Present; Zaun, .Brandes, Mako, Emond and Clarkson. ~.3.so present; .Richard Hogan., Administrator, Pat Farrell, City Attorney and Robert Frigaard, City Engineer. 75.162 Motion by Emond seconded by Zaun tc> approve the minutes of the February 18, 1975 meeting as presented. Zaun,..Brandes, Mako, Emond and Clarkson "aye", motion carried. .75.163 Motion by Emond seconded by Zaun to approve the minutes of the Special February 19, 1975 meeting as corrected. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75,16 Motion by Brandes seconded by Zaun to pay the claims against the City. Mako, Emond, Clarkson, Zaun and Brandes "aye", motion carried.. Michelle Copenhaver and Mark Hendahl presented a "Music in Our Schools" proclamation which was signed, by the Mayor. .March 13 will be 'Music in Our Schools;. Day." The Park and Recreation minutes for February 12 were presented. The "Goals, Responsibilities and. Procedures" of the Committee were discussed. Motion by Clarkson to send the Park and Recreation "Goals, Responsibilities and Procedures" to the City attorney for reviewal died for the lack of a second. 75.165 Motion by Clarkson seconded by Brandes to adopt the "Gc~a1s, Responsibilities, Procedures" for the Park and Recreation Committee. Emond, Clarkson., :Zaun,. Brandes and Mako "aye", motion carried. Some recommended names for the committees were presented. The second reading of the amendment tcs the scavenger ordinance took plane. Pat Wren of Wren, Inc, and Lavern Wahl were present for the discussion. Mr. Wahl felt that the fee and permit for pumping served no purpose and was ridiculous.. Mr. Wahl said that dumping was permitted on private property. in othex° communities. 75.166 Motion by-Clarkson eeconded by Mako to adopt the amendment to the scavenger ordinances: Clarkson and Mako "aye", .Zaun, Brandes and Emond opposed, .motion failed. .75..167 Motion by Emond seconded by Brandes to instruct .the attorney to prepare an amendment to the scavenger ordinance to strike permit requirement. Zaun,. Brandes, Emond "ape", Mako and Clarkson opposed, motion carried. The Clerk was instructed to cheek with the Public Works Director regarding all the correspondence relevant to this matter... The hearing on the extension of water and sewer laters to Oak Knolls Addition was opened at 9:00 P.M. A list of interested property owners present is attached.. Mr. Frigaard reviewed the preliminary report. Dennis Gillespie asked if the sewer lines could conform with the actual road bed to do away with taking of the trees. Mr. Frigaard explained that every bend in sewer line requires a mauah.ole. Mr. Gillespie asked when is the proposed construction to-take place and how long will it take. Mr, Frigaard advised that the construction would take about twc~ weeks. He also said that the width of the road is up to the Council. Mr. John $uber asked if the assessment would be, the same as in the Lakeridge plat. The extra cost of this assessment is .due to road restoration and the lateral line being extended 380' to reach this development, Dennis McNellis commented on the cost and asked if the trees are being removed dust for the water and sewer. Pat Bresnahan felt that the cost was too much, Leo Gray asked if there would be other benefitted property owners from the 3$Ot extension. Mr. Gillespie said that this area has run .off problems and. needs sewer. 75.16$ Motion by Clarkson seconded by Zaun to table this hearing until March 10 at 9:QO P.M. to allow the engineer to check with Re11er Construction Co. to see if this construction can be done with a change order and to report back to the Council. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. Mr. Frigaard said that it would. be hard to justify the 8" line as a trunk. project. Judy Briske of the League of Women Voters presented a resolution which would give support to the Minnesota Legislature to adopt legislation to ban the nonreturnable bottles. and cans. She gave reasons for support of this type of legislation, Thomas Seliga and Paul Bresnahan of the Brockway Glass Co. union gave their arguments against this type of legislation. Mr. Joel Price of Menasha Corporation said that there. would be no business for people in the corrugated products if this legislation is passed. Mr. Zaun said that he is not in a position to made a decision at this time considering the economy and job problem. Mr. Eanond stated that he agrees with Mr, Zaun somewhat. Mr. Brander said that he is in favor of anything that would cut down on pollution but would hate to pass on any given thing that would be used out of context in the legislature so would go along with Mr. E~nond and. Mr. Zaun. Mr. Mako said that he would be in favor of this type of legislation if a bill were passed to retrain and pay unemployment to people ~.ose jobs arere destroyed. Mr. Maynard Johnson was present for a discussion regarding the Industrial Revenue Bond policy. Mr. Preeshl and Mr. Johnson are in disagreement with the initial $450 fee. Mr. Johnson felt that this is an undue expense and additional costs should be paid by applicants after the fact. 75.168 Motion by Clarkson seconded by Zaun to table a decision on .the Industrial.. Revenue Bond policy until 8:3D P.M. on March 1D. Mako, Emond, Clarkson,_ Zaun and Brander "aye", motion carried. 