Present;.- Zaun, Brandes, Mako and Emond. Absent: Clarkson. Also present; Richard Hogan, Administrator, Robert Frigaard, Cit3r Engineer and Roger Knutson, City Attorney.. 75.95 Motion by $randes seconded by Zaun to accept the minutes of the January 24, 1975 meeting. Zaun, Brandes, Mako and Emond "aye", motion carried. 75.96 Motion by Brandes seconded by Emond to accept the minutes of the January 22, 1975 special meeting. Brandes, Makes, Emond and Zaun "aye", motion carried, 75.97 Motion by ~inond seconded by Zaun to pay thee-claims against the City, list attached. Mako, Emond, Zaun and Brandes "aye",motion carried. Mr. Clarkson arrived at 8:14 P.M. The Water and Sewer minutes for January 1~, 1975 were presented. :75.98 Motion by Emond seconded by Brandes to follow the recommendation of the Water 8c Sewer Committeea,~;and set a hearing for sanitary. sewer and water laterals to Oak Knoll Addition for March 3 at 9:fl4 P.M. Emond, Zaun, Clarkson, Brandes and Mako "aye", motion carried. 75.99 Motion by Brandes seconded by Emond to follow the Water & Sewer Committee recommendation and order the engineer to prepare a preliminary report on water and sewer extensions to homes on .215th ~t;c;to Dodd Blvd. and sewer extension. to the homes on the hill west of Lakeville on 210th Street. Clarkson, .Zaun, Brandes, Mako and.Emond "aye", motion carried.. 75.140 Motion by Clarkson seconded by Zaun to follow the Water and Sewer Committee recommendation and reduce the pumping permit fee from $5.04 to $.5©- Zaun, Brandes, Mako, Emond and Clarkson "aye", motion carried. 75.101 Motion by Clarkson seconded by Brandes to instruct the City Attorney ~ix°a~t up an amendment to the scavenger ordinance to change the wording to read that only license~.`holders be allowedto purchase .pumping permitsfrom the City.. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. The Park & Recreation minutes for. January l5, were presented. 75.142 Motion by Emond seconded by Brandes to follow the Park 8c Recreation recommendation and authorize the SnoFest to utilize 167th Street Park at Valley Park, Valley Park #6 Park, Ritter Farm Park and tl~e hockey rinks for their programs and events for dates of February 7, 8 and 9, 1975• Mako, Emond, Clarkson, Zaun and Brandes "aye,', motion carried. 75.143 Motion by Mako seconded by Clarkson to table the Council approval of Policy No. 1, Goals, Responsibilities and Procedures Document until the 14th of February, Emond, Clarkson, Zaun, Brandes and Mako "aye", motion carried. 75.14+ Motion by Mako seconded4m~nd to accept the. resignation of Jim Balliinger from the Park and Recreation Committee and to thank him for his service rendered to the co~~n~ty and present him with a Lakeville flag. Clarkson, Zaun, Brandes, Mako and Emond "aye", motion carried. The Planning Commission minutes of January 16 were presented. 75.105 Motion by Zaun seconded. by Brandes to follow the .recommendation of the Planning Commission and set the conditional use and special use permit. fees at $140 with the renewal at $140, Zaun, Brandes, Mako "a3re", Emond anal Clarkson opposed, motion. carried. 75.146 Motion. by Emond seconded by Brandes to follow the Planning Commission recommendation and reappoint Karl Lutgens to another 3 year term. Brandes, Mako, Emond, Clarkson and Zaun "aye", motion carried. ~1) s • CITY OF LAKEVILLE COUNCIL MEETING FEBRUARY 3, 1975 A representative of Central. Telephone was present explained how the proposed new cable would be installed and its fixture use. This is in regard to their. request for two .utility permits. 75.107 .Motion by Emond seconded by Brander to grant utility permits to the Central Telephone Company to construct manholes and bury telephflne cable along State Highway #50, from intersection of F.A.I.H. #35W in Lakeville, southeast to Dodd Blvd. and 207th St. West and to bury a conduit on the north side of State Hf.~;hway #50, under F.A.I.H. 35W, from the west frontage road to the east frontage road. Mako, Emond, Clarkson, Zaun and Brander "aye", motion carried. Paul Oxley reviewed the Police Reserve Report for 197+. Mr. Robert Jensen, State Representative, asked the Council to pass a resolution urging the Minn. State Legislature to repeal the so-called fiscal disparities law. .:.75.108 Motion by Emond seconded by Brander to adopt the resolution "URGING THE MINI~TESOTA STATE LEGISLATURE TO REPEAL CHAFER 2~ OF NBNNESOTA EXTRA SESSION LAWS 1971,. THE SO-GALLED FISCAL DISPARITIES LAW". Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. Mr, Jim White, State Representative, appeared before the Council to request the passage of a resolution asking for the termination of the taxing. powers of the P~lI'C in Lakeville. 75.1Og Motion by Emond seconded by Zaun to adopt. the resolution that the taxing powers of the MTC in the. City. of Lakeville be discontinued. Clarkson, Zaun, Brander, Mako and Emond "aye", motion carried. Mr. & Mrs. Richard Whither and Mrs. Joe Emond appeared before the Council to complain about rusty water. The Whittlers presented a bill for clothes .that had been ruined by rusty water. 75.:110 Motion by Brander seconded by Zaun to acknowledge receipt of the claim from Richard Whittier. Zaun, Brander, Mako, Emond and Clarkson "aye", motion carried. Mr. Robinette explained what the Utility Dept. had done to remedy.-this situation. Mr. Frigaard also gave his opinion on why thin rusty water was in .the pipes. The Engineer and Public Works Director were instructed to review this matter .and come back. with a recommendation to take care. of this problem. Mr. McGuire asked the Council to set a ,point meeting with the School Board to, 1, set a date for when the water supply would be available to the new high school and 2. consider the easement. A meeting was set for 7:00 P.M. on the i0th of February. Mr. Preeshl and Mr. Maynard Johnson were present to discuss the resolution adopting guidelines for municipal industrial deeelopment bondswith the Council. 75.111 Motion by Clarkson seconded by Zaun to table this resolution on industrial bond policy until March 3 at 9:30 P.M. and instruct the `attorney and administrator to make the necessary changes and send. copies to the proper people. Brander, Mako, Emond, Clarkson and Zeun "aye",motion carried. 75,112 Motion by Emond seconded by Zaun to adopting the resolution setting the X320,000 bond sale for Tuerday, February 18, 1875, at 8:00 P.M. at-she City Council Chambers in Lakeville. Mako, Emond, Clarkson, Zaun and Brander "eye", motion carried. 75.113 Motion by Clarkson seconded by Zaun to accept the resignation of the following. people from the Human Rights Commission: Mrs. Gladys Jackson, John Enggren and Alverta Coram. A letter will be sent thanking thew for-their service to the community. Emond, Clarkson, Zaun, Brander and Mako "aye", motion carried. ~2) CITY. Zaun., Brander', Make, Emond and Clarkson "aye", motion carried. 75.116 Motion by Clarkson seconded by Mako to authorise the advertising for the position of secretary under the Title V'I Comprehensive Training ~.et-Emergency Jobs Program, the etartin~ gage to be $7,800 per year which wage will be paid by the Federal government, Brander, Mako,,Emond, Clarkson and Zaun "aye", motion .carried.
