AN ORDINANCE AMENDING TITLE 1 CHAPTER 7
OF THE LAKEVILLE CITY CODE CONCERNING
CRIMINAL HISTORY BACKGROUND CHECKS
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1. Section 1-7-5 of the Lakeville City Code is amended to provide:
CRIMINAL HISTORY BACKGROUND: The Lakeville Police Department is authorized to
do a criminal history background investigation on applicants for City employment, independent
contractors engaged by the City, and the employees of independent contractors working. for the
City. Before the investigation is undertaken, the person subject to the background check must
authorize the Police Department in writing to undertake the investigation and to release the
information to the City Council, City Administrator, and other City staff as appropriate. Should
the City reject an applicant's request for employment due, partially or solely, to the. applicant's
prior conviction of a crime, the City Administrator shall notify the applicant in writing of the
following:
A. The grounds and reasons for the denial;
B. The applicable complaint and grievance procedure set forth in Minnesota Statutes Section
364.06;
C. The earliest date the applicant may reapply for employment; and
D. That all competent evidence of rehabilitation will be considered upon reapplication.
SECTION 2. This ordinance shall be effective immediately upon its passage.
ADOFTED this 3rd day of October 2005, by the. City .Council of the City of Lakeville,
Minnesota.
