Present; Brandes, Mako, Emend and Clarkson. Also present; Pat Farrell and Raager Knutson, Citg Attornegs, Robert Frigaard, City Engineer and Richard Hogan, Cit~? Administrator. 75.1 Motion bg Clarkson seconded by Emend to appoint Edward eo, l~iayor. Brandes, Emend and Clarkson "aye", Mako abstained, motion carried. Mr. Mako was sworn in as new Mayor of Lakeville. 75.2 Motion by Emend seconded by Brandes to appoint Duane Zaun as. Councilman. Mako, Emend, Clarkson and Brandes "eye", motion carried, Mr. Zaun was sw©rn in as Councilman, Mr. Langness~ of Sprinsted Inc. reported that two bids had been received on. the 1, 464,4GD end issue. The bids were then opezzed,with a copy of th®se bids attached to these minutes.. 75.3 Motion by Emond seconded b~ Brandes to accept the bids on the ~1,46a,oc~ bond issue. En~nd, Clarkson, Zaun, Brandes and Mako "aye", motion carried,' 75.4 Motion bg Hacsnd seconded by Brandes to .adopt the resolution "Authorising, Selling .and Establishing the Terms of ~1,46t3,c>CO Temporary: Improvement Bonds of 197"and .award. the bonds to the iow bidder, First ~Tati4nal Bank of l~ls and Allison-Williams with a net interest dollar:rate of X23(),556,24, and. net sPfseti~e rate mf 5.3369%. Clarkson, Zaun, Brandes, Mako and Emend "aye", motion carried. 75.5 Motion by Clarkson seconded bg Emend to accept the minutes of the December 16, 197 meeting as presented. Brandes, Mako, Emend, Clarkson and Zaun "a3~e", motion carried. 75.7 Motion by Emend seconded by Mako to peg the claims against the Citg. Mako, Emend, Clarkson, Zaun and Brandes "aye", motion carried. 75.8 Motion by Brandes seconded by Zaun to appoint the council working cozz~ittees, numbers one thru 14, as presented on the attached list. Emend, Clarkson, Zaun, Brandes and Nlakc~ "aye", motion carried. 75.9 Motion by Emond seconded by Clarkson to appoint Edward Mako, Civil Defense Director. Clarkson, Zaun, Brandes, Mako and Ecnond "aye", motion carried, 75•la Motion by Brandes seconded by Mako to appoint James Emend, Acting Mayor. Zaun,. A letter from the Lakeville T imes was read. 75.14 Motion.. icy Mako seconded by Zaun to acknowledge receipt. of the letter froze. the Lakeville Times. Clarkson, Zaun, Brandes, Mako and Eztzond "aye", motion carried. I i CITY OF LAK~TILLE COUNCIL MEETING JANUARY 6, 1975 Paul Steele, an attorneq from Northfield representing the Lakeville Times, discussed his reasons for believing that the Lakeville Times is the only newspaper that shAUld be appointed as legal newspaper for Lakeville. Al Patenaude, Christina Huddleston Gordon Lekson and I3on Cross, local citizens, all gave their opinions regarding the keeping of this business ~ Lakeville and felt that the Lakeville Times should be appointed. Mr. Farrell said that either ppper would be qualified to be the legal newspaper for Lakeville. Mr. Mako said that the prime concern is which newspaper serves most effectively and reaches the most customers. Motion by Mako to appoint the Dakota County Tribune the official City of Lakeville newspaper died for the lack of a second, 75•l5 Motion by Brander seconded by Zaun to appoint the Lakeville Times ar the official City newaper. Zaun and Broader "aye", Mako and Clarkson opposed, Emond abstained, motion failed. This matter was postponed until further discussion with the attorney and papers. 75.16 Motion by Emond seconded by Brander to appoint Grannie and Grannie, City Attorney, Bonestroo, Rosene, Anderlik and Assoc., City Engineers and Midwest Planners, City Planner. Brander, Mako, Emond, Clarkson~~and Zaun "aye", motion carried. h letter will be written to Beekman, 'Yoeder and Seay letting them know the Council decision. The Sewer and Water minutes for December 1D, 197+, were presented. The reQOmmendation that the Council have a preliminary report made for bringing water and sewer to all of Sec. 32, T11~F, R2CW was returned to the committee for further rtudq. 75.17 Motion by Emend seconded by Brander to swept the preliminary report for water and sewer extensions to oak Knolls Addition as presented bq the engineer. Mako, Emond, Clarkson, Zaun and Brander "aqe", motion carried. The Park do Recreation minutes for December 11, 197 were presented. 75.1€3 Motion by Clarkson seconded by Emond to follow the recommendation of the Park & Recreation Committee and authorize the expenditure of up to ~6c~0 to purchase sign material. Emend, Clarkson, Zaun, Brander and Mako "aye", motion carried. The Planning Commission minutes for December 12, 1974 were presented. A motion by Clarkson seconded by Brandes~ grant Mr. Miller a trailer permit was withdrawn. 75.19 Motion by Clarkson seconded by Brander to table alp zo s for trailer 1~~ permits: Raplinger, Miller and King, Sr. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. 75.20 Motion bar Emend seconded by Brander to follow the recommendation of the Planning Commission and grant Sea Girt Inn a permit to place a sign on the corner of Highway 5 and Co. Rd. 4~. Zaun, Brander, Make, Emond and Clarkson "aqe", motion carried. Motion bq Brander reconded by Zaun to renew the special use permit for Francis Rittenhouse for one year was withdrawn. 