The meetfng was called to o~der•,at the Qrchard Lake Elementary School by Mayor
Lekson. at 7:-30 P.M.
Roll call was taken. Present: Councilmembers Spande, Curry, Zaun, Nelson and
Mayor.Lekson.
Also present: Darrell Schn~i:~iex,,'Consulting City<.Engineer Patrick .Farrell,
City Attorney and Patrick MCGarvey, City Admin,istratorfClerk.
Ma3~or Le~aragn explained th,e. procedure- for the continued public hearing on the
pro$osed~improvement of 175th Street from Trunk 'Highway 5d to Ipava Avenue.

Mr. Schneider explained the new assessment policy the Council had adopted"for
State Aid street improvements which would pertain to 175th Street project.
The front foot. rate of $13,00 for a curb and gutter section and-_$9.00 for
the rural section would remain. However,.: any. platted lot. would not:-be assess-
ed fear-more: than a75`front feet or less than 85 front feet. The exact foot
age woi~ld.be determined by ,dividing the actual front footage in-`half with'a
.maximum or minimum footage as outlined.
Mfr. Schneider also explained that the `area assessment would be for $l00 for "
partel'of property which presently has'a dwelling unit existing on it.
Iii the.futu?re, $100 would be charged for each building permit taken out for
addl.t3.ona.1 dwelling units.

each member of the Council and the .Clerk.
Mr. Schneider explained and answered a question that the road was designed
'for 40 miles, per hour but would be .posted .'for 30 miles ger hour speed limit.
Mr. Ferrell explained the st$tuslof the right-of-way negotiation and that
no negotiation work had been done since the: previous hearing so that the
City would not have a large expense in the event: the project was not apptoved.-
The City Engineer showed a drainage map whereby .the.-City may require drainage
easements for this project in response to~a question.-
Mr. Schneider explained than concrete: curb and gutter will 'be built all along
:.the 175th Street at the eastern-end in the future when development is that
area is better known. The developer will pay his appropris.te share of those
costs and other abutting property owners would pay the difference beatween'ahe
xuxai rate and urban rate at that time..
Mr. Gerk asked,t each member of the Council's feeling were about the pro-
ject.'
Councilman 2atm stated that `he believed .the road was needed, but hewas concern-
ed about the Brea assessment golicy. ,
Councilman Spande.-felt-the road was caused by premature development but that
it was-.needed. He also stated he felt the Council had adopted-the appropriate
galic-lee fore. Senior Citizen deferments.
Councilman Nelson stated ~b~t he would have to .abstain an the vote .Since he
lives"in the area to be a$aessed ;but that he was for the..pro~ect and thought
the Council`. had worked out the best policy'possible for it.
Couneilpersr~n Curry Mated that she felt'the Council had worked out a fair
fiscal policy for the project. She-also suggested the staff look into the
pQSSibility ofadding.'bus lanes on each side of .the road at~the-crest of the
hill to provide for pedestrian crossings.

Mayor Lekson stated that~~ ttte road would pr'"obablq cost near $500,d~ `if it
was put'°off. until 1979 and what t+~~s a good enough season for him tofavor
it at this time.

78.122 Motion was-made by Zaun., seconded by-Nelson to :close the public hearing.
Roll call was taken~an`'the motion. Ayes,-Lekson, Spande, .Curry,. Zaun and'Nelson.
78.123 Motion was made by Spande,_seconded by .Curry to order the improvement of 175th.
Street from Trunk Highway 50 to Ipava Avenue and authorize the Engineer to pre-
pare plans and specifications on the project.
Roll call was taken on the .motion. Ayes, Lekson, Spande, Currgand Zaun. Nays,
none. Abstain:- Nelson.
78.24 Motion was made. by Curry, seconded by Spande to re;~et the bid opening for .the
Redevelopment of Well ~~3 fore April l0, 1978 at 10:00 A.M'.
Roll call was taken on the motion. _Ayes, Lekson, Spande, ,Curry, Zaun and Nelson.
78.125 Motion was made by Curry,. seconded by Zaun to approve the building and site
plan .:for the':. addition. to J & E Manufacturing.

78~.2b Motion was made by Curry, seconded by`~aun. to approve the purchase order to
Layne Minnesota for the repair of Well X62 for their quotation of $8,163, that
being the low quotation for the work.

78.127 Motion was made by Curry, seconded by„Spande to'adopt Resolution 478-22 abating
an assessment for; John and Cheryl Huffmatt on a parcel of property now owned by`
the City of Lakeville..
Roll°call was ':taken. on the motion. Ayes, Lekson, Spande, Curry, Zaun and Nelson.
78.128 Motion was made by Zaun, seconded by .Nelson to approve a claim for payment in
the amount of $100 fore.Robert Hartkopf to be taken out of the Natural Resource
Committee budget..
Roll call was. taken on the motion. Ayes,'Lekson, Spande,'Curry, Zaun. and; Nelson.
78.129 Motion, was made by Zaun, seconded by Nelson to adjourn the Council meeting.
