis of the 3udge's decision. 75.348. Motion by Emond seconded by Brands to aclmowledge receipt of the CBD plan, to remove the moratorium and: table arty action on the adoption of the plan until June 2. Eauond, Clarkson, Zaun, Brander and Mako "ages, motion carried, The hearing on the proposed street improvement, North Lake Marion, was-opened at 9x35 P.M. A list of interested property owners present i.e attached. Mr. Frigaard.reviewed the preliminary report. Curtis Gunderson said that he had a petition in opposition to the. proposed street improvement. Clarkson, Zaun, Brandes, Mako and Emond "aye", motion carried. there Mr. Joe Schweich asked how matey connections were on the .short portion of 199th Way and said that he is opposed to this project. Mr. Tom Walsh asked if this paving would help keep the water from collecting in the road. Mr. Frigaard explained that there will have to be some reshaping of the road and placing of gravel to make this water drain east. Mr. James Blanchard presented a petition from persons on Upper 196th Way, Java Path and JasmineAvenue who are opposed to the paving of these streets. 75.350 Motion by Etaond seconded by Zaun to acknowledge receipt of this petition from the residents of the above named streets. Zaun, Brander, Mako, Emoted and Clarkson "aye", motion carried. Karl Lutgens felt that only the people who had been on gravel roads were opposed to this project. He is in favor as the. dust is sQ bad he has to run his air conditioner all the time. His lawn is also being ruined. Mrs. Jan Graff presented a report showing how many children live on her street and. explained that she felt paving of this street would only bring mare traffic. 75.351 Motion by Zaun seconded by Clarkson to acknowledge receipt of the report presented by Mrs. Graff. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried.. John Graff felt that the new road which had been built for the construction of the water and sewer project should be closed. Tom Faerber did not feel that this road should be closed and that he is in favor of the blacktopping. Mr. Rudiger said he is in favor of the blaektopping but it should be located in the proper place. Tom Wahl said that. he is in .favor of blacktopping. Intr. Gothard'said he felt the water problem should be resolved before the streets are blacktopped. Tom Rasmussen said that the road is now higher than his driveway and the water is running into his yard so he felt this should be taken care of. Robert Boenish is in favor of the blacktopping and he feels the new road should remain. as it is a. safety factor. Karl Lutgens said that signs should be installed directing people to Antlers Park as this would keep some traffic away. Mrs. Graff asked if storm sewers were planned for this area. Tom Wahl said that some culverts had been removed during construction of the utilities and should be replaced. Mr. Blanchard asked if all the clean up work was done for the utility project. Tom Ki~ruuel asked if the driveways are to be repaired and was told -they would be done in conjunction with this project. Gene Bennett felt that all of 186th St. should be paved as it would be foolish to leave a portion i.n gravel. Clark Johnson would like to see a storm sewer study made before the streets go i.n. 75.35 Motion by Clarkson seconded by Zaun to close the hearing for street improvements, North Lake Marion area. Maka,-Emond, Clarkson, Zaun and Brander "aye",emotion carried. 75.353' Motion by Find seconded by Clarkson to adopt the resolution ordering the street improvements, North Lake Marion and to authorize the engineer to prepare the plans and specs, for the portion of street from Jaguar Ave: to the end of Jersey Lane. Emond~"aye"y Clarks , Viand Mako opposed, Brander abstained, motion failed, Tom Rasmussen asked if the elevations had been shot of the lots on 199th Way and was replied: in the affirmative. CZ) c ~ , ~ • CITY' OF LAI~VILLE COUNCIL MEETING MAY l9~ 1975 75.35+ Motion by Mako seconded by Clarkson to adopt the resolution ordering the street .improvements, North Lake Marion area, authorizing the engineer tc~ prepare the plans and specs for the project as presented with the extension of blacktop on-196 St. to Jaguar axui to include in the plans and epees any culverts .that are necessary for adequate draining of that area. Clarkson, Zaun, Mako and Emond "aye", Brander abstained, motion carr~e d. Mr. Clarkson said that the costs should be available when the bids are received for this project. 