75..21 Motion by Brander seconded bq Emond to table the Rittenhouse special use permit for one week. Brander, Mako, Ee~nd, Clarkson and Zaun "aye", motion. carried. The Dee. 26 Planning Commission minutes were presented. .75.22 Motion by Clarkson seconded by Emond to follow the recommendation of the Planning Commission and grant "The dare Depot" a special use permit for one gear. l+~tako, Emond, Clarkron, Zaun and ~randes "aye", motion carried. 75.23 Motion bq Brander seconded by Zaun tca follow the Planning Commission recommendation and grant the Jackson Sod do Landscape Co. a special use permit for outside storage for one gear. Emoncl, Clarkson, Zaun, Brander and Mako "aye", motion carried. _2_ • • s CITY ~F LAKEtTILLE C4tJNCIL MEETING J.AN[TAFtY 6, 1975 Mr. Preeehl appeared before-the Council to explain why National Polymers is now asking for ~750,4mQ in Industrial Revenue Bonds. He said that they wound be able to obtain lease insurance if the Council would approve these bonds.. It Was decided to establish a meeting with all the priciples to establish a clear cut policy on the granting of Industrial Revenue Brands by the 24th of January. 75•~~ Motion by Ea~cand seconded by Brander to table this request for bonds until the first meeting in February. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. 75.25 Motion by Emond seconded by Brander tea acknoxledge receipt of the petition from the. Eureka property owners who are opposed to being annexed by Lakeville. Zaun, Brander, Mako, E~mcand and Clarkson "aye", motion carried. Mr. Mako explained to these Eureka residents how this annexation had come about. 75.26 .:Motion by Clarkson seconded by end to aclrnowledge receipt of the resignation from R®d Pikus from the Planning Com~i.ssion and instruct the clerk to write him and thank hiffi for his service rendered and present him with a City flab. Brander, Mako, Emond, Ci~srkson and Zaun "aye", motion carried. 75.27 Motion by Clarkson seconded by Zaun to nullify motion No. 74.166. as to appointment of committee members. Makca, Emond, Clarkson, Zaun and Brander "aye", motion carried. 75.28 I+~otion by Clarkson seconded by Emond tc> appoint John Jojade tc> a three year term on the Planning Commission, Emond, Clarkson, 2aun, Brander and Mako "aye", motion carried, Mr. Robinette presented his S,de Tree Disease Program for 1975• 75.29 Motion b7 Emond seconded by Zaun to approve the Shade Tree Disease Plan far° 1975 as presented, Clarkson, Zaun, Brander, Mako`and Emond "aye", motion carried. 75.34 Agc~tion by Clarkson seconded by Mako to designate the Dakota County Tribune as the official City newspaper. Mako and Clarkson "aye", Zaun and Brander .opposed, Emond abstained, motion failed. 75.31 Motion by Mmkea seconded by Brander to designate the Lakeville ~'i.mes as the officiil City newspaper. Brander, Mako, Clarkson and Zaun "aye", Emond abstained, motion carried. Mr. Farrell advised the Council that he heel sent the check which had been received from Instant Homes back tea them ae the Council had instructed him. He'said he would reeommend,~not granting. the special use permit until this matter is resolved and that a restriction of the placing of mobile homes in Arr3m<ar Park be restricted. 75.32 Motion by Brander seconded by Clarkson to table the Instant Homes special use permit until the first meeting in February. Mako, end, Clarkson, Zaun and Branded "aye", motion carried.. 75.33 Motion by Clarkson seconded by Brander to instruct Instant Homes that no additional trailers will be allowed to be placed on site until they have complied with the City by paying all outstanding claims and the agreement in regards to hookup chax°ges. Emond, Clarkson, Zaun, Brander and Mako "aye", ~atian carried. This letter trill be sent by-certified mail. Mr. Hogan reported to the Council that the Burroughs Co. is now cooperating on the budget program and a report will be forthcoming in the near future... Mr. Farrell reported that he had not been able to reach a deeision with the Larsons in regards to the payment: for the trees and felt that the only solution would be to let the eomuassioners make sn award. 75.3r~ Motion by Mako to authorize the attorney to proceed with the condemnation of the Larson property. Mention seconded by Brander, Clarkson, Zaun, Brander, Mako and Emond "aye" Motion carried. '75.36 Motion by Clarkson seconded. by 1~akQ to table the gravel permits until. the next meeting and request a recommendation from the building inspector. Brander, Mako, end, Clarkson and Zaun "aye", .motion carried... 75•~~- Motion bg Clarks®n seconded by Zaun to award the purchase of the two patrol cars to Sunnyside Chrysler for the low bid of X8,095. Mako, Emend, Clarkson., Zaun and Brander ".aye", motion carried, A meeting was set for 7P.M. Thursday to review the contract with,MidWest Planxters. 75.2 Motion by EmDnd seconded by Brander to change the date for the hearing on the Orckard Lake taster and Sewer Improvements from the 15th to the 22nd of January.