75.17a Motion by Clarkson seconded by Mako to adopt the resolution establishing the compensation ~r Gregory Grose... Copy attached. Emond, Clarkson, Zaun, Brander and Mako "ape", motion carried. Mr. Davis reported to the Council that his mother had her property appraised and also has an offer in writing .far the purchase of the property at Lake Marion. Mrs. Davis did not feel that the offer from the City gas enough ar there is a difference of about $5000 from the City offer and the price they would-take. 75.171 Motion by Clarkson seconded by Mako to instruct the attorney to have an appraisal made of the Davis property on Lake Marion and report back to the Council on March l~ at 9:15 P.M, for the purpose of deciding.. the question of that property. Clarkson,. Zaun, Brander, Mako and Emond "aye", motion carried. 75.17 Motion. by ~nond seconded by Brander to extend this meeting until all agenda items are completed. Zaun, Brander, Mako and Fond "aye", Clarkson opposed, motion carried. Motion by Clarkson to finish this item and close the meeting died for the lark of a second. :Meetings were set up to discuss the purchase of easements from Clint Zweber and James Larson.. 75.173 Motion by Emond seconded by Brander to table the Clint Zweber matter until the 14th of March. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75,174 Motion by Mako seconded by Emond to table the James Larson matter until the ~2) • CITY. Mako, Emond, Clsrkson, Zaun and Brander "aye", motion carried. 75.175 Motion by Emond seconded by Brander to instruct the .attorney to proceed with condemnation proceedings against the Moffitt property in regards to the Orchard Lake.Road. Emond, .Clarkson, Zaun, Brander and Mako "aye", motion carried. Mr. Farrell advised the Council on the condemnations against the Kellers in re the Valley Park West sewer and water ea~tensions. 75.176 Motion by Emond-seconded by Zaun to authorize the attorney to ,appeal the awards made to the Kellers for the Highview Avenue Road and the water and sewer easements. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. Mr. Farrell reported that the engineer had calculated the amountof land taken from Airlake for the 215th Street road. He also figured the amount due on assessments outstanding on this property. Theland would be d©nated in return for the abatement of the assessments. 75.177 Motion by Emond seconded by Brander to authorize the preparation of a formal resolution for the abatement of assessments on property given for easements on 215th Street by Airlake. Zaun, Brander, Mako, Emond and Clarkson "ayef', motion carried. 75.178 Motion by Emond seconded by Clarkson to authorize the attorney to take legal action against Ardmore Homes to collect any outstanding bills awed the City. Brander, Mako, Emond, Clarkson and Zaun '"aye", motion carried. The Valley Park ditch problem was discussed and Mr. Farrell asked for permission to interpose and answer in the third party. suit against the City. Mr. Farrell recommended that the City try to obtain the easement for the cost of the suit. 75.179 Motion by Emond seconded by Zaun to a~} thorize the payment of $200 to Sandi Raines for easements on Lots~,5,6~~'LS.keridge Addition. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried.. 75.1$0 Motion by Mako-seconded by Emond to approve the renewal garbage license for Lakeville Sanitation. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. 75.181 Motion by Mako seconded by Zaun to acknowledge receipt of the summons and epmplaint against the City filed by G.'W. Astleford and refer this matter to the attorney. Clarkson, Zaun,,Brandes, Mako and Emond "aye", motion carried. The amendment to Ordinance No. 31 was read for the second time. 75,182 Motion by Clarkson seconded by Zaun to adopt the. amendment to Ordinance No. 31 of the City of Lakeville, being an ordinance regulating and restricting the parking of vehicles on the streets or'n public places in the City of Lakeville and providing penalties for violations. thereof.