75.355 Motion by Mako seconded by Zaun to follow the recommendation of Mr. Robinette axid Mr. Michaud regarding the use of the lagoon at Antlers Park for boat launching and the establishment of the ;parking lot for trailers and automobiles. Zaun, Brander, Mako, Emond and Clarkson."aye", motion carried, 75.356 Motion by Emond seconded by Zaun to follow the recommendation of the Public Works Director and authorize the removal of the old buildings at Antlers Park, the upgrading of Antlers Park field and the third ball field in Aronson Park. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.357 Motion by Z,aun seconded by Emond to acknowledge receipt of the petitions to vacate a portion of 201st Street in Antlers Park and a portion of Judicial Road west oP Orchard Lake. Mako, Emond, Clarkson, 2.aun and Brander "aye", motion carried. 75.35$ Motion by Emond seconded by Mako to set the hearing for the vacationof 201st Street for June l6 at 9;15 P.M. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. 75.359 Motion by Emond seconded by Mako to extend. this meetin.~ until all the business on the agenda is taken care of. Brander, Mako and Emond "aye", Clarkson and Zaun opposed, motion carried. Margaret Klotz a,nd Ken Ellingson explained why they felt the portion of Judicial Road should be closed. 75.3 Motion by Mako seconded by E,mond to set a hearing for the vacation of a portion of Judicial Road for July l~+ at 9:00 P.M. Zaun, Brander, Mako, Emond and .Clarkson "aye", motion carried. The parking fear at Lake Marion were discussed and the Council felt that no change should be made regarding .these at this time. 75.361 Motion by Mako seconded by Zaun to accept the job description for. the Park .Administrator as,~resented and authorize the hiring of a person to fill this position. Maka w'aye" Brand s, nd, Clarks©n and-~a~. opposed, motion .failed. ,75.362 Motion by E'mond seconded by Clarkson to authorize the engineer to prepare contracts for the sealing axed cleaning of sewer lines as recommended. Mako, Emond, Clarkson, Zaun and Brander opposed, motion failed. , 75.363 Motion by Clarkson seconded by zaun to rend this recommendation regarding the televising, sealing and cleaning of sewer lines to the Water and Sewer Committee for a recommendation and to authorize the engineer and pu~lie works director to work with the committee. Emond, Clarkson, Zaun, Braxldes and Mako "aye", motion carried. 75.3+ Motion by Brander seconded by Clarkson. to authorize the Mayor and the Clerk to execute the Ceta Contract. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. 75.3Fi5 Motion by Clarkson seconded by Emond to reject all bids received May 19, 1975, on the fire truck. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. 75.366 Motion by Emond seconded by Mako~rebid for the fire truck and to set the bid. letting date for the gth of June, 1975 at 2:00 P.M. C. b. T. at the Fire Hall. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. Margaret McFarlane returned to request monetary aid to move the Heller house. This money will be taken from the Liquor Fund. Mako Clarkson, Zaun and Brander."aye", Emond opposed, motion carried.. 75.368 .Motion by Clarkson seccmded by Brander to complete the Revenue Sharing report faith the information that these funds will be used to make the payment on Antlers Park and to authorize the :Mayor and the .Clerk to execute :the document.. Etnond Clarkson, Zaun~ Brander and Mako "aye",.emotion carried. 75.369 Motion by Emond seconded by Mako to acknowledge:. receipt ofthe preliminary report for Storm Sewer, LakevilleHills, Jackson Heights and Jackson Heights 2nd. Clarkson, Zaun, Brander, Mako and Emend "aye"', motion carried. The Council police committee reported on various matters. reviewed with the Police Chief. 75.370 Motion bg Mako seconded by'Brandes to authorize Mr. .Hogan te? spend up to 950© if it is necessary to keep the ambulance service operating between now.and June 2nd. Zaun, Brander, Nlako, Emond and Clarkson "aye", motion carried. 75.371 Motion by Mako reconded by Clark~x~,,,,to follow the recommeniation of Mr. Hogan to eanti~ue the insurance liability M. Eadsley for the remainder of the insurance period. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. A meeting was set to meet with theauditor on Thursday, the 29th. 75.372 Motion bry Emend seconded by Zaun to approve the on sale beer license for the ..Lakeville Softball Association. Mako, Emond, Clarkson, Zaun and.Hrandes "aye", motion carried. - 75.373 Motionb~y Emond seconded by Zaun to ac~owledge receipt of the Walt Rivers claim for damages to a drainage ditch.
