CITY OF LAKEVILLE

AN ORDINANCE AMENDING TITLE 7, CHAPTER 7
OF THE LAKEVILLE CITY CODE,
THE OFF SITE STORM WATER CONNECTION CHARGE ORDINANCE.
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 7-7-2 of the Lakeville City Code is amended to read as follows:
OFF-SITE STORM: WATER CONNECTION CHARGES: In accordance with the City's
comprehensive storm water plan, before a building permit is issued for any new`dwelling,
commercial, .industrial or institutional buildings, a connection charge for the construction of off-site
storm water improvements must be paid, unless the charge was previously paid in conjunction with
the subdivision of the. property. The square foot charge shall be established by resolution of the City
Council. The charge shall be based upon the type of use and square footage of the parcel on which
.the building is to be constructed. The charge for residential .lots oversized due to individual on site
sewage disposal and water systems will be reduced to the charge that would be imposed on a one-
half (1/2) acre residential lat. An additional charge will then be .imposed if the residential lot. is
.further subdivided less a credit for the charge previously paid. The charge. shall be based upon the
gross acreage of the subdivision less the area to be dedicated to the city for ponding, parks and
wetland, and right of way for state highways, county roads, local arterial roadways and major
collectors. A credit shall be given far any on-site storm water improvement which has been
oversized to serve other property. The charge shall be paid in cash before the building permit is
issued by the City unless the City and landowner agree that the charge may be assessed against the
property.
SECTION 2. Effective Date. This ordinance shall take effect immediately following its passage.
