s CITY OF LAKEVILLE COUNCIL MEETING MARCx lo, 1975 The 7:00 P.M. special meeting .was called to order by Mayor Mako. Mr. Dennis Hovland and William Flynn presented a report regarding the Advantages of a Common Organization for Civil. Defense. The County is asking all communities to approve a resolution for joining and named the communities that had already. joined this organization.. Mr. Flynn said. that there would have to be a local coordinator but that Mr, Hovland would be the go-between for obtaining funds from the State, A decision regarding the joining of the common organization was .put off until the meeting of the 17th, The regular meeting of the Lakeville City Council was called to order by Mayor Mako at 8.:00 P.M. Flag pledge followed. Present; Zaun, Brander, Mako, Emond and Clarkson, Also present; Richard Hogan, Administrator, Pat Farrell and Roger Knutson,. City Attorneys, and Robert Frigaard, City Attorney. 75.183 Motion by Brander seconded by Emond to approve the minutes of the March 3, 1975 meeting as presented. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. The engineer presented his report. He also presented a preliminary. report for the street improvement of Iteri Avenue. 75.18+ Motion by Emond seconded by Zaun: BE IT RESOLVED by the City of Lakeville Council that; 1. the preliminary report presented by the City Engineer dated March lei, 1975, attached hereto as exibit A, is hereby accepted, 2. a public hearing be held to consider the proposed improvement on April 1~+, 1975 at 9:00 P.M. 3. the Clerk and Attorney are authorized to publish and. send notice ar required by law. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.185 Motion by Clarkson seconded. by Mako to order a preliminary report for sewer. and water extensions around Orchard Lake and sewer and water to the Orchard. Lake School and any-other streets that appear feasible. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried, The Planning Commission minutes for February 27, 1975 were presented.. 75.186 Motion by Emond seconded by Zaun. to assign items 2 and 3 pertaining to the sign ordinance and notification of property owners to Pat Farrell who will return with a recommendation on the 17th of March. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. 7.187 Motion by Emond seconded by Clarkson to follow the Planning Commission recommendation and grant Mr. Stanley Biggen a conditional use permit to install a ~~fl00 gal tank at Vernon's Skelly Station at Hwy 50 near 35W. Clarkson, Zaun, Brander, Mako and Emond""aye", motion carried. Mr. Farrell reported on the progress of the Brookview Park development. 75.188 Motion by Emond seconded by Brander to close the nominations for the open positions on the .committees. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. Application blanks for persons whose names had been submitted are to be rent out.. 75.189 Motion by Emond seconded by Zaun to adopt the "Resolution Adopting Guide- lines for Municipal Development Bonds," Brander, Mako, Emond, Clarkson< and Zaun "aye", motion carried. Mr. Farrell reported -that there had been a request that the City accept the streets in Valley Park nth Addition but said they .would not be accepted until; A. the streets are free from liens and claims, B, the City Engineer approves of them and C. a normal maintainanee bond is provided. The continued hearing on the sewer and water lateral extensions to Oak Knolls Additon was opened at 9:00 P.M. Mr. Frigaard reported that he had contacted Keller Construction and they would do the Oak Knolls project on a change order at the same price they had done Lakeridge Addition. Mr. Frigaard stated that the property owners ~1) ~ Y CITY OF LAKEVILLE COUNCIL MEETING MARCH 10, 2975 said they would remove the trees and take. care of repairing of the boulevards, sod and seed. Mr, Frigaard felt that the minimum width of the street should be no less than 16' but 18' would be better and that the. width should be at least 2~' at the Highway. The new esta.drraated costs for this improvement would be about $3,475 per lot. Mr. Emond felt that .the ,City should go with an 18' road as long as no more trees are taken out. Mr. Gillespie asked if placing the sewer and water close together would save some trees and was told only two. Mr. Huber confirmed that the homeowners would. take Out. the trees. Mr. Farrell said he is not in favor of the City allowing the homeowners to take out the trees without a waiver of claim for liability in advance. Mrro Gillespie said that there is an experienced lumberjack who will over- see this job, Mr. Huber said that he is willing to sign this waiver. 