Present; Zaun, Brander, Mako, Emond and Clarkson.. Rlso present; Richard Hogan, City Administrator, Robert Frigaard, Citg Engineer and Pat .Farrell and Roger Knutson, City Attorneys. 75.70 Motion by Emond seconded by Brander to accept the minutes of the .January 13, .1975 meeting as presented. Zaun, Brander, Mako, Emend and Clarkson "aye", motion carried. 75.71 Motion 'bg Brander,seconded by Emond td peg the claims against the City, list attached. Brander, Mako, E'mond, Clarkson and 'Zaun "aye", motion carried. 75,72 Motion bg Emond seconded by Brander to pay the claims against the Liquor Store, list attached. Mako, Emond, Clarkson, Zaun and Brander "age", motion carried. Mr. John Jo;jade presented the..Proclamation of Snow Festival Days. which the Mayor signed. No progress report ways made on Industrial Bond Policy as Mr. Preeshl had been ill. 75.73 Motion by Emond seconded by Zaun to authorize the Mayor and the clerk to sign the Metro~litan Sewer Interceptor Agreement for 1975. Emond, Clarkson,. Zaun, Brander and Mako "aye",.motion carried. It was decided to have the clerk send letters to all. the members of the Human Rights Commission to see if theg Mill want to serve. .Otherwise they will be asked. to .send in letters of resignatian bg Feb. .3 so that other members can be appointed. Various other matters were discussed by the Council such as a new fire truck, new building and new members of the fire department. The status of the Cle~in~ personnel at the liquor store was discussed. The Council liquor committee will discuss this further with the Larsons. 75.74 I~tion by Emond seconded bg to authorize Mr. Zaun'to attend the seminar for new councilmen on the 24th wind 25th. Clarkson, Zaun, Brander, Mako and Emend "age", motion carried. Mr. Farrell reported that the City now is the owner of Lots 14 and 15, B1, FoPest Hills.. He also reported regarding the Gephart lawsuit and felt that the City could repoup some of the costs. Mr, Farrell also reported that Arfield Lecy would give a small piece of land for $24 and the abatement of his first years interst payment on his assessment at Lake Marion. The land is where a grinder station is located. 75.75 Motion bg Clarkson seconded by Brander to grant Arfield Leey the abatement of his first gear's interest on his assessment payment on parcel 21)947 and tc pay Mr. Lacy X24 for a small piece of land where a grinder station is located. Zaun, Brander, Mako, Et~nd and Clarkson "aye"', motion carried. The moneg settlement of the Quist property was discussed. 75.74 Motion by Zaun seconded by Brander to authorize the pagment of $23,404 for settlement in the acquisition of the Quist property f'or which condemnation had been authorized. Brander, Mako, Emond, Clarkson and Zaun "aye", motion carried. 75.77 Motion by Emond seconded by Clarkson to put the Freidheim Industrial Bond Agreement on the table, Mako, Emond, Clarkson, n and Brander "aye", motion .carried.. 75.78 Motion by F~nond seconded by Brander to authorize the Mayor and the Clerk to sign the underwriting agreements between Freidheim, Miller and Schroeder and the City of Lakeville in re the Industrial Revenue Bonds. The hearing an water and sewer extension to Dakota Heights and Oak Hi11s Additions was opened at 9:QO P.M. A list of interested pmpertyowners is attached. Mr. Robert Clark said. that Ixonia is paved now and waulc this street be repaved When the water and sewer are in. He .was advised that onlg a gravel base would be put in and that if a paved street is desired here, there would have to be a petition from the property owners and the costs would be born bg the property owners. Other additions have had the pavement escrmwed at the City although the costs have changed considerably and`the ssoney escrowed would probably not cover all the costs. Mr. Lundgren asked how..this would be assessed. Mr. John See asked how soon this. project could be completed and said he is in the process of building a home and would like to know whfeh kind bf a ~?stem to install. Robert Laddusaw asked what this includes and was told it also. includes, the trunk. Robert Mueller said he felt that this improvement wsr being isapo~ed on. them by the speculatcars. Mr. Patenaude. asked hcrw the faxmers would be assessed. Mr. James Oletzke said he is opposed to this pro,~ect as he'had toa much invested in his presexat system and this will be causing a hardship on the homec>~raers. Mr. Steven Suer said he was not included in this hearing but felt it was too expenseve and asked if the elaborate systems were necessary. Mr. Patenaude asked if his. lour acres is included-and was advised that it was not. Mr. Ren Larrimore said that with the state of the economy this should not go in. Mr. Robert 3tgve and Mr. Yorks said that they would like to build if water and sewer are .installed, Mr. Frigaard advised that if this project is ordered, water and sewer.: could:.. be in bg next.:fall. Mr. Emond felt that these. people would appreciate the water and sewer if it were instal~.ed. It was also mentioned. that the water would have to be installed now to be able to use the new water reservoir. 