Present; Zaun, Braades, Make and Emend. Absent; Clargs®~. Also present; Roger Knutson and Pat Farrell, City Attorneys, Robert Frigaard, City Engineer and Riehaxd Hagan, City :Administrator. 75.2+7 Motion by Brander aeeoaded by Zaun tc> accept the .minutes of the April 7, 1975 Heating as preseateci. Zaun, Brander, Mako and Emoad "aye?', motion carried. Mr. Don Peterson and Dave Krause appeared before the Council with a Procla~ation of Homey 3undag which was signed by Mayor Mako. 75.2#$ Motion by Emend seconded by Zaun to accept the bids. for the Hakota Heights, Oak Hilly water sad. sewer extensions. Brandea, Mako, Emond and Zaun "age", motion. carried. ~1r. Frigaard reccended that the low bidder, Richard Kautaon, Ise, be awarded .the contract. Mr. Clarkson arrived at 8s1O P.M. 7S•2~9 Motion by En:oad seconded ~ Brander to award the contract to the low bidder, Richard Knutson, Inc. whose bide was ~697,629.5E} accepting the alternate. Makc>, Emond, Clarkson, Zaun and Brander "aye"., motion carried. Mr. Frigaard presented the pleas for sewer and water truxilss to Dakota Heights, Highview to Ipava sad the booster station at 167th Street and Highview Avenue. Some dissuasion took place as to why the booster station pleas had not been recommended for approval bg tie Water and Sewer Committee.. Mr. Frigaard advised that he-had taken them to the Committee on the 8th of April and they.: had no objections to this location or other aspects of the plan. 75.254 Motion by Hmoad seconded by Zaun to accept. the pleas and specs for the Sewer and Water Trunks to Dakota Heights, Highview to Ipava and for the booster station at 167th Street and Highview sad set the bid letting date for the 9th of May at .11:40 A. M. Mr. Farrell advised t~iat- the Council should have a lease from Mr. Ramberg. tc> t~se a porti©n of his property for a parkinglot. The intent at t1~is time is to provide for the present ,use of this.. area but not to provide for more than is there. It was suggested that more information be brought in the first oeeting in Maya 75.253 Motion by Emend seconded by Zaun 'to accept the petition Yor water and sewer extensions from John J. and Hilary Ann Breen to 63ov~t Lot 1, sec. 2~F, T11~ and refer this petition to the Water sad Sewer Committee for a recommendation. Thep~chaae of a 1000. gallon pumper for the fire department was discussed. 75.25 Motean by Braades to authorize the aa#~~rn..~nd taking by Emend aeeoaded of bids-for the 1000 gallon, pumper setting the bid letting date for May 19, 1975' at 2:DD `P.M. and preaeat them at the Cc~nmcil meeting of May 19. Make, Emend, Clarkson, Zahn and Brander "aye", motion carried.. The hearing for the Iteri Avenue street improvement was epeaed at $:40 P.M. A list of interested. property owners present is attached. Mr. Frigaard reviewed. thepro~eetfor the Counailand audience. He said that he would like to .bid this project out with another pra.~ect far which a petition lass some i.a. :~iis would. result isr ire bidders and a better price. ~ 4 { CITY OF LAKk'Vn.T.F. C4IINCIL MEETING - APRIL 1~4, .1975 Mr. Pat Harvey asked why this improvement is not the responsibility Qfthe City - as there .had been pavir~ there before the street was torn up for the water and sewer extensions. Roder f3ilmer felt that the land owner had paid for the original blacktop and should not be charged a second time. It was euplained that the property owner would be liable for this improvement and that the original owners of property on this street had as~.ed be left out of the original water and sewer extensions which explains why this street improvement is so far behind the other.. installations. Jim Loren2en asked if he would be assessed for the driveway improvement as his driveway is on 21~th Street and not on Iteri. He was advised that he could bring this matter up at the assessment hearing. 75.255. Motion by Clarkson seconded by Brander to adopt the resolution ordering street .improvement and preparation of plans for Iteri Avenue. Clarkson, Zaun, Brander,, and Mako "a~e", E~ond abrtained, m~rtiOn carried. Mr. Farrell reported that tl~e ownership of the pools in Va11ey Park had not yet been determined but that the City could condemn there pools to get some aeti©n. 75.256 Motion by Emond seconded by Brander to adopt the resolution authori~~ng the condemnation of taro swia+ming pools in Lakeville,. Munn. as presented by the attorney, copy attached. Clarkson, Zaun, Braxides, Mako and Eraond "aye", motion carried. A petition to lower the speed limit on County Road 70 was presented with some of the interested persons present to discuss the speed problem. 75.257 Motion. by Zaun seconded by ~nond to acknowledge receipt of the petition to lower the speed limit on County Road 7Q. Zaun, Brander, Mako, F~mond and Clarkson ".aye", nation carried. It was suggerted that the County-engineer, Mr. Anderson, be requested to make a further survey of this road with the police comm:Lttee and chief and then present th3.s informatian before the County Board. 75.258`.. Motion by E~ond seconded by Zahn to accept the storm drainage plan for Crystal Lake drainage area which is dated ~/24/`T5. Brander, Mako, Ea~nd, Clarkson and Zaun. aye", motion carried.. The conti~ed hearing en the street improvements to the eonaa~a roads in Crystal.. bake, Bluebill Bay Road and Maple Island Road, was opened.:... ,"75.259 Motion.. by Mako seconded by Zaun to order the street improvements on the co roads in Crystal Lake which include approximately $Ot3 feet of Bluebill Bay Road and that portion of Maple Island Road which is common to Burnsville and Lakeville, resolution to be prepared by .the attorney.. The City also agrees to participate in -the replaee~nt of the culvert on Bluebill Bay Road and the cost of the same. Mako, E~ond, Clarkson, Zaun and Brander "aqe", motion. carried. The. hill west of Jacquard Avenue on 210th Street and the existing surfacing on New Cotimty Road 70 were discussed. This matter will be reviewed with the Cc+unty engineer at the same time as the req~;xert for the speed limit on Highway 7~. The attorney gave his rec tion regarding the uppaid.~laimfor street improvements in Clay's Acrer which is awed to Northwest Bit~umi.nou.a. He advised that the Cc?~ancil had two al Liver, 1. to do nothing 2. to hold a supplia~ntal assessment hearing for these costs. "j5.26E)> Motion by Clarkson recorded by Emond to send a letter to Northwest Bituminous as f411owrz because the City has no legal responsibility for payment of this claim, the City hersby declines..payment of the same. Mm4nd, Clarkson, Zaun, Brander snd Mako "ay®" motive. carried. 75.266 Motion by Emond>seconded by Zaun to authorize the agieeer to prepare a prelim3,naxg report for the street improvement on the Borth side of`Lake Marion. Clarkson, Zaun, Brander, Mako and Fond "aye", motion carried.. 75.267 Motion by Clarkson seconded by Zaun to acquire-and condemn easements relating to pro3ect plans and epees for sewer and water trunks, Highview to Ipava and for property for the. booater station.. at 167th Street abet Highview Avenue.