75.90 ~ Motion by Clarkson seconded by Emond to adopt the resolution as .prepared by the Attorney to order the sanitary sewer and water laterals to Oak Knolls Addition as shown on the amended preliminary report with the revised costs and the waiver of claim by the property owners, Mako, ,Emond, C]a rkson, Brandes and Zaun "aye", motion carried, Mr. Farrell reported that he had had an appraisal made of the Davis. property which is X13,0©~., Mr. Davis has an offer of $14,000 and is not - in the position to negotiate further. There is 45' of shoreline on this property. 75.191 Motion by Mako seconded by Zaun to authorize the offer of X14,000 for the Tom Davis property and authorize the attorney to prepare the necessary.. earnest money contract for the purchase,: to authorize an earnest money - amount and authorize the Mayor and the Clerk to sign the earnest money contract, Mr. EYnond felt that this land should nctbe purchased at this figure.. Mr. Mako thous°,ht this land could possibly used for a boat ramp and parking,, 75.192 Motion by Clarkson seconded by Mako to amend the above motion to read that the money for the purchase of the land be taken from the Liquor Store profits, Clarkson, Zaun and Mako "aye", Emond and Brandes opposed, motion carried, Roll call was then taken on motion 75.191 which is as follows: Clarkson, Zaun and Mako "aye", Brandes and Emond opposed, motion carried. Mr. Farrell presented recommendations regarding easement payments for Glint Zweber and James Larson. 75.193 Motion by Brandes seconded by Zaun to pay $1000 additional to Clint Zweber for an easement on Highview Avenue. Zaun,- Brandes, Mako, Fmond and Clarkson "aye", motion carried. 75.19+ Motion by Emond seconded by Brandes to pay :5200 to James Larson for an easement on Highview Avenue. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. Mr. Farrell said he felt that Keller easements for road and sewer could be obtained for the amount of the award and will pursue this further. 75.195 Motion by Emond seconded by Zaun to grant Central Telephone Company a permit for buried telephone lines in Lakeridge Addition, Mako, Emond, Clarkson, Zaun and Brandes "aye", motion carried. Two sample resolution in regards to selling wine in stores other than Liquor Stores were discussed. 75.186 Motion by Emond seconded by Brandes to adopt the resolution presented by Jim Martin re selling wine in grocery stores with the elimination of the last two words "among housewives" in the last Whereas paragraph. Clarkson, Zaun, Brandes, Mako and Emond nave", motion carried. 75.198 Motion by Emond seconded by Zaun to approve the appointment of the Central Business District review committee as presented. Zaun, Brandes, Mako, Emond and Glarkson "aye", motion carried. .75.199 Motion by Clarkson seconded by Zaun to acknowledge receipt of the ..letter from Mr. Jack Horner commending. Gary Fredrieey for his .good snowplowing job.. This letter will be posted on the bulletin board at the public works building and a copg place in Mr. Fredricey's personnel file. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried:; 75..200 Motion. by Clarkson seconded by Mako,to.adopt the water and sewer complaint .procedure as presented.. Mako, Emond, Clarkson, 7•aun and Brandes-"aye", motion carried, 75,.201.. Motion by Emond seconded ,by Mako to acknowledge receipt of the petition for sewer and water for Oak Hills. First Addition and the remaining part: of Oak Hills Third Addition and turn this over to the Water .and Sewer Committee for a recommendation. Emond, Clarkson, Zaun,.:. Brandes. and Matra "aye", motion carried. 75.202 Motion by Mako seconded by Emond to adopt the amended. salary proposal. for Don and Arlene Larson, copy attached. Clarkson, Zaun, Brandes, Mako and Emond "aye-, motion carried, 75.,203 Motion by Clarkson seconded by Brandes to extend the meeting to take care of the remaining business. Zaun, Brandes, Mako, Emond and Clarkson "aye", motion carried. 75.20+ Motion by Clarkson seconded by .Zaun to follow the Administrator's recommendation and hire Beverly Voshmik as secretary for one year's _probation at a salary of $650 monthly for 1975 starting immediately. Brandes, Mako, Fmond, Clarkson and Zaun "aye",.motion carried. The Building Inspector's report was presented. and discussed. A letter from Mr. Grohoski requesting building permits for Laeridge Addition was also discussed and a recommendation will be brought. back to the Council at the next meeting, 75.205 Motion by Mako seconded by Clarkson to follow the recommendation of the Administrator and authorize the Administrator to hire persons on the E.E. 0. program. Mako, Emond, Clarkson, Zaun andB randes "aye", motion carried. Mr. Hogan reported. that there will be a prehearing on the NSP rate: increase on March 19. 75.2~~6 Motion by Emond seconded by Brandes to appoint Mr. Clarkson to the Dakota Law Enforcement Association. Emond, Zaun, Brandes: and .Matra "aye", Clarkson abstained, motion .carried.. Mr. Mako read a letter to the Council regarding the sale of Mnnreg's Country Club and the possibility of public ,ownership. - Motion by Clarkson seconded by Zaun to adjourn carried unanimously.