75.79 Motion bg Clarkson seconded by Zaun to .close the hearing on water and sewer extensions to Dakota Heights and Cak Hill$ Additions. Esrond, Clarkson, Zaun, Brander and Mako "aye", motion carried.. to Oak Mills; & _ Dakota :Heights 75•x- Motion bg Clarkson seconded by Brander to proceed with the water Sc sewer extensions , as outlined in the Engineer's-preiiminarg report. Clarkson, Zaun, Brar~des,` Mako and Emond "aye", motion carried. 75.81 Motion bg Emond seconded by Clarkson to o~~~h~srize the engineer tc~ prepare the plans and epees for the water and sewer extensions to Dakota Heights andoak H'fi~1s Additions, Zsun, Brander, Maka, Er~ond and Clarksob "aye", .motion carried. The continued hearing on the storm sewers, culvert and street improvements in Crystal Lake was opened... Mr. Tony Westbreeg felt that the east of $7t)O is excessive and the pr©perty owners are not getting enough benefit from this improvement. He ales felt that the storm sewer should be underground in Lakeville. Mr. John Connelly said that he is opposed to this improvement and can not see whg any of this cost should be assessed against his property. • It was felt that this could be a legal problem to pay for this improvement and it was decided to advise the attorney to, be at the work.'~es~on meeting on the 27th of Januaxy. 75.82 Motion bg Clarkson seconded by Zaun to continue this hearing until March 17 at 9zt~ P.M. ~Zaun, Brander, Mako, Emond and Clarkson."age", motion carried. Mr. Ackerman said that he had contacted Dow Aggregates and said they are not .planning to take any gravel out this year. He rec:saended this persai.t be granted. 75.$3 Motion bg Emond seconded bg Zaun to grant Dow Aggregates a permit for gravel for 1875. Brander, Mako, Emend, Clarkson .and Zaun "aye", motion carried. Mr. Ackerman reported that.Denng Dunham had had his gravel pit surveyed and ~2) • CITY f?F LAIS~TILLE CfJUNCIL MEETING JANUARY 2~, 1975 will be selling gravel to Northwest Bituminous. He will also cooperate and take down the old cement plant and this pit will be in first class shape. 75.8 Motion by Clarkson seconded.by ESaond to grant Denny Dunham a gravel permit. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. The building inspector will keep the council informed on this pit. Mr. Ackerman recommended that an excavating permit be granted to Mrs. Seeley as the now has her pit in shape. 7.85 Motion by F.'arond seconded by Mako to grant Mrs. Seeley an excavation permit. Emond, Clarkson, Zaun, Brandes_and Mako "aye", motion carried. Mr. end reported that it was felt that the City should not rent space in Valley Park at this time for an off sale liquor store. It would be more .feasible at this time to enlarge the liquor store. 75.$6 Motion by Emond seconded by Brander to authorize the purchase'of a second Plymouth Sattelite patrol car at the price of ~i#,~tJO. which was the iow qudtation. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. The administrator informed the Council that the Burroughs budgetary accounting program should be on the machine shortly. Mr. Dsee Licht of Midwest Planners presented ~,ie proposed Technical Assistance Contract. He .said the City would be charged a flat fee of ~1(K) per meeting and billed on an expense basis which can be billed back to the developers. 75•$7 Motion by Brander seconded by Emond to enter into the Technical Assistance Contract subject to the attorney's approval. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. Mr. Licht presented a contract for the Central Business District which is a physical plan which would be drafted within 9G days of the execution of this contract with the maximum east being ~975G• A reta~ market .study contract which it an economic analysis study of the .community was also presented. _ This one. would be completed in 3~ daps and the cost would be X2540. Motion by Clarkson seconded by Mako to enter into the Central Business District study contract subject to the attorney's approval. This motion was withdrawn, 75.88... Motion by Clarkson seconded by Mako to enter .into the Central Business District contract-with Midwest Planners subject to the attorney's approval with the fee not to exceed #9750 and said funds to be taken fin the 197+ liquor store profits. Brander, Mako, Emond, Clarkson and Zaun "aye", motion .carried. `~~-75.89 Motion by Mako seconded by Zaun to order the plant and specs for the trunk extension to Dakota Heights. Mako, Emond, Clarkson, Zaun and Brander "aye",.motion carried. 75.90 Motion by Mako seconded by Zaun to extend the meeting. Emond, Zaun, Brander and Mako "aye", Clarkson ~ppored, motion carried. A meeting was set to meet with the planner to review the community development plan on Thursday at 7 P,M, No decision was made on hiring the person for the Title VI act. Mr. Oxley will be requested to attend the meeting of Feb. 3 to explain the police reserve report. 75.91 Motion by Mako seconded by Zaun to authorize. the expenditure of 2~+6,?FQ LS to purchase the administrator an adding machine, Clarkson, Zaun, Br , Mako and Earond "aye", motion carried.
