HomeMy WebLinkAbout02-28-78 CITY OF'LAREVILLE SPECIAL COUNCIL MEETING ,;FEBRUARY 28,.1978 The meeting .was called`to order at 4:00.P.M. by. Mayor Lekson. Roll call was taken. Present: Spande, Lekson, Curry, Zaun and Nelson. .Also. present: Patrick McGarvey, City Administrator/Clerk; Patrick Farrell, Citq Attorney; Reporters for the two local newspapers. Mayor Lekson stated that he had called the special meeting so that the Council could..discuss and possibly decide on a course of action concerning the proposed City Charter that'was being taken up for a proposition through a`pettion being circulated; by Richard LeRoy. Ma~aor Lekson .then asked each member of the Coun- cil to discuss the issue.. Councilman Spande stated that he wasn't for or against the proposition at this time but felt that the ,proposition should be made through and by the City Coun- cil. Councilman Nelson stated'he didn't know enough about the Charter process at this time so he couldn't take's position for or against it. He did state he didn't like what,seemed'to be a back door ..approach to the proposition:, Councilman Zaun stated he didn't feel the Council was' being .given an 'opportunity to assume the full responsibility for the City on such a proposition.; Councilperson Curry stated that a Chanter process gives the`ci izens a chance to'have input into how they want their local government to :operate and that the..process requires avote of ,the citizens, in the affirmative to enact any Charter...... Mayor Lekson stated he didn' feel a Charterwould necessarily result-in better government and that change is not always for. the better. He also stated he doubted that there were eleven people';in the City of Lakeville who could ex- plain the difference between a Charter City and a Statutory City. The City Attorney, .Patrick Farrell, explained that the court appoints the members of a Charter Commission and that State Statute sets a minimum of seven and a maximum'of 15 members. The terms would be staggered to begin with of two and four years each. The City Attorney explained that the judge has the authority to appoint whoever he chooses, but that the 'judge would solicit the City 'Council's' nput into the selection .process. Mr. ,Farrell :stated that it was not a maater of a race-to the Courthouse with a'set-of names. 78.78: After more discussion, motion was .made by Curry, seconded by Lekson to invite Mr. LeRoy and any, of the pet~aione~s tb come"before the .City Council on Mareh 20 to discuss their reasons for petitioning for a City Charter commission. Roll call was-taken on the motion. Ayes, Spande, Lekson, Curry, Zaun:and Nelson:. 78.79 Motion was :made by Spande, seconded by"Lekson to adjourn- he Council meeting.
